RECOMMENDATIONS
ADOPT resolution determining that specified properties(located within Development Zone 2 of the Pittsburg/Bay
Point BART Station Area Specific Plan)in the Bay Point Redevelopment Project Area are non-conforming and
authorize the Redevelopment Director to prepare and distribute to all property owners requirements to be selected
as master developer.
FISCAL IMPACT
No General Funds would be used.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Bay Point Redevelopment Plan allows the Agency to require owner participation agreements to accomplish
development in conformance with the Plan. The Redevelopment Agency's Rules to Implement Business Tenant
Preference and Owner Participation also provides that the Agency notify affected property owners(as well as non-
owners)of the opportunity for owner participation. The above-recommended resolution will make the required
determinations and direct staff to prepare and distribute the requirements for submitting qualifications. Statements
of Qualifications would have to be submitted approximately 45 days after Agency action on this resolution,
followed by the proposals two months later. Based on the forgoing, a recommendation for aster Developer
could be before the Agency in December 2005.

SUBJECT: Requirements for Selection of Master Developer for Development Zone 2 of the
Pittsburg/Bay Point BART Station Area Specific Plan, in the Bay Point
Redevelopment Project Area
The Contra Costa County Redevelopment Agency RESOLVES THAT:
The Board of Supervisors (the "Board") of the County of Contra Costa(the "County")
adopted the Bay Point Redevelopment Plan by Ordinance No. 87-102 on December 29, 19879
and subsequently amended by Ordinance No. 94-64 on December 6, 1994 and Ordinance No.
99-05 on February 23, 1999 (the "Redevelopment Plan"), which Redevelopment Plan sets forth a
plan for redevelopment of the Bay Point Redevelopment Project Area(the "Project Area").
The Contra Costa County Redevelopment Agency (the "Agency") is responsible for
administering the Redevelopment Plan to cause redevelopment of the Project Area, including
assembly, site preparation and redisposition of property both within and outside the Project Area
for private redevelopment consistent with the Redevelopment Plan.
The Redevelopment Plan provides that the Agency may by Resolution,require owner
participation agreements to help achieve such conformity and may select and designate those
properties which shall be subject to owner participation agreements.
The Redevelopment Agency's Rules to Implement Business Tenant Preference and
Owner Participation in the Bay Point Project Area provide that the Agency shall notify affected
property owners, as well as, non-owners of the nonconformity of property and feasibility for
owner participation, and also set forth the procedures and schedules for soliciting proposals from
the owners as well as non-owners to become master developers of the parcels.
The County Board of Supervisors adopted the Pittsburg/Bay Point BART Station Area
Specific Plan (the "Specific Plan") in 2002 to guide development and redevelopment of the area.
The Specific Plan designates the 23-acre Development Zone 2 as Residential Mixed Use, with

the potential to develop 40,000 sq. ft. of commercial use and approximately 325 residential units;
Multiple-Family Residential, with a potential of developing up to 120 units and Park and
Recreation.
NOW, THEREFORE, BE IT RESOLVED, that the Contra Costa County Redevelopment
Agency hereby finds and determines as follows:
1. The present use of the parcels shown in Exhibit A attached hereto do not conform
to the requirements of the Redevelopment Plan in their current use as single-
family residential parcels with respect to parcel size, utilization, and parcel
configuration.
2. The parcels shown in Exhibit A should be assembled for purposes of
redevelopment so as to allow for integrated development of the parcels primarily
for mixed-use high and medium density residential and commercial uses as called
for in the Redevelopment Plan (and Specific Plan).
3, The owners of the parcels shown in Exhibit A shall be notified of the
nonconformance of their parcels and in accordance with Section III A(2) of the
Agency's Rules to Implement Businesses Tenant Preference and Owner
Participation, the owners of the parcels shall be given the opportunity to submit
qualifications and a proposal to be selected as master developer of the parcels
shown in Exhibit A to redevelop the parcels in conformance with the
Redevelopment Plan and Specific Plan.
4, The Staff shall prepare and distribute to all interested owners and non-owners
requirements for submittal of qualifications and proposals. All statements of
qualifications shall contain the following information, which shall form the basis
for selection of a master developer:
a. Identity of Proposal
b. Description of the Development Team(including owner and join ventures or
partners of, architects, engineers).
c. If the development team includes partners or joint ventures or is to be carried
out by a person or entity that has entered into a purchase or option agreement
with the owner, the relevant joint venture partnership, option or partnership
agreement should be provided.
d. Development experience of members of the development team.
e. Financial information regarding the development team including any
financing and evidence of the development team's financial ability to carry
out and complete the contemplated redevelopment.
