SUBJECT: Approval of a Cardroom Work.Permit SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION 1. RECOMMENDED ACTION: APPROVE the issuance of a cardroom work permit to Mr. Jason Struthers with the Condition that he sign and abide by the agreement (between the Contra Costa County Office of the Sheriff and Mr. Struthers) indicating that should Mr. Struthers engage in any conduct that would disqualify him from obtaining a cardroom work permit, including,but not limited to, the items listed.in County Ordinance Code 52-3.707 during the annual life of the permit the permit shall be rescinded and deemed void. Permit to be reviewed for renewal on an annual basis and each year a new agreement shall be signed by Mr. Struthers upon approval of such permit. II. FINANCIAI.IMPACT: NONE III. BACKGROUND/REASON-61BACKGROUND/REASON-61 FOR RECOMMENDATIONS : As instructed by the Board of Supervisors at their regular scheduled meeting on'Tuesday, July 27, 2004, representatives of the Contra Costa County Office of the Sheriff met with Mr.Struthers to discuss the matter of reconsideration of the issuance of a cardroom work permit. After reconsideration of the matter the Contra Costa County Office of the Sheriff recommends that Mr. Struthers be granted a renewal to his cardroom work permit for a one(1)year period with the condition that he sign and abide by the agreement (between the Contra Costa County Office of the Sheriff and Mr. Struthers) indicating that should Mr. Struthers engage in any conduct that would disqualify him from obtaining a cardroom work permit,including but not limited to,the items listed in County Ordinance Code 52-3.7017 during the annual life of the permit said permit shall be rescinded and deemed void. STRUTHERS I, JASON A. STRUTHERS agree to the condition of my cardroom work permit renewal for a one (1) year period (life of permit). Condition: The renewal of my cardroom work permit is subject to annual review. Should at any time I engage in conduct that would disqualify me from obtaining a cardroom work permit, including but not limited to, the items listed in County Ordinance Code 52--3.707, 1 acknowledge and am hereby advised that the Contra Costa County Office of the Sheriff shall rescind and deem my work permit void. RECOMMENDED ACTT©N: DENY the appeal by Mr. Jason A. Struthers for the issuance of a cardroom work permit. II. FINANCIAL,IMPACT: NONE ILS. BACKGROUND ASQN_(S)FOR RECOMMENDATION(S): County Ordinance 52-3 regulates cardrooms in the County. Authority for enforcing the ordinance is delegated to the Sheriff. The Ordinances provides procedures and standards for the licensing of cardrooms as well as for the issuance of work permits to those who wont in cardrooms. On May 24,2004,Mr.Struthers applied to the Office of the Sheriff for a cardroom work permit. The permit was denied. At Mr. Struthers request,the application and proposed denial was reviewed. After consideration of all available information the reviewing officer concluded that the proposed denial would remain in effect. On June 2,2004,Mr. Struthers was notified that his application for a cardroom work permit was denied. On June 28, 2004, Mr. Struthers filed an Administrative Appeal with the Clerk of the Board requesting a hearing before the Board of Supervisors.
