RECOMMENDATION: 1. FIX August 15, 2006 at 9:30 am for a public hearing on the proposed increase of certain Forensic Service Fees and to set fees for new investigative services. 2. DIRECT the Clerk of the Board to publish required notices pursuant to Government Code 6061. II. FINANCIAL IMPACT: The adoption of the attached Resolution will allow the County to recover the costs associated with the listed activities in the Fee Schedule dated July 1, 2006. III. BACKGROUND: In the 1994 -1995 fiscal year, the Forensic Services Division was required to recover certain operational costs from laboratory users. A fee schedule was established defining the cost of evidence examination services for the users of laboratory services. The current fee schedule was adopted in February 2004. Since that time the Forensic Services Division has experienced increases in costs for salaries and supplies. The new schedule also includes fees for evidence examination and support services that have been added since the last Board approval. New fee set at $175 per hour for Contra Costa Government Agencies and $195 per hour for private attorney, pro per defendant and non Contra Costa government agencies. Fingerprint Services — increase in fees to Contra Costa Government Agencies of $10 per hour and $25 per hour for private attorney, pro per defendant and non Contra Costa government agencies. New fee set at $110 per hour for Contra Costa Government Agencies and $125 per hour for private attorney, pro per defendant and non Contra Costa government agencies. Controlled Substance Analysis - increase in fees to Contra Costa Government Agencies of $10 per hour for clandestine drug laboratory analysis and $20 per hour for private attorney, pro per defendant and non Contra Costa government agencies. New fee set at $175 per hour for Contra Costa Government Agencies and $195 per hour for private attorney, pro per defendant and non Contra Costa government agencies. Increase in fees to Contra Costa Government Agencies and private attorney, pro per defendant and non Contra Costa government agencies for the analysis of solid dosage drug testing from a per type of drug submitted charge to a per item submitted charge. New fee set at $75 per item for Contra Costa Government Agencies and $95 per item for private attorney, pro per defendant and non Contra Costa government agencies. Toxicology Analysis - increase in fees to Contra Costa Government Agencies of $5 - $15 per sample (depending on type of drug) and $20 - $25 per sample (depending on type of drug) for private attorney, pro per defendant and non Contra Costa government agencies. New fees set at $50 - $150 per sample for Contra Costa Government Agencies and $70 - $200 per sample for private attorney, pro per defendant and non Contra Costa government agencies. Increase in fees in the amount of $10 - $20 per sample for general toxicology screens for private attorney, pro per defendant and non Contra Costa government agencies. New fees set at $95 - $200 per sample. (No change to existing fees for Contra Costa Government Agencies for general drug screens.) Blood Alcohol Analysis - increase in fees for the analysis of blood, breath or urine for alcohol in the amount of $5 for Contra Costa Government Agencies and $10 per sample for private attorney, pro per defendant and non Contra Costa government agencies. New fees set at $45 per sample for Contra Costa Government Agencies and $75 per sample for private attorney, pro per defendant and non Contra Costa government agencies. Testimony — increase in fee for testimony not resulting from laboratory analysis in the amount of $10 per hour for Contra Costa Government Agencies and $20 per hour for private attorney, pro per defendant and non Contra Costa government agencies. New fees set at $175 per hour for Contra Costa Government Agencies and $195 per hour for private attorney, pro per defendant and non Contra Costa government agencies. The proposed schedule provides for fees for new services in the following areas: Adds screening and analysis of methadone in blood and urine. Fee for Contra Costa Government Agencies is $40 per sample (screening only); $100 - $120 per sample (confirmation). Fee for private attorney, pro per defendant and non Contra Costa government agencies is $60 per sample (screening only); $130 per sample (confirmation). Adds toxicology analysis of other drugs based on availability. New fees set at $100 per sample for Contra Costa Government Agencies and for private attorney, pro per defendant and non Contra Costa government agencies. DUI Checkpoints and Breath Operator Training — adds services of a toxicologist and breath alcohol instrument at DUI checkpoints for Contra Costa Government Agencies. New fee set at $300. Adds breath operator training (after business hours) for Contra Costa law enforcement agencies. New fee set at $200. Reports and Case Documentation — adds reports and case documentation available on CD. New fee set at $175 per hour for research and compilation for Contra Costa Government agencies and $195 per hour for research and compilation for private attorney, pro per defendant and non Contra Costa government agencies. Digital Images — adds digital images of crime scenes or evidence documentation available on CD at no cost for Contra Costa Government agencies and $5 per CD plus $195 per hour compilation time for private attorney, pro per defendant and non Contra Costa government agencies. Drug Samples forwarded for Referee Analysis — adds forwarding of drug evidence to a private laboratory for referee analysis. New fee set at $175 per hour for Contra Costa County Government Agencies and $195 per hour for private attorney, pro per defendant and non Contra Costa government agencies. Testimony- adds 3 hour minimum for testimony provided outside of Contra Costa County for private attorney, pro per defendant and non Contra Costa government agencies. This action supersedes any prior evidence examination fees set by the Board. IV. CONSEQUENCE OF NEGATIVE ACTION: Negative action will result in insufficient revenue to offset the cost of these activities.
