BARRY, AICP Costa COMMUNITY DEVELOPMENT DIRECTOR '`' County r�i'Gii+'� DATE: September 19, 2006 SUBJECT: MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF ANTIOCH (CITY) AND CONTRA COSTA COUNTY (COUNTY) TO ALLOW THE CITY TO USE THE COUNTY'S GREEN BUILDING MATERIALS DISPLAY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION APPROVE and AUTHORIZE the Community Development Director, or his designee, to execute a Memorandum of Understanding (MOU) between Contra Costa County and the City of Antioch to allow the City to use the County's Green Building Materials Display. FISCAL IMPACT No impact to the County General Fund. The City would be responsible for repairing or replacing the Display if damaged as well as liable for any injuries or damage caused by the Display while in the City's custody. The Display is currently located in the CDD offices on the 4th Floor, North Wing of 651 Pine Street in Martinez. This 7 ft high by 4 ft wide Display contains more than fifteen environmentally benign construction materials, such as carpet made with recycled plastic water bottles and counter top made with recycled glass bottles. The Display is intended to give the public an opportunity to learn about and view samples of environmentally conscious building materials that can be used in new homes or in remodeling projects. When the Display was purchased, staff envisioned loaning the Display temporarily to other jurisdictions in the County so it could be displayed in various locations which would encourage a wider range of local builders to use green building materials. The City of Antioch will sponsor and staff a booth at the Antioch Home and Garden Show on October 13th- 15th. Staff from the City has asked to borrow the Display for a limited duration to exhibit it at the Show and their City offices. Because of the large size of the Display, an MOU was prepared to protect the County against any liability resulting from relocation of the Display. Furthermore,the MOU would require the City to repair or replace the Display if it is damaged while in the care, custody, or control of City staff, however caused.
