11. FISCAL. IMPACT:
This project is fully funded by Flood Control Zone 3B funds.
111. REASONS FOR RECOMMENDATION/BACKGROUND:
On July 20, 2004, the Board approved a Board order(Item C.10)authorizing the Chief Engineer of
the Flood Control District or his designee to advertise for bids for the San Ramon Creek Mitigation
Planting project, with the bids to be received on Tuesday, August 24, 2004. District staff was
unable to complete the bid packet until July 27, 2004, and the "Notice to Contractors" was not
ready for mailing and publication, as required by Public Contract Code Section 22037, until that
date. To comply with the 30-day mailing requirement of Section 22037, it was necessary to mail
and publish the"Notice to Contractors"with a later bid receipt date(i.e.,August 31,2004)in place
of the August 24, 2004 bid receipt date listed in the July 20, 2004 Board order. To accommodate
the one-week adjustment of the bid receipt date, District staff recommends that the Board; (1)
amend its July 20, 2004 order to correct the bid receipt date from August 24, 2004 to August 31,
2004; and (2) ratify the publication and mailing of the "Notice to Contractors,,, which listed the
correct August 31, 2004 bid receipt date.
The project is needed as environmental mitigation to the San Ramon Creek Improvements
Project, originally constructed in 1998 and 1999. This project replaces deficient plantings and
irrigation from the 1999 San Ramon Creek Mitigation Planting project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
The Board reviewed and approved the final EIR for the San Ramon Creek Chaney Road to
Livorna Road Improvement Project (PW85-55) on June 16, 1987 and Addendum #1 (1/12/93,
CP92-84),Addendum#2 (5/2/95, CP95-29),Addendum#3 (10/17/95, CP95-58)and Addendum
#4 (12/12/95, CP95-64) and certified that the Final Environmental Impact Report for the project
was completed in compliance with the California Environmental Quality Act, The Final EIR was
presented to the Board and the Board reviewed and considered the information contained in it,
and found that the project will have significant effects on the environment, each of which is
determined to be mitigated or unavoidable. The findings for the San Ramon Creek Flood Control
Project between Charley and Livorna Roads were made by the San Ramon Valley Regional
Planning Commission to comply with Section 15091 of the CEQA Guidelines and incorporated
herein by reference. The Board reviewed and approved the original San Ramon Creek Mitigation
Planting project (2/23/99 CP95-64).
IV. CONSEQUENCES OF NEGATIVE ACTION;
If the recommended action is not taken, the project may have to be re-bid, resulting in potential
delays in starting the project and complying with required environmental mitigation.
