SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2006/ for Road Acceptance 98-01089(cross-reference Subdivision 98-08166 and
Subdivision 98-08167),accepting the Completion of Warranty Period and Release of Cash Deposit under the Road
Improvement Agreement, for project being developed by Hofmann Land Development Company,Discovery Bay
area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The improvements have met the guarantee performance standards for the warranty period following completion and
acceptance of improvements. The five-year warranty on roads with profile slopes less than 1%is guaranteed by a
separate bond/agreement.
CONSEQUENCES OF NEGATIVE ACTION:
The developer will not receive a refund of their cash deposit and the road improvement agreement and
performance/maintenance Surety bond will not be exoneraleZr—_

RESOLUTION NO. 2006/479
SUBJECT: Accepting the Completion of Warranty Period and Release of Cash Deposit under the
Road Improvement Agreement for Road Acceptance 98-01089 (cross-reference
Subdivision 98-OS 166 and Subdivision 98-08167),Point of Timber Road,for project
being developed by Hofmann Land Development Company, Discovery Bay area.

On November 30,2004,this Board resolved that the improvements for Road Acceptance 98-
01089 were completed as provided in the Road Improvement Agreement with Hofmann Land
Development Company, and now on the recommendation of the Public Works Director;
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance. Therefore, IT IS BY
THE BOARD RESOLVED thatJ!the Public Works Director is AUTHORIZED to:

• refund the $4,500.00 cash deposit (Auditor's Deposit Permit No. 348211, dated April 10,
2000)plus interest in accordance with Government Code Section 53079, if appropriate,to
Talisman Realty Group, Inc., dba Hofmann Land Development Company, pursuant to the
Road Improvement Agreement and Ordinance Code Section 94-4.406.
NOW THEREFORE BE IT RESOLVED that the warranty period has been completed and
the Road Improvement Agreement and surety bond are exonerated.
