SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful performance for
Minor Subdivision 99-00007.
SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 20041 406 for Minor Subdivision 99-00007 accepting completion of warranty period
and release of cash deposit for faithful performance,being developed by Ashley V.Partners,Alamo area. (District
III)
FISCAL IMPACT:
There is no impact to the General Fund.
BACKGROUND/REASON(S)FOR RECOMMENDATION(S):
On June 17, 2403, the Board resolved that the improvements in Minor Subdivision 99-00007 were completed as
provided in the Subdivision Agreement with Ashley V. Partners. The improvements have satisfactorily met the
guaranteed performance standards rewired by the County.
CONSEQUENCES OF NEGATIVE ACTION:

RESOLUTION NO. 2004/ 406
SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful
performance, Minor Subdivision 99-00007, Alamo area. (District III)
On June 17,2003,this Board resolved that the improvements in Subdivision 99-00007 were
completed as provided in the Minor Subdivision Agreement with Ashley V.Partners and now on the
recommendation of the Public Works Director;
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $1,000.00 cash
deposit (Auditor's Deposit Permit No. 362473, dated January 25, 2001) plus interest to Pickett
Development Company in accordance with Government Code Section 53079 (if appropriate),
Ordinance Code Section 94-4.406, and the subdivision agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed and the
Subdivision Agreement and the performance/maintenance surety bond are exonerated.
