SUBJECT: Accepting Completion of Warranty Period and Releasing Cash Deposit for Faithful Performance
for Road Acceptance 00-01100.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 20041 442 for Road Acceptance 00-01100(cross-reference Subdivision 8023),accepting
completion of warranty period and releasing cash deposit for faithful performance for Point of Timber Road,Byron
area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The improvements have met the guaranteed performance standards for the warranty period following completion
and acceptance.
CONSEQUENCES OF NEGATIVE ACTION:
The developer will not receive their deposit or have their performance surety exonerated as guaranteed by the
subdivision agreement.

RESOLUTION NO. 2004/ 442
SUBJECT: Accepting completion of warranty period and releasing cash deposit for faithful
performance, for Point of Timber Road for Road Acceptance 00-01100 (cross-
reference Subdivision 8023),Byron area. (District III)
On March 25,2003,this Board resolved that the improvements for Point of Timber Road for
Road Acceptance 00-01100(cross-reference Subdivision 8023)were completed as provided in the
Road Improvement Agreement with Hofmann Land Development Company and now on the
recommendation of the Public Works Director,
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $4,800.00 cash
deposit(Auditor's Deposit Permit No. 401184,dated February 27,2003)plus interest to Hofmann
Land Development Company in accordance with Government Code Section 53079(if appropriate),
Ordinance Code Section 94-4.406, and the subdivision agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed and the Road
Improvement Agreement and the performance/maintenance surety for $71,535.00, Bond No.
ST8711, issued by St. Paul Fire and Marine Insurance Company are exonerated.
