THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on November 29, 19R3 , by the following vote:
AYES: Supervisors Powers , Fanden, Torlakson and Schroder
NOES: Supervisor McPeak
ABSENT: None

SUBJECT: Resolution Interpreting the Discovery Bay Community General Plan (East
County Area General Plan) and Directing Rezoning Hearings Relating to
the B & D Parcel
This being the time fixed for hearing on the recommendation of the County
Planning Commission relative to the County General Plan for the Discovery Bay Community
to consider the area located at the southeast corner of Discovery Bay Boulevard and
Riverlake Road in the Discovery Bay area; and
Supervisor Torlakson having reviewed the history'of the zoning ,and the•.
General Plan designations for the B & D property as well as the actions taken by the
Board of Supervisors from time to time; and
Mr. Anthony A. Dehaesus, Director of Planning, having also reviewed the
zoning and general plan designations for the property and having reviewed the options
available to the Board; and
Mr. Dehaesus having advised that the Board must decide on the general classi -
fication it desires, commenting that if the general plan is not changed, the Office
category will remain, and having noted that according to the zoning ordinance, ten
parking places would be required for the existing office use, and that at the applicants'
request, the Public Works Department had earlier prepared a proposed ten-year lease with
Contra Costa County Sanitation District 19 for property adjacent to the well site which
would provide four parking spaces, and that the Planning staff could agree to six spaces
for the site, but that the Board would have to indicate at this time its intent to
approve the aforesaid lease; and
Mr. Dehaesus having commented that on that basis, the site could be rezoned
as Office or Planned Unit Development (P-1), and for that, the Board would have to
refer rezoning application 2463-RZ to the Planning Commission for hearing; and
The Chairman having declared the hearing open, and the following persons
having appeared in opposition to Office designation for the subject property:
Tony DeBardi , 1042 Willow Lake Road, representing the Design & Environ-
mental Committee of the Discovery Bay Homeowners ' Association,
George V. Brim, 1211 Discovery Bay Boulevard, representing Discovery
Bay Homeowners' Association; and
The following persons having appeared in favor of Office designation for
the subject property:
Terry McDonald, 1464 Discovery Bay Boulevard, who presented petitions signed
by residents of Discovery Bay who favor the Office designation,
Candice Stoddard, Attorney for B & D Company, who urged that the Board
indicate its intent to approve the lease with CCC Sanitation District 19
so as to provide additional parking, and also urged that Planned Development
zoning be explored,
Catherine Marples, Realtor in Discovery Bay; and
The Chairman having read cards from interested citizens who did not wish to
speak but wanted their comments considered:

Those in favor of Office designation:
Barbara Lee Brinkman, 300 Discovery Bay Boulevard
Sylvia Amaral , 5215 Laguna Court; and
No one else having indicated a desire to speak, the Chairman declared the
hearing closed; and
Supervisor Torlakson having commented that in 1980 the Board did vote for an
Office designation for the lot in question and that the general plan designation
was changed accordingly and that he is of the opinion that the highest and best use
for the lot appears to be office, not residential ; and
Supervisor Powers having indicated that now that there was assurance of pro-
visions for adequate parking, he would vote for retaining the Office designation;
and
NOW THEREFORE BE IT RESOLVED that the Board of Supervisors determines not to
amend the General Plan for the B & D parcel but to retain its Office use desig-
nation, and directs that the General Plan map be revised to clearly reflect this
decision, and determines that the current General Plan does not provide Office use
on any adjacent properties.
BE IT FURTHER RESOLVED that guidelines of the General Plan are to be followed
and the Board directs the County staff to promptly advise the Discovery Bay Property
Owners Association, the Hofmann Company, and others concerned with development in
the Discovery Bay Community of any applications for changes and of any public hear-
ings that would follow.
The Board hereby DECLARES its intent to implement the lease agreement between
Contra Costa County Sanitation District 19 and the applicant which would provide
for additional parking.
Sypervisor Torlakson having requested the Board to adopt a resolution clearly
stating its policy on this matter, the Board thereupon adopted Resolution No.
83/1203 as submitted by Supervisor Torlakson.
BE IT FURTHER RESOLVED that the Planning Commission schedule for hearing,
Rezoning Application 2463-RZ, for the purpose of considering the proposed rezoning
of the B & D parcel to Office use, including the consideration of the Planned Unit
District (P-1) and parking places on the Contra Costa County Sanitation District #19
property as discussed above, and report its recommendation to the Board within a
reasonable length of time.

RESOLUTION NO. 83/1203
SUBJECT: Proposed Resolution to Answer Concerns on Neighborhood
Intrusion, Discovery Bay Area.
WHEREAS, a Master Plan exists for future development of
Discovery Bay; and
WHEREAS, the General Plan developed by the County basically
reflects this Master Plan;
WHEREAS, many residents of Discovery Bay have expressed concern
about potential intrusion of businesses or commercial activities
into the neighborhood areas;
WHEREAS, no other commercial areas are reflected in the General
Plan other than the presently designated Short Stop, Hofmann Commer-
cial Center (next to the Short Stop) and the B $ D property ( across
the street from the Short Stop) ;
WHEREAS, many residents are concerned about setting a precedent
that would enable others to argue for establishment of transitional
zones or limited office zones (0-1) ; or land use permits for office
uses ;
WHEREAS, the Board of Supervisors on November 29, 1983, has
narrowed the interpretation of the General Plan Office designation
to apply on the corner of Riverlake Drive and Discovery Bay Blvd.
to only one lot (the B $ D parcel) ;
WHEREAS, should any other property owners submit applications
for commercial or office activities, they would have to go through the
public hearing process before the County Planning Commission and the
Board of Supervisors for a General Plan change, or in some limited
cases , for a Land Use Permit;
BE IT THEREFORE RESOLVED that the Board of Supervisors indicates
that the B $ D rezoning is not a precedent-setting action since it
is the only other area designated in the - General Plan for office use ;
BE IT FURTHER RESOLVED that the Board of Supervisors wishes to
the greatest extent possible to follow and utilize the guidelines of
the existing General Plan and the existing Discovery Bay Master Plan;
BE IT ALSO RESOLVED that the Board of Supervisors directs the
county staff to clearly and promptly notify the Discovery Bay Property
Owner 's Association, the Hofmann Company, and other concerned citizens
in Discovery Bay of any proposed applications of this nature and of
any public hearings that would follow.
