Adopted this Order on November 29 , 1983 by the following vote:
AYES: Supervisors Powers , Fanden, McPeak, Torlakson, Schroder

SUBJECT: Appeal of Peter J . Bonanno and Sher Ciaramitaro
from Board of Appeals granting of Land Use Permit
#2036-83 , Martinez area.
This being the time set for hearing on the appeal of
Peter J . Bonanno and. Sher Ciaramitaro from the Board of Appeals
granting of Land Use Permit #2036-83 , (with conditions) to continue
non-conforming horse keeping use at 14 Robinsdale Court , 'Martinez
area; and
Harvey Bragdon , Assistant Director of Planning , having
described the property site and reviewed the conditions of approval;
and
Peter J. Bonanno, appellant, having urged the Board
to grant his appeal and having advised that the families on
Robinsdale Court do not approve of the horse keeping use; and
Pat Jackson, representing Robert and Jewel Vicars ,
owners , having advised that horses had been kept at the subject
location for the past 15 years , and having objected to the
conditions that were imposed on the new owners , and having
advised that the new owners had not invested the money to meet
all of the new conditions because they are not certain they will
be allowed to keep horses on the site permanently; and
Peter J . Bonnano, appellant , having appeared in
rebuttal, and the Chair having declared the hearing closed; and
Supervisor Fanden having advised that she had looked
into the matter quite thoroughly and had taken a field trip to
the site, and having recommended that the owners be allowed to
continue to keep the horses for 90 days and that inspections be
made to ascertain that the owners comply with all conditions of
approval; and in addition, that the Planning staff look into the
matter of adequate off-street parking for horse trailers and
visitors , and that the Health Department inspect the property to
be sure that all health considerations are being met ; and that
the owners pay for the cost of the health inspections ; and
Mr. Bragdon having advised that the Board of Appeals
had granted the appeal for 6 months, at which time compliance
with the conditions of approval will be reviewed;
As recommended by Supervisor Fanden , the Board
hereby DENIES the appeal and upholds the granting of LUP #2036-83
with conditions (Exhibit A attached hereto and by reference incorporated
herein) , and DIRECTS the County Planning Staff to review compliance
with the conditions of approval imposed by the Board of Appeals .

THE BOARD FURTHER ORDERS that the issue of parking is
REFERRED to the Director of Planning for review and recommendation
to the Board, and the Director of Health Services is DIRECTED to pro-
vide the necessary health inspections with the cost of such inspec-
tions to be the obligation of the owners.

CONDITIONS OF APPROVAL FOR LAND USE PER11IT 2036-83, Revised:
1. The permit is granted to the owner, Mr . and Mrs . Bob Vicars
only, and is not transferable.
2. The permit is issued as per the plot plan submitted with the
application except that:
A. The paddock area shall be fenced so that it is 10-ft. ,
from any property line.
B. Within 90-da7s of the effective date of this land use
permit at least two 15-gallon sized shade trees shall
be planted near the stable and the 10-ft. , sideyard
strips shall be landscaped with evergreen bushes at
least 5 gallon size. Provisions acceptable to the
Zoning Administrator shall be made to irrigate these
plants and the trees shall be protected from the horses
until they are large enough to not be damaged by the
animals . The Zoning Administrator shall review and
approve tree and bush types and location. Bushes
shall be on 10-ft. , center or less .
C . Animal watering facilities shall be located near the
stable or away from side property lines.
3. Within six (6) months of the effective date of this permit,
the Planning Commission shall review their approval to make
sure that conditions of approval have been met . If not, the
Commission may revoke or amend the conditions of this permit .
The permit is also to be reviewed in five (5) years without
formal application. At that time, the permit may be continued
five years at the discretion of the Zoning Administrator. The
owner shall be responsible for requesting the review. At
the review, the Zoning Administrator may alter, add or delete
conditions .
4. A maximum of two horses are allowed with this permit.
The following are not conditions of approval; however, the owner
should be aware of them. .
A. Comply with the requirements of the County Health Department .
