DIRECT the Clerk of the Board to Publish the Notice of Public Hearing in compliance with Section 6062a of the California Government Code. 3. DIRECT the Public Works Director to mail notice of hearing in compliance with Government code Sections 54986 and 66017. (Districts I and II) [CDD-CP#06-13] Project No.: 0676-6P4007 DATE: September 26, 2006 PAGE: 2 of 2 FISCAL IMPACT: The amendment and adoption of urgency interim ordinances and regular ordinances adopting revised STMP fees will result in the collection of potential fees from new developments to fund subregional transportation improvements within the West Contra Costa Transportation Advisory Committee fee area. There will be no impact to the General Fund. REASONS FOR RECOMMENDATIONS AND BACKGROUND: On July 18, 2006, the Board of Supervisors adopted revised STMP fees to fund the revised subregional transportation improvement program for the West Contra Costa Transportation Advisory Committee(WCCTAC). Ordinance No. 2006-21 adopted fees with an effective date 60 days after passage. Ordinance No. 2006-20,which was an urgency ordinance effective for 30 days,adopted interim fees pending the 60-day effective date of Ordinance No. 2006-21. On August 15, 2006,the Board of Supervisors adopted a second urgency ordinance(Ordinance No. 2006-31) extending the urgency ordinance for an additional 30 days. (Districts I and H) [CDD-CP#06-13] Project No.: 0676-6P4007 DATE: September 26, 2006 PAGE: 2 of 2 FISCAL IMPACT: The amendment and adoption of urgency interim ordinances and regular ordinances adopting revised STMP fees will result in the collection of potential fees from new developments to fund subregional transportation improvements within the West Contra Costa Transportation Advisory Committee fee area. There will be no impact to the General Fund. REASONS FOR RECOMMENDATIONS AND BACKGROUND: On July 18, 2006, the Board of Supervisors adopted revised STMP fees to fund the revised subregional transportation improvement program for the West Contra Costa Transportation Advisory Committee(WCCTAC). Ordinance No. 2006-21 adopted fees with an effective date 60 days after passage. Ordinance No. 2006-20,which was an urgency ordinance effective for 30 days,adopted interim fees pending the 60-day effective date of Ordinance No. 2006-21. On August 15, 2006,the Board of Supervisors adopted a second urgency ordinance(Ordinance No. 2006-31) extending the urgency ordinance for an additional 30 days. The amendment to Ordinance No. 2006-21, together with new urgency (Ordinance No. 2006-64) and regular (Ordinance No. 2006-62) ordinances will result in the collection of potential fees from new developments to fund subregional transportation improvements within the West Contra Costa Transportation Advisory Committee fee area CONSEQUENCES OF NEGATIVE ACTION: Failure to fix the hearing date to consider adoption of amendment, urgency and regular ordinances for the Subregional Transportation Mitigation Program(STMP)fees will result in the loss of potential revenues for this fee program.
