(District III)I SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ` ADOPT Resolution No. 2006/ for Road Acceptance 00-01099 (cross-reference Subdivision 98-08166), accepting the Completion of Warranty Period and Release of Cash Deposit under the Road Improvement Agreement, for proj ect being developed by Hofmann Land Development Company,Discovery Bay area. (District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The improvements have met the guarantee performance standards for the warranty period following completion and acceptance of improvements. (District IH) On November 30, 2004,this Board resolved that the improvements for Road Acceptance 00-01099(cross- reference Subdivision 98-08166)were completed as provided in the Road Improvement Agreement with Hofmann Land Development Company, and now n the recommendation of the Public Works Director; �the The Board hereby FINDS that improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance.Therefore,IT IS BY THE BOARD RESOLVED that the Public Works Director is AUTHORIZED to: • refund the$4,100.00 cash deposit(Auditor's Deposit Permit No. 348211,dated April 10,2000)plus interest in accordance with Government Code Section 53079, if appropriate, to Talisman Realty Group, Inc., dba Hofmann Land Development Company,pursuant to the Road Improvement Agreement and Ordinance Code Section 94-4.406. NOW THEREFORE BE IT RESOLVED that the warranty period has been completed and the Road Improvement Agreement and surety bond are exonerated.
