BACKGROUND/REASONS FOR RECOMMENDATIONS The Beard of Supervisors asked the Transportation Water and Infrastructure Committee to monitor the activities in support of reauthorization of Measure C-88. On September 15, the Committee considered a report from County staff on this matter. That report included a review of the Contra Costa Transportation Authority's recirculated Notice of Preparation (NOP)for the Countywide Transportation Plan and Proposed Sales Tax Reauthorization (see Exhibit A). County staff responded to the earlier NOP on August 6, 2003. Since that response was prepared, AB 427 has become state law, removing the 20-year time limit on local transportation sales tax measures, and instead allowing them to remain in effect for the period of time specified in the respective local sales tax ordinance as approved by the voters. In addition, MTC has initiated an update to their Regional Transportation Plan (RTP), now known as the Transportation 2030 Plan. Authority staff estimates that this Plan could provide a net of approximately $300 million for new or enhanced investments for Contra Costa County beyond what is provided by the current RTP.The Committee recommended that staff prepare a letter to supplement our earlier comments and submit this letter for Board approval (see Exhibit B). LOCATION Contra Costa County, California. A map showing Contra Costa County —the area subject to the Project— is attached. PROJECT DESCRIPTION Background The CCTA was established in April 1989 to implement the Measure C Transporta- tion Improvement and Growth Management Program (GMP) passed by voters in November 1988. Measure C included an Expenditure Plan for allocating revenues from the collec- tion of a one-half percent sales tax to a variety of projects and programs. In addi- tion, the Measure C GMP established a cooperative, multi-jurisdictional process for managing growth on a countywide basis, while maintaining local authority over land use decisions and the establishment of performance standards. This process is based on Regional Transportation Planning Committees (RTPCs), which work to- gether to establish Action Plans for Routes of Regional Significance. In the Fall of 1990, Contra Costa County and Contra Costa cities designated the CCTA as the Congestion Management Agency (CMA) for Contra Costa. CCTA's role as CMA includes making recommendations on the allocation of State and fed- eral transportation funds and working with the Metropolitan Transportation Commission to address regional issues. CCTA is also responsible for preparing and updating a Congestion Management Program (CMP). Proposed Project As part of its Measure C responsibilities, the CCTA must prepare a countywide Comprehensive Transportation Plan (CCTP) to "support efforts to develop and maintain an ongoing planning process with the cities and the county." The CTP is intended to provide the overall direction and a coordinated approach for achieving and maintaining a balanced and functional transportation system within the county Notice of Preparation for 2004 Countywide Comprehensive Transportation Plan June 20, 2003 Page 3 while strengthening links between land use decisions and transportation. It outlines the CCTA's vision for Contra Costa and its transportation system and the goals, strategies and specific projects and other actions for achieving that vision. The 2004 Update will be the second major update to the CTP plan since it was first adopted in 1995. The 1995 CTP established the overall direction of CCTA's trans- portation and growth management, knitting together Action Plans prepared by the RTPCs and building on the requirements of the Measure C GMP. The 2000 Up- date further refined CCTA's vision, goals, and recommended strategies, and built on the refinements to the Action Plans carried out in 1999 and 2000. The CCTA envisions the CTP 2004 Update as the vehicle for: ■ Updating the vision, goals, policies, and strategies of the 2000 Update; ■ Defining an approach to allocating limited funding to priority projects and pro- grams, including Mate and federal funding allocated through the Regional Transportation Improvement Program administered by MTC; ■ Anticipating questions that will need to be addressed in the 2005 Regional Transportation Plan under preparation by MTC; and ■ Incorporating the Expenditure Plan and refinements to the GMP being devel- oped as part of the proposed renewal of Measure C. The sales tax imposed by Measure C will expire in 2009, and CCTA has begun working to develop a new measure to extend the sales tax, which it hopes to place before the voters in 2004. The CTP Update will also specify alternatives for transportation improvements that will impact the natural and man-made environment. The improvements will con- tain a mix of highway, arterial, transit, operational, and non-motorized improve- ments, as well as growth management techniques. ENVIRONMENTAL ISSUES TO BE ANALYZED The EIR for the 2004 Update to the CTP, including the proposed Expenditure Plan and revisions to the Measure C Growth Management Program, will be prepared as a program EIR. The program EIR will allow CCTA to look at the broad, regional Notice of Preparation for 2004 Countytvide Comprehensive Transportation Pian jure 20, 2003 Page 4 effects of a prop,ram of actions before adoption the 2004 CTP, and for Contra Costa voters to understand the environmental implications of the Expenditure Plan that will be included as part of the extension of the half-cent sales tax. Project level environmental review will be performed on the particular projects included in the Expenditure Plan once the projects are more clearly defined and more detailed studies prepared. Key environmental issues identified for analysis in this E1R include: transportation, air quality, noise, energy, geology and seismicity, biological resources, water re- sources, visual resources, cultural resources, and population growth and land use. t Robert K. The Community Development Department is responding on behalf of the County. This response supplements the response provided to you in our letter dated August 6, 2003. The Authority's September 4th report to your Administration and Projects Committee indicated that AB427, which was supported by the Authority, became law on July 28, 2003. This law removes the 20-year time limit on local transportation sales tax measures and instead allows them to remain in effect for the period of time specified in the respective local sales tax ordinance as approved by the voters. The Draft EIR should evaluate an alternative that includes a 30-year time limit for the new Expenditure Plan. This would enable the Authority to consider adopting a 30-year Expenditure Plan if it would help achieve the objectives of the County Transportation Plan and is supported by the Authority's future polling activities. On July 9th, the Metropolitan Transportation Commission issued a notice to Congestion Management Agencies requesting they submit projects for MTC to consider in its preparation of their Transportation 2030 Plan. Authority staff subsequently announced that the 2030 Plan could provide a net of approximately $300 million for new or enhanced investments for Contra Costa County beyond what is provided by the current Regional Transportation Plan. The Draft EIR should evaluate an alternative that includes this additional revenue for the new Expenditure Plan.
