SUBJECT: REIMBURSEMENT FOR STATE SPECIAL ELECTION
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
REQUEST the Legislature and Governor to take action to fully reimburse Contra Costa County for
the estimated $2.5 million expenditure that it will incur in complying with the Governor's order to
conduct a special election on November 8, 2005.
BACKGROUND/REASONS FOR RECOMMENDATION:
On June 1, 2005 the Governor proclaimed and ordered a statewide special election be held on
November 8, 2005 to submit to the voters various initiative measures. In making hisp roclamation
the Governor stated:
The funds necessary to pay the claims of local agencies arising from their costs
incurred to conduct the special statewide election shall be included in the State
Budget for the 2006-2007 fiscal year, or in an earlier enacted claims bill. (italics
added)
Unless reimbursed by the State, the estimated $2.5 million cost of the special election in Contra
Costa County will be borne by the County General Fund, thus reducing funding available for
critical services and supports to its citizens and businesses. It is neither right nor fair that local
government should bear the cost of conducting a special election that is called by the State.
Since the election is being held in 2005, reimbursement of County costs should be included in the
FY 2005-06 State budget. Requiring counties to conduct a special election in November without
full reimbursement provided for in the FY 05-06 budget is also contrary to the expectations of the
voters when they passed Proposition 1A in 2004. This proposition restricted the State's ability to
impose unfunded State mandates on local governments, a clear message from local voters to the
State that local government should be able to allocate its general funds to meet local needs and
priorities.
