SUBJECT: Policy to grant a 5% preference to Contra Costa County vendors
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
DIRECT the Director of the Department of General Services to initiate a five percent
preference to Contra Costa County vendors on all sealed bids or proposals except
with respect to those contracts which state law requires to be granted to the lowest
bidder. A Contra Costa County vendor is a firm or dealer with fixed offices or
distribution points located in and having a street address within the county for at
least six months prior to the date upon which a request for sealed bids or
proposals is issued. In addition the vendor must hold a valid business license
issued by the county or a city within the county. This policy will take effect 60
days after Board approval.

This proposal will strengthen the existing economy as well as add an incentive for
business to stay in and relocate to Contra Costa County. Locally owned
businesses are more likely to produce income,jobs, tax receipts and charitable
donations in the community over several generations. Whenever ownership
coincides with the location of a business all these transactions reinforce one
another and increase the money that is recycled back into the community.

August 10, 2004
On this day,the Board of Supervisors considered directing the General Services Director to initiate a five
percent preference to Contra Costa County vendors on all sealed bid proposals except with respect to
those contracts which state law requires be granted to the lowest bidder.
Public Comment was presented by the following persons:
Ed Roth, 30 Golf Club Road,Pleasant Hill
Kris Hunt,Contra Costa Taxpayers Association, 838 Escobar Street,Martinez
Supervisor DeSaulnier requested County Counsel prepare a draft ordinance to be returned to the Board
for consideration and approval.
Supervisor Gioia noted the interplay between this proposed ordinance and the Small Business Enterprises
Ordinance would have to be examined to ensure the two ordinances can work together.
Chair Glover suggested the draft ordinance go to the Internal Operations Committee before it is returned
to the Board.
Supervisor Gioia suggested potential cost issues be examined,both in regard to the costs to the County
and to the benefits for local employment.
Supervisor Greenberg said she would like to see in the report how many contracts of the type to be
affected by the ordinance the County typically sees.
Supervisor DeSaulnier said that surveying other jurisdictions that have enacted similar ordinances could
provide some useful information.
Supervisor Uilkema suggested the language of the ordinance should be made more specific so as to
clarify that the ordinance only applies to businesses in the unincorporated areas.
Supervisor DeSaulnier said the ordinance should be examined to ensure it will partner well with the cities.
The Board of Supervisors took the following action by unanimous decision:
REFERRED to the Internal Operations Committee the matter of directing the General Services Director
to initiate a policy for a five percent preference to Contra Costa County vendors on all sealed bid.
