L Recommended Action:
APPROVE the first Amendment to Agreement No. 181 to provide right of way services by the County to the
Contra Costa Transportation Authority for the State Route 4 East, Loveridge Road to Somersville Road
Project,to increase the payment limit by$10,000 to a new payment limit of$20,000,effective July 20,2005;
and AUTHORIZE the Chair,Board of Supervisors,to sign the Agreement on behalf of the County.

Contra Costa Transportation Authority will pay the actual costs for Real Property staff right of way services.
111. Back round and Reasons for Recommendations:
The Contra Costa Transportation Authority requires a variety of right of way services but has no right of way
staff and has contracted with the County for these services. The Real Property staff will prepare up to nine
right of entry documents on private property for hazardous materials investigations.
IV. Consequences of Negative Action:
The Contra Costa Transportation Authority would not be able to contract for the County's right of way

FIRST AMENDMENT TO CCTA AGREEMENT NO. 181

FOR
STATE ROUTE 4 (EAST) WIDENING PROJECT

WHEREAS,the Contra Costa Transportation Authority and Contra Costa County Real Property Division
("CONSULTANT")entered into Agreement No. 181 on December 15,2004;and
WHEREAS,the parties now wish to amend the Agreement to increase the maximum compensation and to expand
the scope of services; now therefore be it
MUTUALLY AGREED:
(1) that Article 2 of the agreement is amended to expand Task 1 to include tasks preparing up to nine Rights of
Entry for hazardous materials investigation; and
(2) increase the Total Agreement Value by$10,000 for an overall Total Agreement Value of$20,000; and
(3) that all other items and conditions of the Agreement shall remain in effect.
In witness whereof,the parties hereto have executed this First Amendment to the Agreement as of the day and year
above written.

Summary of Issues In December 2004,the Authority approved Agreement No. 181 with Contra
Costa County for right of way assistance for the State Route 4(e) Widening
Project from Loveridge Road to Somersville Road. This agreement was
initially set up on a task order basis with the first task to prepare rights of
entry for geotechnical work. It is now necessary to obtain rights of entry for
hazardous materials investigations on nine parcels.
Recommendations Staff recommends approval of Amendment No. 1 to County Agreement No.
181,Task Order 1, foran amount not to exceed$10,000. Thisbringsthe
total amount of the agreement to $20,000.
Financial Implications Adequate funding to accommodate this amendment is included in the 2005
Strategic Plan for Project 1406.
Options The APC could elect not to approve this work however;the right of way
activities are the critical path element for the project.

Background
In June of 2004,the Authority approved having Caltrans perform the bulk of the right of way work for the
State Route 4(e)Widening Project from Loveridge Road to Somersville Road. Caltrans had scheduled
staff to become available in the spring of 2005 when it was anticipated that the Environmental Document
for the project would be cleared. In December of 2004,the Authority approved Agreement No. 181 with
the County Real Property Division to assist with some early advanced right of way work,as needed. The
agreement was set up on a task order basis in order to define specific work items and associated costs as
different issues arise.
The first task was for the County to prepare eight rights of entry on private property for geotechnical
borings for structures such as noise barriers and retaining walls; this work has been completed. The need
as now arisen for hazardous materials investigations. County staff can quickly and efficiently complete
this work because some of the parcels were involved in the prior rights of entry for geotechnical work.
It is still anticipated that a future task,being discussed with the County,will be for the County Real
Property Division to assist with holding the hearings and granting the actual Resolution of Necessity
(RON)through the Contra.Costa County Board of Supervisors.
