SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT Resolution No. 2006/ 4-12- to approve the wage schedule and salary increase agreed to by
Contra Costa County and Public Employees Union Local No. 1 for the classification of Public Health
Nurse in accordance with Section 58.8, subsection A.3., of the current Memorandum of
Understanding.
BACKGROUND:
The salary increase and lump sum payment for Public Health Nurses are made in accordance with
Section 58.8, subsection A.3., of the current Memorandum of Understanding which states, "The pay
differential between the classes of Public Health Nurse and Registered Nurse existing on June 30,
1985 shall be maintained for the duration of this Memorandum of Understanding."

BE IT RESOLVED that the Board of Supervisors of Contra Costa County ADOPT the wage
schedule, effective October 1, 2005 as agreed by and between Contra Costa County and the
Public Employees Union Local No. 1 for the classification of Public Health Nurse represented
by that employee organization.
BASE RATE OF PAY
October 1, 2005 3% increase in base rate of pay
In lieu of a retroactive pay calculation requiring special payroll processing back to October 1,
2005, the County will make a lump sum payment to each current employee, without back
interest, for the months of October 1, 2005 through June 30, 2006 computed as follows:
Employee regular pay, hourly based earnings, including overtime pay and other
earnings computed as a percentage of base pay, will be added together for each
applicable pay period to determine appropriate pay base. This base will be multiplied
be three percent (3%).
The payment amount thus computed will be added to the employee's August 10, 2006
paycheck where it will be listed as "LUMP SUM PAY" and will be subject to required
deductions such as taxes and retirement.
Any employee believing there is an underpayment resulting from this methodology
exceeding fifty dollars ($50.00) may contact their Department personnel officer. The
Auditor-Controller's Office will investigate and issue the additional pay, if owed, as soon
as possible.

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT Resolution No. 20061 to approve a three percent (3%) salary adjustment, effective October 1,
2005, for employees in the classification of Public Health Nurse, and approve a Lump Sum Payment
Agreement between Contra Costa County (County) and Public Employees Union Local No. 1 (Local One) for
the classification Of Public Health Nurse consistent with Section 58.8, subsection A.3., of the 1999-2005
Memorandum of Understanding between the County and Local One.
BACKGROUND:
When the County and the California Nurses Association entered a new Memorandum of Understanding in
early June 2006, employees in the classification of Registered Nurse received an increase in their base rate of
pay effective October 1, 2005.
Section 58.8, subsection A.3., of the 1999-2005 Memorandum of Understanding between the County and
Local One states, "The pay differential between the classes of Public Health Nurse and Registered Nurse
existing on June 30, 1985 shall be maintained for the duration of this Memorandum of Understanding."
Employees in the classification of Public Health Nurse will receive a three percent (3%) salary adjustment,
effective October 1, 2005, and a lump sum payment on their August 10, 2006 paychecks. The proposed
Lump Sum Payment Agreement between the County and Local One would be consistent with the spirit of
Section 58.8, subsection A.3, of the 1999-2005 Memorandum of Understanding between the County and
Local One. Under the Lump Sum Payment Agreement, in lieu of a retroactive pay calculation requiring special
payroll processing back to October 1, 2005, the County would make a lump sum payment to each currently
employed County Public Health Nurse, without back interest, covering October 1, 2005 through June 30,
2006. The lump sum payment would also require Local One, on behalf of itself and its members, to withdraw
with prejudice any grievance or complaint concerning Section 58.8, subsection A.3, of the Memorandum of
Understanding between the County and Local One.

LUMP SUM PAYMENT AGREEMENT
1. Effective June/s , 2006,this agreement is made by and between Public Employees Union
Local No. 1 (Local One) and the County of Contra Costa (County).
2. Section 58.8, subsection A.3., of the current Memorandum of Understanding (MOU) between the
County and the Local One (1999-2005) states that"ftjhe pay differential between the classes of
Public Health Nurse and Registered Nurse existing on 6/3D/85 shall be maintained for the
duration of this MOU."
3. Considering section 58.8,subsection A.3., of the MOU, and in lieu of a retroactive pay calculation
requiring special payroll processing back to October 1,2005, the County will make a lump sum
payment to each currently employed Public Health Nurse, without back interest, covering October
1, 2005, through June 30,2006, computed as follows:
a. Public Health Nurse regular pay, hourly based earnings including overtime pay
and other earnings computed as a percentage of base pay will be added together
for each applicable pay period to determine appropriate pay base. This base will
be multiplied be three percent(3%).
b. The payment amount thus computed will be added to the Public Health Nurse's
August 10, 2006 paycheck where it will be listed as"LUMP SUM PAY' and will
be subject to required deductions such as taxes and retirement.
C. Any employee believing there is an underpayment resulting from this
methodology exceeding fifty dollars($50.00) may contact their Department
personnel officer. The Auditor-Controller's office will investigate and issue the
