AUTHORIZE Public Works Director to sign said Agreements on behalf of the County. C. AUTHORIZE the Chair, Board of Supervisors, to execute Grant Deeds on behalf of Contra Costa County and ACCEPT the Grant Deeds from Ida F. Alfaro, Cheryl Mann, Eloise Amerson, Sergio Singhbhairo, Pearl A. Davis, Grethen A. Gray and Raul Mendoza. DIRECT the Real Property Division to have the above referenced Deeds recorded in the office of the County Recorder. [I. Financial lmpact: This activity is funded by Contra Costa County Redevelopment Agency (100%). Ill. Reasons for Recommendations and Background: The improvements in connection with the North Broadway Area Infrastructure Project are part of the Contra Costa County Redevelopment Agency's design to improve and upgrade the existing infrastructures. The County purchased nine properties for the new street alignments. In the final design only 44-feet is required for the road right of way, which leaves an excess of 3-feet on either side of the right of way. Public Works and the Redevelopment Department would like to exchange this surplus right of way in an effort to provide additional buffer space for the adjacent property owner and to release the County of further maintenance responsibilities of surplus right of way, and obtain land rights necessary for handicap ramps. IV. Consequences of Negative Action: The County would be responsible for the maintenance of excess right of way and the project will not have sufficient nand rights to allow construction of the handicap ramps in accordance with the approved plans and specifications. THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on September 14, 2004, by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, GREENBERG, DESAULNIER AND GLOVER NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 20041 461 (Streets & Highways Code § 8355) SUBJECT: ADOPT Resolution No. 2004/461 approving Real Property exchange and Sales and Purchase Agreements in connection to the North Broadway Area Infrastructure Project— Phase Ill [CDD-CP#97-36] Project No. 0662-6R4141 Bay Point Area. District V. The Board of Supervisors of Contra Costa County RESOLVES THAT: On December 2, 1997, the Board approved the proposed project and adopted the Negative Declaration pertaining to this project and directed the filing of a Notice of Determination. The Notice of Determination was filed and posted on December 5, 1997. Contra Costa County acquired certain real property in the unincorporated area of Bay Point at various times during 2003 and 2004 for roadway purposes. Portions of said properties as described in Exhibits "A" are DETERMINED to be surplus and no longer necessary for County or other public purposes. This Board hereby APPROVES and AUTHORIZES the exchange of said property, pursuant to Streets & Highways Code Section 8355. This Board hereby APPROVES and AUTHORIZES the Public Works Director to execute said Sales and Purchase Agreements on behalf of the County. The Chair, Board of Supervisors, is hereby AUTHORIZED to execute Grant Deeds on behalf of the County in consideration for ACCEPTING Grant Deeds from Ida F. Alfaro, Cheryl Mann, Eloise Amerson, Sergio Singhbhairo, Pearl A. Davis,Grethel A. Contra Costa County is authorized to offer a one time rebate up to $75.00 per property with submittal of a receipt for the expenses and a site visit from the County to confirm installation of compliant plants/shrubs or ground cover as shown on Exhibit "Y for the corner lots within six months of completion of the project". 4. The right, title and interest in the property to be conveyed shall not exceed that vested in the Grantor or Grantee, and said property is conveyed subject to all existing easements, covenants, conditions, restrictions, reservations, and all other encumbrances, whether the same be recorded or unrecorded. 5. Grantor shall pay all costs of recording fees, if applicable. 6. Grantor shall retain possession of the property up to the date of recording the deed. 7. The Grantee understands that these conveyances are subject to approval by the County Board of Supervisors,and the Grantor reserves the right to cancel the conveyance at anytime prior to the recording of the deeds. In the event of cancellation of the conveyance, all monies deposited shall be refunded without payment of interest. 8. Upon approval of the conveyance of the property by the County Board of Supervisors, Grantor will cause to be delivered to Grantee a grant deed to the property properly executed and recorded by the Grantor. Grantee may not take possession of the property until a deed from Contra Costa County has been recorded. 9. Further Assurances. Whenever requested to do so by the other party, each party shall execute, acknowledge and deliver all further conveyances, assignments, confirmations, satisfactions, releases, powers of attorney, instruments of further assurance, approvals, consents and all further instruments and documents as may be necessary, expedient, or proper in order to complete all conveyances, transfers, and assignments under this Agreement, and do all other acts and to execute, acknowledge, and deliver all documents as requested in order to carry out the intent and purpose of this Agreement. 10. The properties described herein are being conveyed on an "as is" basis and Grantor or Grantee makes no warranty, claim or guaranty, or any kind, as to the condition and/or possible uses of the land or any improvements thereon. Grantee understands that the property is not capable of independent use and agrees and approves of the combining of this property with his/her adjacent property to create one parcel. 11. This Agreement may not be amended or altered except by a written instrument executed by County and Grantee. The parties herein have set forth the whole of their agreement and the performance of this agreement shall relieve the grantor of all further obligations or claims on this account.
