SPECIFIC REQUEST(S)OR RECOMMENDATION(S)8 BACKGROUND AND JUSTIFICATION
RECOMIV4ENDATION(S):
Approve and authorize the Health Services Director, or his designee (Randall Sawyer) to execute
on behalf of the County, Contract #22-276-16 with City of Richmond (Fire Department), a
municipal corporation, in an amount not to exceed $258,695, to provide AB 2185 inspections
(Hazardous Materials Release Response Plans and Inventory) for the period from July 1, 2005
through June 30, 2007.
The Contractor has requested a reciprocal indemnification clause, as a matter of equity, to cover
reimbursement for damages and injuries arising from the County's negligence. In the view of
County Risk Management, this indemnification will create a minimal potential loss. The Health
Services Department desires to expedite approval of the Agreement as written.
FISCAL IMPACT:
This Contract is funded 100%by AB 2185 fees the County charges to businesses for the handling
of hazardous materials, and is included in the Department's budget.
BACKGROUND/REASON(S)FOR RECOMIVIENDATION(S):
Pursuant to the Hazardous Materials Release Response Plan and Inventory Program (AB 2185),
approved by the Board of Supervisors on April 28, 1987, the County Health Services
Department's Hazardous Materials Division is responsible to ensure that each hazardous materials
handler in Contra Costa County is inspected annually. The County has contracted with the City of
Richmond Fire Department since January 1988 to provide certain AB 2185 inspections at
County's request.
On July 22, 2003, the Board of Supervisors approved Novation Contract #22-276-15 with City of
Richmond (Fire Department), for the period from July 1, 2003 through June 30, 2005, for the
provision of AB 2185 inspections.
Approval of Contract #22-276-16 will allow the Contractor to continue providing services through
June 30,2007.
