HomeMy WebLinkAboutMINUTES - 11061984 - T.11 �lTHE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 6, 1984 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Hearing on appeal of Mary Lou Cox, (applicant and owner) from Board of Appeals denial of appeal of condition 2B(a) from conditions of approval of Minor Subdivision 52-84 in the Knightsen area . This being the time fixed for hearing on the appeal of Mary Lou Cox, (applicant and owner) from the Board of Appeals denial of appeal of Condition , 2B(a) from conditions of approval of Minor Subdivision 52-84 in the Knightsen area; and Harvey Bragdon, Assistant Director of Planning, described the property site and advised that a Negative Declaration of Environmental Significance was originally posted on MS 9-84, the previous application for the current MS 52-84, and , therefore , was not required with this refiling; and The Chairman opened the public hearing; and Mary Lou Cox, applicant , appeared and commented that Minor Subdivision 9-84 at one time was approved and then expired when her husband became ill , and advised that after the expiration she submitted another application, and commented that all of the papers had been signed and 'requirements for Minor Subdivision 9-84 had been met when the Subdivision expired; she also stated that it was not at this point possible to recover anything unless this Minor Subdivision was allowed to go through; and Ms . Cox commented that , in her opinion, the on-site drainage improvement requirements for this Minor Subdivision are illogical , unaffordable and unrealistic , and urged the Board to grant the appeal on condition 2B(a) of conditions of approval of Minor Subdivision 52-84 in the Knightsen area; and Supervisor Torlakson inquired as to whether the previous approval for this Minor Subdivision included a Collect and Convey condition; and Boyd Jewett , County Public Works Department , advised that a Collect and Convey requirement was not imposed on the original Minor Subdivision approval , as it was prior to adoption of the Collect and Convey Ordinance , and advised that the old application expired and there is now a new application before the Board which does require the applicant to comply with the Collect and Convey requirements for a Minor Subdivision; and Brad Cox, 18 Terranova, Antioch, appeared and urged the Board to approve Minor Subdivision 52-84 without conditions , stating that without the passing of this Minor Subdivision, the subject pro- perty would be virtually useless; and Supervisor Torlakson inquired as to whether it would be more feasible on a parcel of this size to have a retention pond or some sort of mitigation for the run-off water, and inquired if the applicant would be able to redesign an adequate mitigation site for run-off water; and -1- Boyd Jewett advised that the applicant could investigate whether there is permeability, and stated that if it infiltrates it could infiltrate the water that would otherwise run-off , but that you would then have maintenance problems , and advised that this is where you would run into problems in dealing with adequate drainage faci- lities downstream; and Supervisor Torlakson advised that he supported the staff' s stronger recommendation of the Collect and Convey requirements in a general sense , and stated that he would like to support granting the appeal , but because of the County' s liability to law suits , he commented that he would like to have some additional time to review this proposal; and The Chairman closed the public hearing, as no one else desired to testify; and Supervisor Torlakson advised that he would like to have the opportunity to further study this appeal and to meet with the applicant and the County staff in order to explore other alternatives available in this situation, rather than to take any specific action at this time. Board members having considered the matter , IT IS ORDERED that the hearing on the appeal of Mary Lou Cox, (applicant and owner) from Board of Appeals denial of appeal of Condition 2B(a) from conditions of approval of Minor Subdivision 52-84 in the Knightsen area is CLOSED and decision on the aforesaid matter is DEFERRED to December 4 , 1984 at 2: 30 p.m. Orig Dept: Clerk of the Board cc: Director of Planning Public Works Director County Counsel Mary Lou Cox I hereby codify that this is a true and Correct copy of an action taken and entered on the minutes,of 11w Board of Supervisors on the date shown.
