Authorize the Public Works Director, or designee, to reimburse Shapell Industries of Northern California the
amount of$664,928.63 with funds from the Dougherty Road Maintenance Fee (Fund 8192) for work completed

FISCAL IMPACT:
There is no impact to the General Fund. The County has not funded any of the improvements related to this action.
The improvements were conditioned of the developer and completed by the developer with oversight by the County.
Upon approval by the Board of Supervisors, the amount of$664,928.63 will be reimbursed from the Dougherty
Road Maintenance Fee.

BACKGROUND/R.EASON(S) FOR RECOMMENDATION(S):
The Dougherty Road Bridge was constructed by Shapell Industries of Northern California under Subdivision 99-
08306 as a condition of approval. The Board of Supervisors accepted these improvements as complete on
December 13, 2005.
Condition of Approval #174 of Subdivision 99-08306 states that these improvements are eligible for
reimbursement from the Dougherty Road Maintenance fee. Engineering Services staff has reviewed the costs in
accordance with the conditions of approval and have determined the costs to be accurate.
Upon approval by the Board of Supervisors, the amount of$664,928.63 will be reimbursed from the Dougherty
Road Maintenance Fee.
CONSEQUENCES OF NEGATIVE ACTION:
If the action is not approved, Shapell Industries of Northern California will not be reimbursed.

SUBJECT: Authorization of Reimbursement for RA 1157 - Dougherty Road Bridge
Engineering Services is authorizing Accounting to reimburse Shapell Homes for the
County's share of the Dougherty Road Bridge project located within Dougherty Valley (in
San Ramon area), District III. Engineering Services has prepared the attached cost
breakdown spreadsheet and have reviewed the accompanying binder which contains
consultant/contractor invoices and cancelled checks for the Dougherty Road Bridge project.
The submitted invoices and cancelled checks are acceptable and within the scope of the '
project. We request Accounting to verify the cost breakdown and supporting documentation.
The County's share of $664,928.63 has been calculated based on pre-determined
percentages: 28% for bridge related work, 80% for road related work, and 47% for County
review/inspection work. These percentages represent the additional cost to Shapell Homes
beyond the project requirements for Alternative 1 specified in #174 of the attached
conditions of approval which the County is financially responsible. Shapell Homes shall be
reimbursed for the County's share of the project from the Dougherty Valley Road
Improvement Fee Trust (Fund No. 8192).
The reimbursement payment should be made out to "Shapell Homes" at the following
address: 100 North Milpitas Blvd., Milpitas, CA 95035, Attn: Sam Worden.
Please notify and copy Teri Rie, Engineering Services upon the issuance of the
reimbursement check and return the attached binder for our files.

173. Once the connection from Stoneleaf Road to existing Dougherty Road is made and until
such time as at least two lanes of future Dougherty through Gale 4 are built, construction of
Stoneleaf roundabout and the approximately 143-homes that front on Stoneleaf Road shall
be delayed until a review by the Public Works Department demonstrates that roundabout and
home construction will not adversely affect through traffic on existing Dougherty Road.
174. Prior to filing the first final map with residential lots, the applicant shall construct a new
EVA road/sewer maintenance/flood control access road/trail bridge (EVA road/trail bridge)
across Main Branch Alamo Creek for the future trail aliunment/EVA access road along
` ;, A existing Dougherty Road, with a minimum of 2-feet of freeboard above the 100-year water
surface. The bridge shall.be designed to accommodate H2O truck loading. The minimum .
cic;1; %, idth of the bridge shall be the paved width of the approach EVA road/trail. The
transitions from the bridge to the EVA road/trail shall meet the requirements of the San
Ramon Valley Fire District and have a minimum design speed of 20-miles per hour (mph),
subject to the review and approval of Engineering Services.
If, prior to filing the first final map and prior to the start of design for the EVA road/trail
bridge, the County formally requests the applicant to remove the existing Dougherty Road
` bridge and construct a new bridge to accommodate 2-lanes of traffic, in lieu of the EVA
road/trail bridge described above, the applicant shall design and construct a bridge structure
of a width specified by Public Works with a minimum of 2-feet of freeboard above the 100-
year water surface and provide for H2O truck loading. The applicant shall submit for review
and approval of the Public Works Department two conceptual plans-and two construction
cost estimates for the following two alternatives: Alternative 1) for the bridge structure
contemplated in the first paragraph (i.e. an EVA road/trail bridge with transitions to the
existing road for a design speed of 20-mph; and Alternative 2) for the 2-lane bridge
structure, with transitions to the existing road. If the new 2-lane bridge is fonnally requested
by the County prior to issuance of the grading permit, the applicant shall demonstrate to the
Public Works Department that they are diligently working to coordinate the construction the
2-lane bridge to occur with the temporary Dougherty Road closure allowed with the
Stoneleaf/Gale 3 grading. The applicant is financially responsible for all costs of alternative
one. The applicant shall be reimbursed for the additional construction costs (costs above and
beyond the costs of alternative one) of providing the wider bridge and the transitions from
the Dougherty Valley Road improvement Fee Trust (Fund No. 8192) to the extent that funds
are available. If the additional construction costs for alternative two exceeds the amount of
funds available in the Dougherty Valley Road Improvement Fee trust (Fund No. 8192), the
applicant shall provide sufficient funds necessary to complete the construction of the bridge
and roadway, which amount will be credited against future Dougherty Road Improvement
Fees (Fund no. 8192). The applicant and the Public Works Department shall work together

on alternative designs to minimize costs. The applicant shall submit original copies of
invoices, receipts, and construction contracts to Engineering Services for reimbursement.
175. Prior to issuance of the 500`h Gale 3 building permit (exclusive of building permits for any
apartment units), the applicant shall submit a bonding exhibit to the Public Works
Department for a four lane section of Dougherty Road between the northern and southern
intersections with Bollinger Canyon Road. Prior to the 700`h Gale 3 building permit
(exclusive of building permits for any apartment units), the applicant shall post a bond for
the improvement of a four lane section of Dougherty Road between the northern and
southern intersections with Bollinger Canyon Road.
EIR Mitigation Measures
176. This project shall comply with the mitigation measures set forth in the project environmental
impact report. Conformance with the EIR includes the following:
A. Contribute this development's fair share toward the cost of improving the
intersection of Dublin Road with Dougherty Road as follows:
1) Northbound approach: provide two exclusive left-tum lanes, one shared
through-left lane, two exclusive through lanes, and one exclusive right-turn
lane.
2) Southbound approach: widen Dougherty Road to provide one left-turn lane,
three through lanes, and one right-turn only lane.
3) Eastbound approach: Widen Dublin Road to include one left-turn lane, two
through lanes, and two right-turn only lanes.
4) Westbound approach: Widen Dublin Road to include two left-turn lanes, two
through lanes and one right-turn only lane.
Compliance with this measure shall be satisfied by paying the Dublin-Contra Costa
Mitigation Fee (DCC Fee). The DCC Fee will be collected at building permit.
(EIR Mitigation Measure 4.6-2)
B. The applicant shall ensure that approximately 80 percent of the housing in the
development shall be located within one quarter mile of a designated transit route,
consistent with Dougherty Valley Specific Plan Policy C-5 and the collector road
system in Figure 8 of the Specific Plan.
