RECOMMENDATIONS :
ADOPT Resolution No. 2004/ 451 for Subdivision 01-08564, accepting completion of improvements for
Subdivision Agreement(sound wall), San Ramon(Dougherty Valley) area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The developer,Shapell Industries ofNorthern California,has competed improvements(sound wall)as per resolution
No. 2002/597, dated October 1, 2002.
CONSEQUENCES OF NEGATIVE ACTION:
The developer,Shapell Industries of_Northern California will not receive the cash deposit as per the resolution dated
August 17, 2004. "`-

The Public Works Director has notified this Board that the improvements (sound wall) in
Subdivision 01-08564 have been completed as provided in the Subdivision Agreement with Shapell
Industries of Northern California heretofore approved by this Board in conjunction with the filing of
the Subdivision Map.

SUBJECT: Accepting completion of improvements for Subdivision Agreement(sound wall)
for Subdivision 01-08564, San Ramon(Dougherty Valley) area. (District III)

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of August 17, 2004 thereby establishing the six-month terminal period for the filing of liens in
case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $46,750.00,
Bond No. 929248004 issued by the above surety be RETAINED for the six month lien guarantee
period until February 17,2005, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the performance surety Bond No, 929248004 issued by
the above surety and the subdivision agreement(sound wall) are EXONERATED.
BE IT FURTHER RESOLVED that the improvements(sound wall)in subdivision 01-08564
are ACCEPTED AS COMPLETE.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the $1,000.00 cash deposit (Auditor's Deposit No.
392675, dated September 10, 2002)plus interest in accordance with Government Code 530709, if
appropriate, to Shapell Industries of Northern California pursuant to the requirements of the
Ordinance Code.
