BACKGROUND / REASONS FOR RECOMMENDATION When the Centra Costa Transportation Authority (CCTA) approved a draft final Transportation Expenditure Plan (TEP) for the extension of the local transportation sales tax (Measure C-1988) on May 26, 2004, they included a new requirement within its Growth Management Program (GMP)the development and adoption by the cities, towns, and County of a mutually agreed-upon new Urban Limit Line(ULL). The CCTA approved "principles" that envisioned a process conducted by the cities, towns County to develop a new ULL between July 1, 2004 and December 31, 2004. The CCTA acknowledges that it is not a land use agency and that the effort to develop a new mutually agreed- upon ULL is the sole province of the cities, towns, and County. Discussions about initiating this process have been discussed at the Public Managers Association (PMA), and the CCTA has formally offered to fund a coordinator to help facilitate local jurisdictions to initiate the process, and agreed to retain [Ion Blubaugh, consultant, for this purpose. Attached for the Board's consideration under Exhibit "A" is a letter from Amy Worth, Chair, CCTA, dated June 25, 2004,to the Chair, Board of Supervisors,describing the initiation of this process along with a request to designate one elected official to work on a committee with appointees from the other local jurisdictions in each sub-region to develop the new ULL and asks for support from managers and planning staff for this process. It is staff's understanding that there will be four sub-region committees formed based approximately on the boundaries of CCTA's sub-regional transportation planning committees(West County—WCCTAC, East County-TRANSPLAN, North-Central—TRANSPAC,and South Central-SWAT). Each jurisdiction within the sub'-region have been asked to appoint one elected official and the PMA has designated a City Manager from within that sub-region to assist Mr. Blubaugh. Staff recommends the Board consider designating a Board member(s)to each of the sub-region committees. The following table, which relates the four Contra Costa sub-regions to the Supervisorial districts, has been prepared to guide the Board in its consideration of this matter: District 1 I District H District 111 District IV District V West County (WCCTAC) East County (TRANSPLAN) North-central (TRANSPAC) v South-Central (SWAT) ,� July 20, 2004 Burd of Supervisors Initiate Process on Mutually Agreed-Upon ULL Page 3 BACKGROUND I REASONS FOR RECOMMENDATION - continued Staff notes that it may be necessary to designate more than one Board member to a sub-region since certain Supervisorial Districts overlap between subregions.One approach to consider is to designate one Board member as the County's representative to each sub-region committee along with an alternate Board member. Staff is also seeking the Board's approval for Community Development Department staff to provide,as necessary, various technical and support services (e.g. preparing maps, graphics, and background material)toward this effort. CONSEQUENCE OF NEGATIVE ACTION The attachedletter from OCTA Chair Amy Worth suggests that each jurisdiction designate their elected official to the sub-region committee by August 1: 2004. A delay could impede successful development of a mutually agreed-upon LILL by the target date of December 31, 2004. Dennis Barry of Community Development noted that the Board may want to consider appointing both a member and an alternate to the sub-regional committees,as more than one district may be included in each sub-region. The Chair invited the public to speak. There was no public comment. Supervisor DeSaulnier noted that it will be important keep the Board apprised of sub-regional decisions. Chair Glover commented on the importance of keeping the sub-regions apprised of each others' actions. Supervisor Uilkema commented that,with the potential that three districts will be impacted by the decisions ofTRANSPAC(the Central Costa Costa sub-region),there could be a Board majority presence at those meetings. She asked that staff develop some procedure for adjourning the Board to those meetings. She also asked that staff inform the Supervisors of upcoming sub-regional meetings. Dennis Barry responded, saying staff will address Supervisor Uilkema's requests. Specifically, the Authority suggests that each local jurisdiction act no later than John Gicia August 1, 2004 to: (1)designate one elected official to work on a committee with the Federal Clover appointees from the other local jurisdictions in each sub-region of Contra Costa on the development of a draft ULL, and communicate that selection to Don Blubaugh at the address Brad Nix below; and (2) provide support from your managers and planning staff for this process. As Karen Stepper you may know, it is the Authority's desire that a new draft ULL be developed in each sub- region, and then reconciled at the countywide level, by December 31, 2004. Kris Valstad Background At a special meeting on May 26, 2004 the Authority approved a draft final Transportation Executive Director r Reber McCleary Expenditure Plan (TEP) for the extension of the Iocal transportation sales tax (also known as ire the "Measure C" sales tax). The TEP will take effect if the voters approve the extension of the tax on November 2, 2004. As part of the TEP, the Authority included a new requirement within its Growth Management Program(GMP)---the development and adoption by the cities, towns and County of a mutually agreed-upon new ULL. The Authority's approved "Principles"for adoption (attached) envisioned a process conducted by the cities, towns and County between July 1, 2004 and December 31, 2004 to develop the ULL. Mr. Blubaugh will be meeting with the County Executive and managers in each sub-region of Contra Costa to determine how he can best serve the needs of the cities, towns and County in starting and carrying out this process.
