Default of Lease Agreement.
1957 Parkside Drive, Concord.
The Public Works Director has advised that Peter J. Frumenti ,
Lessor of the premises at 1957 Parkside Drive, Concord, has failed to comply
with the Lease, dated May 7, 1974; particularly, Paragraph 11, MAINTENANCE
AND REPAIRS, Subparagraphs a and b, which requires Lessor to maintain the
exter—�o o the building and to repair interior damage caused by roof leaks.
The leaking roof has become a serious problem interfering with the County' s
use of the premises.
Paragraph 16, DEFAULT, provides County may proceed to repair the
building in the event of a breach of the lease by Lessor, provided County
has given Lessor 15 days written notice and Lessor has not made a reasonable
effort to correct the problem. Lessor has been given proper notice.
The Public Works Director recommends that the Board of Supervisors
find the lease to be in default, as of November 29, 1983, and authorize
the Public Works Department to notify the Lessor of said default, and to
proceed with necessary repairs, deducting the cost thereof from rental
payment due to Lessor pursuant to Paragraph 16.
IT IS BY THE BOARD ORDERED that the recommendation of the Public
Works Director is APPROVED.
