As you may recall, this refund is requested because at the time of filing of the Grant Deed, a determination was made that the property had $60,000 in equity at the time of transfer(considering the mortgages, etc. remaining on the property). Thus, transfer tax in the amount of$66.00 was charged. (This amount was not put on the fact of the deed, however, as we requested through a separate document that such tax info not be put on the face of the deed.) In reality, however, the amount of encumbrances being assumed by Buyer actually exceeds the value of the property. Page 1 of the attached contract shows the.encumbrances remaining on the property totaling $422,153.09 ($324,755.96 +63,778.65 + 7,618.48). This exceeds the value of the property. Therefore, the correct amount of tax(as was originally computed) is$5.50($1.10 tax rate x$5,000 cash paid to Seller). This amount is also reflected on page 1 of the attached contract. The rest is just math.... $66.00-$5.50 would equal a refund of$60.50. Please take alook at the attached and let me know your thoughts. Thank you again for all your help!
