In order to assist in the landslide repair,the County first acquired temporary rights from all the owners within the subdivision to construct a large earth buttress,drainage facilities,and to make other repairs to stabilize the common area. Alger the initial repairs were completed,the County began acquiring fee title to the affected portions of the common area in order to secure permanent access rights for ongoing maintenance. This was accomplished by negotiating purchase and sale agreements with the individual property owners. Ultimately, twelve homeowners refused to sell their portions of the common area to the County. Therefore, the Board of Supervisors adopted Resolution 2000/498 as a prerequisite action prior to acquiring the land by eminent domain proceedings. Since the adoption of the resolution of necessity, many of the twelve homeowners have sold their properties. Therefore, rescission of the resolution is being sought to give Public Works staff time to acquire the remaining properties with these new owners through negotiations. CONSEQUENCES OF NEGATIVE ACTION: Failure to adopt this Board order may make a satisfactory resolution of this case more diff cult, expensive and time- consuming. I I .
