RECOMMENDED ACTION: ACCEPT the Housing Authority report on the Section 8 Housing Choice Voucher Program issues within the City of Antioch. II. FINANCIAL IMPACT: None. For reporting purposes only. REASONS FOR RECOMMENDATION/BACKGROUND Some of the City of Antioch residents and groups consider the Housing Authority of the County of Contra Costa and Section 8 Housing Choice Voucher (HCV) Program as the cause for the increased crime, areas of blight, and unattractive homes in single-family home developments. Groups of city residents also assert that poorly maintained rentals led to the decreasing home values in some communities within the city. There are other allegations that the city has a disproportionate number of Section 8 HCV participants living in the city. However, there are other citizens and groups who believe that some of the assertions by some residents are racially motivated. While others believe it is driven by economic biases toward the low income families. Many asserted that the Housing Authority was not responsive to complaints and allegations toward HCV participants by not terminating them from the program quickly and the process is too lengthy. The attached report provides information and data related to the various accusations and allegations by both sides. It also provides the actions taken to address and mitigate complaints directed toward the Housing Authority and the Section 8 HCV program. IV. Over the last six months the Section 8 Housing Choice Voucher (HCV) program within the City of Antioch (City) has received a lot of publicity. Unfortunately this publicity centers on Section 8 HCV program participants negatively impacting the city primarily in the areas of increased crime, areas of blight and other quality of life areas. In review of the materials, reports and newspaper articles and editorials the following assertions have been made: ❑ There are too many Section 8 participants in the City. ❑ Section 8 caused the increase of crime within the City. ❑ Section 8 complaints are racially motivated. ❑ Section 8 payments for rent are too high in the City gfAntioch. ❑ Low-income households•.should live in modest units. This report will provide information that may provide insight into the possible reasons for the various claims and assertions. The information is provided not to refute or substantiate the above but it merely provided as point of references from which to determine the accuracy of the assertions. ❑ There are too many Section 8 participants in the City. In Calendar year 2005 the population of the City exceeded 103,000 people. The number of households, according to the Antioch Chamber of Commerce exceeded 35,000 households. The number of Section 8 HCV participating households numbered 1,511 in December 2005. Based upon this information the Section 8 participating households only represented 4.3% of the total number of households. Throughout the county there were approximately 6,540 Section 8 HCV households in December 2005. The City had approximately 23% of the HCV participants. The number of affordable rental units in the City versus the rest of the County is unavailable at this time. ❑ Section 8 caused the increase of crime within the City. The Housing Authority has accurate data related to the number of Section 8 households in the City from year 2003 when the new management information system was activated. In December 2003 the number of HCV households totaled 1,049. By December 2005 that number had grown to 1,511. B; Antioch Violent Grimes Q -2005 .__ _ ......... ._..... M or Q4 :r40 1 a lo: : . In 2005 there was an increase to 543 total violent crimes. The City Property Crimes as indicated on the below chart from the same report increased steadily from 2,280 in 2000 to 3,106 in year 2004. In year 2005 the number of property crimes decreased to 2,863. The number of households grew from 29,656 in year 2000 to over 35,445 in year 2005. An increase of 5,789 households over the five-year period of which only 462 households over the last three years were Section 8 HCV participants seems highly improbable that the increase in crime is solely attributable to HCV participants. The entire police report provided at the July 22"d Quality of Life Forum by the Antioch Chief of Police is attached. ❑ Section 8 complaints are racially motivated! As the population of the City grew over the last five years a review of the various demographic survey reports reveals a growing diversity in the racial and ethnic cultures within the City. As displayed in the table below there are significant increases over the past five years in all groups with the exception of the decrease in Caucasian population. The U.S. Department of Housing and Urban Development (HUD) annually provides the calculated Fair Market Rates (FMR) for the Contra Costa County area by bedroom size. HUD's calculations by bedroom size are.very involved and take into consideration area household median income by family size, area rental market rates, and other factors to determine'a fair market rate. The Housing Authority then calculates its rental payment standard by bedroom size that is historically less than the FMRs. HUD regulations prohibit the Housing Authority from entering into rental Housing Assistance Payment contract that exceeds the rental payment standard or is not a reasonable rent in the immediate area of the proposed unit, whichever is less. All units rented in the City are at or below the payment standard and meet the rent reasonableness test. The Housing Authority payment standard for the county is as follows: 0 bdrm 1 bdrin 2 bdrm 3 bdrm 4 bdrm 5 bdrm $850 $1,019 $1,208 $1,683 $2,064 $2,373 A review of the statistical median income information for the City and the HCV household rental cost provided contrasting results. The City is comprised primarily of two distinct zip codes, 94509 and 94531. The median household income for 94509 is $58,000, which is $10,000 below the County's household median income of $68,000 annually. The median household income in zip code 94531 is $102,000, which is $34,000 greater than the County household median income. The Housing Authority had 1,470 HCV household residents in Antioch during May 2006. There were 1,188 HCV households residing in zip code 94509 where the average rent of these participants is $1,263 per month. In zip code 94531, which is the southeast portion of the City comprised mostly of 3, 4, and 5 bedroom single-family homes, there were 282 HCV participants. The average rent of the participants was $1,732. Taking into account bedroom size, both averages are within the Housing Authority's payment standard. Table 1 attached provides a more contrasting comparison for the two areas. ❑ The Housing Authority takes too long to drop par licipants from the HCV program and is not resj)onsive to the complaints of the City residents. There is a general lack of understanding related to the termination process of participants in violation of the HCV program regulations. This due process of termination for police documented drug or criminal activity may take fifteen to sixty days depending upon the participant's use of the appeal and hearing processes. Some participants accept the termination and their participation ends within two weeks. Others may go through the whole appeal and court process that may take longer than sixty days. HUD Program violations may take longer since the violation goes through an investigation and case building process to ensure the compilation of. sufficient documentation to support the termination to a hearing officer or, sometimes, the court system. Lease violations are enforceable only by the property owner. 'rhe Housing Authority is not party to the lease contract. Terminations of tenancy by owners for lease violations are processed rather quickly but the eviction process by the owner may take sixty to ninety days. If there are flagrant lease violations by a tenant, the Housing Authority may counsel the I-ICV participant to comply with the lease and meet with the property owner to encourage the enforcement of the lease. ❑ Housing Authority Actions With respect to the complaints related to the Housing Authority, a Section 8 office was opened on June 1, 2006 in the City located at 201 8"' Street with a telephone system and related staff dedicated to the City and east county. Public Notices of the office location and phone numbers were published in local newspapers of general circulation within the Section 8 Housing Choice Voucher/City of Antioch Page 4 of 5 City. An open house at this office was held on June 21, 2006 and was well received by City staff, residents and program participants. The Housing Authority is also maintaining current or actively pursuing the following: Y Implemented and maintaining a system. for tracking City resident complaints and fraud allegations with periodic reports provided to City officials without violating participant's right to privacy. Y Maintain open lines of Communication with key contacts on the City staff. Participate in the City's Quality of Life forums. i Expanded the participation in the monthly East County Rental Association meetings by including, not only the Public Housing east county regional manager, but a Section 8 Manager. (A representative also attends this meeting from the City's Police Department.) Y The City's Chief of Police and the Housing Authority's Director of the HCV program meet bi-monthly. In addition to the above the Housing Authority is planning: Y A Housing Authority open forum for all the residents of the City to discuss Section 8 federal regulations, a general overview of the program purpose, occupancy and payments standards, operational processes, Housing Quality Standard requirements, HUD oversight, and other general information related to the tenant, landlord, Housing Authority working relationship. A landlord or rental property owner workshop in the City to provide updates on HUD and state regulations; best rental practices or resources for screening tenants or enforcing their lease; and, available community resources for their property management needs, i Development of written responses to the City residents regarding their complaints or allegations of tenant fraud without compromising the privacy rights of participants or non-participants. ❑ Other City Resident Concerns There are other issues related to the Section 8 Housing Choice Voucher program that are regulatory in nature and would require federal legislation, e.g., time limits on the program. These issues are program changes as presented by some City residents are beyond the City's Quality of Life scope. Other City resident issues center on the decreased single-family home values and difficulty in selling homes because of rentals in the area. It is beyond parameters of this report to determine the Section 8 HCV program impact. There are too many variables such as real estate market conditions and interest rate changes to quantify their impact on value and single-family home sales. Rent of Landlord $1,732 ADDENDUM September 26, 2006: Agenda Item D.2 On this day, the Board of Supervisors acting as the Housing Authority Board of Commissioners considered accepting a report from the Housing Authority Executive Director on Section 8 housing issues in the city of Antioch and neighboring areas. Supervisor Glover introduced the item, saying lie would like for all invested parties to be able to work together to find solutions to the problems. He stressed the importance of not categorizing all participants in the Section 8 program as problematic. Rudy Tamayo, Housing Authority Executive Director, gave a slide presentation that provided information on the Section 8 housing program processes, complaints received, and Housing Authority efforts, including working more closely with the City of Antioch. Chair Gioia, commenting on the information, said it would be nice to have one chart that shows total numbers broken down by the regions of the County given for all the Housing Authorities that exist. Mr. Tamayo said he would create a chart to provide this information. Supervisor DeSaulnier said he hopes the item can be referred to the Family and Human Services Committee (FHS). He noted that concerns have also been heard from tenants regarding landlords, and he would like to know the County's obligation in the complaint process. He said the biggest question is: Are we enforcing oversight as much as we should? And, where does the funding come from? Are there others who do more? He suggested an"800" number and easy access from the County's web page could be ways the County could do more. He asked how many Section 8 certificates had been pulled from participants in the City of Antioch. Mr. Tamayo responded that 19 participants were terminated from the program last year, and that 5 participants are currently in the process of being removed. Chair Gioia asked if there was a requirement to show criminal activity in order to terminate a Section 8 participant. Rebecca Hooley, Deputy County Counsel, said the standard is a preponderance of the evidence, similar to that of a civil case. She noted that an accusation alone would not be enough to disqualify a participant. Silvano Marchesi, County Counsel, said that HUD requirements related to criminal activity state: "if any member of the family commits..." Mr. Marchesi noted that the term "commits" is not defined for]low it relates to accusations or convictions. The Chair called for public comment and the following people spoke: Sejwinher 26, 2006 Aciclenduln to Agencla Item D.2 Page 2 q f'4 Honorable Donald P. Freitas, City of Antioch, said "The City of Antioch is in crisis," and said the issue is one of oversight as well as how to resolve complaints. IIe said citizens are up in arms because of the length of time it takes to resolve issues and complaints. He said that if Antioch has l.0% of the County's population but 20% of the County's Section 8 participants, that is a problem--but he said it would not be a problem if program requirements were properly enforced. Supervisor Glover referred to Mr. Tamayo's suggestion that there be a biennial review process, and suggested that, at least temporarily, the formation of a committee representing all involved parties that could meet on a monthly basis might be more beneficial because six months in between reviews, at this point, would be too long. Mayor Freitas said that would be step in the right direction. Jim Davis, Antioch City Council, said the number one complaint with the program is the lack of follow-up. He said that when he made a phone call to the Housing Authority without disclosing his position, he received the same "stonewalling" that constituents are complaining about. IIe said that what Antioch wants to hear is the Board's concern and direction: "Where do we go from here?" Supervisor Glover referred to the action plan outlined in the Board Order, and asked if Councilmember Davis thought anything was missing. Councilmember Davis said he thought the plan would be a good start, and noted a willingness to meet with Supervisor Glover on a regular basis. He urged the Board to continue the item until it is complete with numbers that give a clearer picture of the overconcentration of Section 8program participants in Antioch—many of whom, he said, are living in homes that "people who make $1001,000 can't afford to live in." He further suggested the inclusion of 6-bedroom homes in the figures. James Conley, Antioch City Council, said, "It is not a race issue, but a quality of life issue," and further suggested that, "When I have worked hard my whole life to afford my House and I have a neighbor who is not working that is a problem." Chair Gioia suggested it is important to note that finger pointing will never solve the problem and that many Section 8 participants are in compliance with the program. He said that data does not bear out that Section 8 participation increases crime. He further said that many Section 8 participants are working, but even so are unable to afford housing without assistance. He said that it would do a disservice to the community to say we want to limit opportunities for affordable housing. Rather, he said, what is needed is better oversight and enforcement for those who have violated the terms of the program. Sel)ternber• 26., 2006 Addendum to Agenda Item D.2 Page 3 of'4 Supervisor Uilkema said she would prefer that if this item comes back, that it come back to the full Board. She noted several requests: first, on the issue of portability, what does it mean in terms of the program and who implements it? Second, the issue of geographic areas and the setting of rent, and who would make changes or adjustments. Third, she asked about the legal requirements of HUD saying that, while she doesn't want the whole book, she would like information on the requirements that relate to local communities and how it is interpreted so that it can be used. She also suggested the importance of the interrelationships with other agencies. Supervisor Glover spoke to the importance of the landlord's role in the process. He noted that even with a good landlord, evicting a tenant can be a long, drawn-out process. He added that the County's new rental inspection program is a step to help ensure that housing is up to par even in the case of absentee landlords. He noted the importance of"a hand up rather than a handout," and suggested that the issue of how to get people to sustainability should be examined. He asked that all the information and questions raised today should go back to staff so that the data can be retrieved. He also suggested that a meeting be set up with the City of Antioch and their police department's Community Action Team (CAT). IIe further suggested working with Congresswoman Tauscher's office to see who has responsibility and at what levels. He noted that efforts made to this end will carry over for use Countywide. . Supervisor DeSaulnier suggested this subject be returned to the Board quickly. He suggested the issues of an 800 number and of easy access from the County's home page be referred to the County Administrator. He suggested that the topics raised by Supervisor Uilkema should also be brought back to the frill Board, as well as the issue of "best practices." Supervisor Piepho said she would like to have the letter submitted by Gary Gilbert on this item become part of the discussion. She suggested working with the Mayors' Conference to find avenues for the Cities and the County to work together, and said Representatives Tauscher and Pombo may want to be included. Supervisor Glover, noting that many involved parties are saying "it is not about race," said that whether it is fact or fiction, there is an issue of race connected with the Section 8 program. He suggested not brushing it under the table without acknowledging that it is part of the reality for some, and lie noted the importance of inclusively examining all the issues. He said he would make a motion to approve this item inclusive of the comments made by the Board members. John Cullen, County Administrator, said that staff will work with the Housing Authority to organize a response. He said he has identified from the discussion three key areas for the responses: (1) Federal Issues, including rules and eligibility; (2) Identifying tasks that can be worked on immediately with the cities; and (3) County oversight and processes for running a Housing Authority. AXTTIOCE TIOSAL OgNfA DE p PART I CgigES EVELACTIVITYJ S � 20034, 2005 In review of crime statistics for the City of Antioch, the number of Part I crimes decreased and events (calls for service) saw an increase in 2005, compared to the previous year. There were 3517 Part I crimes in 2005 which was a decrease of 156 or 4.3%. There were 77,501 events (calls for service) which was an increase of 2,160 or 2.9%. The increase in the number of events (calls for service) can be attributed to the rise in population and the expansion of the southeast area of the city as well as the eastern region of Contra Costa County which encompasses Oakley, Brentwood and Discovery Bay/Byron. The department handled 13,462 police reports in 2005. This was a decrease of 8 or .06% in comparison to the previous year. In 2005, there were 4,722 adult arrests which was an increase of 877 or 22.8% in comparison to the previous year. Additionally, there were 1,092 juvenile arrests in 2005 which was a decrease of 102 or 8.5%. Part I crimes are identified as homicide, rape, robbery, aggravated assault, burglary, larceny, stolen auto and arson. Two of the most notable statistics were homicides and stolen autos. The homicide rate saw an increase of 4 or 66.7%. However, the number of stolen autos decreased by 127 or 12.2%. This was an encouraging statistic in that the stolen auto rate saw a steady increase over the past several years. The decrease can be partially attributed to the concerted effort County wide in addressing the stolen auto issue. During 2005, the number of homicides, robberies, burglaries and arsons showed an increase in comparison to the previous year. The increases were as follows: • Homicides increased by 4 or 66.7% • Robberies increased by 57 or 32.6% • Burglaries increased by 18 or 2.5% • Arsons increased by 4 or 10.0% During 2005, the number of rapes, aggravated assaults, larcenies and stolen autos showed a decrease in comparison to the previous year. The decreases are as follows: • Rapes decreased by 3 or 9.7% • Aggravated assaults decreased by 32 or 10.2% • Larcenies decreased by 77 or 5.7% • Stolen autos decreased by 127 or 12.2% In order to provide a visual explanation of Part I crimes and selected departmental activity levels, a series of graphs have been incorporated in the report. Despite the economic uncertainties that are being faced by the City of Antioch and the Police Department, we are proud of the service level that we have been able to maintain and provide as the city continues to grow. Our employees are highly dedicated and strive to meet the needs of the citizens by servicing the community and working in partnership to make Antioch a safer place to live and work. Please read this statement aloud in its entirety in order that it may be entered into the record. As an employee of the CCHA from March 2002 thru October 2004 1 obtained extensive knowledge and experience as a Housing Assistant determining the initial eligibility of perspective applicants selected from the Section 8 Waiting List in addition to monitoring their ongoing participation on the program. In essence, as a caseworker I worked with Section 8 tenants from the time they entered program until such time as left voluntarily or their subsidized rental assistance was terminated by HA management personnel which rarely occurred despite the written recommendations of caseworkers which included clear and convinciing documented evidence of lease violations, abuse and/or fraud. In response to Mr. Tamayo's lack of concern for the negative impact section 8 is having on our quality of life, United Citizens for Better Neighborhoods was formed by this writer in April 2006 to serve as a voice of the people due to combat increasing problems section 8 tenants and their families are creating in our neighborhoods and schools. Prior to the commencement of this hearing, city council meetings, and both Quality of Life Forums, the concerns and complaints of Antioch residents were being ignored by Mr. Tamayo and his management staff. It wasn't until this matter received extensive media attention that Mr. Tamayo decided to conduct"damage control" by opening the Antioch office to silence his critics. Moreover, in an meeting held with management personnel in May 2006, Mr. Tamayo informed his staff that the new Antioch office would remain open until the residents of this community stopped complaining which should occur by the end of the year." By this time, his condescending attempt to appease the city council and the residents of this community was "too little, too late." In preparation of submitting this written statement, I have taken the opportunity to review Mr. Tamayo's report dated September 26, 2006, to the Board of Commissioners. At this time I will briefly address two areas mentioned in the report: Section 8 caused the increase of Crime: In various cases, once a self-proclaimed section 8 tenant moved into their new home, within days or weeks area residents began complaining of mid-week and weekend late night parties; evidence of possible drug transactions and criminal activity as homeowners observed unknown individuals arriving and departing within minutes throughout the day and evening hours; sex acts performed at night in vehicles in the driveway of section 8 homes; and excessive profanity and threats of death and physical violence against homeowners who approached their section 8 neighbors requesting that they refrain from the above behavior. In addition, middle and high school students of area homeowners are reporting to their parents that they have been robbed at gunpoint, physically assaulted while walking to and from school, and subjected to"pocket searches" by fellow classmates who boast of moving here on Section 8 from Oakland, Richmond, and San Francisco. When a new neighbor moves into a home that was offered for rental on the CCHA website and the family begins to cause problems in the neighborhood, what do you suggest we do? Ignore the problem and allow this family to compromise the safety and security of our community or should we look the other way while our neighborhoods deteriorate and our families live in fear? Section 8 complaints are racially motivated: Our concerns regarding the section 8 program has NOTHING to do with race. I repeat, RACE IS NOT AN ISSUE. Due the lack of cooperation from the HA, I contacted Mr. Glover by email hoping that he assist us with this matter. Unfortunately, the response I received was in the form of letter written to the CC Times on June 23, 2006 entitled "Shifting Demographics Unsettling for Antioch." In his editorial Supervisor Glover states" The city(Antioch) is more racially and culturally mixed than the Antioch of my youth. Unfortunately, the changes that are happening in Antioch are also giving rise to the racial and ethnic stereotypes that some find comfort in believing." The issue of racism was introduced and turned into a "hot button" issue by your board member and colleague, District 5 Supervisor Federal Glover. I believe Mr. Glover's decision to make this a racial issue was based upon his assumption that I was an individual of European decent. It has been brought to my attention that he was quite shocked to find out that I am a black man. To reiterate, UCBN is concerned about behavior, nothing more, and nothing less. As the Executive Director of the Contra Costa Housing Authority, Rudy Tamayo will say or do just about anything to avoid taking personal responsibility for the failures of his administration. Its no surprise that Mr. Tamayo sent new Asst. Executive Director Mark Stephenson to face the angry residents of Antioch. Due to his lack of preparation, Mr. Stephenson was short on answers and quick to provide excuses for every question he encountered. In an sad attempt to deflect attention away from executive and management personnel Mr. Stephenson placed all blame for Housing Authority problems on housing assistants, inspectors, and other clerical personnel. With every question Mr. Stephenson was asked the answer was the same, "We're doing the best we can, with the people we have." I'm confident that Mr. Stephenson and Tamayo's willingness to continously ridicule the work performance of their staff during city council meetings and community forums will improve staff morale resulting in better customer service. The most disturbing comments were made by a section 8 tenant who angrily informed Mr. Stephenson that she has contacted Housing Manager Ingrid Layne on several occasions to report that she is currently being sexually harrassed by her landlord but Ms. Layne has refused to return any of her phone calls. If Ms. Layne and other managers of the Housing Authority refuse to investigate the sexual harrassment complaint of a section 8 tenant whose personal safety may be at risk, why should the citizens of Antioch or East County expect anything different? Ladies and Gentlemen, the current administration of the Contra Costa Housing Authority is incapable of effectively administering the Section 8 program as confirmed by the letter of Congresswoman Ellen Tauscher to the Secretary of HUD requesting immediate intervention. As the governing Board of the HA it is my sincere hope that your decision to conduct this hearing serves as a preliminary measure in your search for the truth. Its imperative that you take into consideration that had Mr. Tamayo and the HA acted in good faith when dealing with our city council and the residents of this community, this crisis may have been avoided.
