Adopted this Order on November 6, 1984 , by the following vote:
AYES: Supervisors Fanden, Schroder, McPeak, Torlakson
NOES: None
ABSENT: Supervisor Powers
ABSTAIN: Non
SUBJECT: Hearing on recommendation of the County Planning
Commission with respect to rezoning application 2606-RZ
filed by Jerry Loving and Associates (applicant) , and Bob
Mueller, Monarch Management Inc. , (owners) , on application
for approval of Development Plan No. 3036-84 and a
Tentative Map for Subdivision No. 6517 in the Pacheco
area.
This being the time fixed for hearing on recommendation of
the County Planning Commission with respect to rezoning application
2606-RZ filed by Jerry Loving and Associates (applicant) , and Bob
Mueller, Monarch Management Inc. , to rezone approximately 1 .4 acres
from Multiple Family Residential (M-17) to Planned Unit Development
(P- 1 ) , and also a request for approval of Development Plan No .
3036-84 for 29 residential units , and a Tentative Map for
Subdivision No. 6517, in the Pacheco area; and
Harvey Bragdon, Assistant Director of Planning, described
the property site and advised that a Negative Declaration of
Environmental Significance was posted for this proposal; and
The Chairman opened the public hearing; and
Marlys Gilber, 120 Henry Clay Court , Pacheco, appeared to
express her opposition to the proposed project stating that she was
opposed to the number of condominiums being proposed for the subject
property and also stated that she would like her property also zoned
as Multiple Family Residential ; and
Harvey Bragdon advisd that the proposed project was con'-
sistent with the General Plan for this area, and advised that the
proposed 29 unit complex was within the permitted range; and
Linda Brallier , 110 Henry Clay Court , Pacheco, appeared
and stated that she had never received any notice of the proposed
rezoning; and
Supervisor Torlakson inquired as to what Mrs . Brallier' s
position was on the proposed project; and
Mrs . Brallier commented that with a condominium project
and an apartment complex being built she felt some mitigation
measures should be taken with respect to the traffic situation in
this area, and urged the Board not to approve the proposed project
until some specific measures had been taken to solve the traffic
problems; and
Bob Mueller, owner of the subject property, appeared and
commented that this proposed project was being built in a transition
area, and stated that he was prepared to make the entire presentation
to the Board of Supervisors that was made at the Planning Commission
stage; and
Supervisor Torlakson stated that he thought it would be
helpful to touch on the traffic problems in particular and commented
that without any action from the Board the application would be able
to put an equal number of units on the site; and

Jerry Loving, applicant , appeared and stated that he felt
the best way to go about his project was a Planned Unit approach,
and also stated that the proposed structure would be low in profile ,
and an all wood exterior , also commenting that these units would be
quality constructed units; and
Supervisor Torlakson requested comments from the County
Public Works Department with respect to the proposed project; and
Boyd Jewett , County Public Works Department , advised that
the Public Works Department had taken into consideration the
requirement plans on the adjacent development as the required right
of way and the number of units being considered, and commented that
it was felt that the drainage was adequate; and
Harvey Bragdon advised that the density catagories in the
General Plan do not coincide with the current zoning, and commented
that the applicants are going from (M-17) to (P-1 ) in order to
achieve 21 units per acre, and stated that the applicants are
meeting the requirements of the Plan; and
The Chairman closed the public hearing, there being no one
else desiring to testify; and
Supervisor McPeak commented on the problem of the notifi-
cation procedure for this proposal and stated that perhaps one solu-
tion to this problem would be to have the envelopes addressed to the
person listed on the latest tax roll , or "current resident" , and
stated that in her opinion the project is consistent with the County
General Plan and also is also consistent with the current zoning,
and therefore recommended that the Board approve the proposed pro-
ject, as recommended by the County Planning Commission; and
Board members considered the matter, IT IS ORDERED that
rezoning application 2606-RZ is APPROVED as recommended by the County
Planning Commission and that Development Plan No . 3036-84 and Tentative
Map for Subdivision No . 6517 in the Pacheco area APPROVED subject to
conditions of approval imposed by the County Planning Commission, as
set forth in Exhibit A attached hereto and by reference incorporated
herein, and the Board hereby adopts ADOPTS the Planning Commission' s
reasons as set forth in its Resolution No . 51-1984 as its determination
for this decision.
IT IS FURTHER ORDERED that Ordinance No. 84-58 giving effect
to the aforesaid rezoning is INTRODUCED , reading waived and November
29, 1984 is set for the adoption of same .
