HomeMy WebLinkAboutMINUTES - 11291983 - T.6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 29, 1983-4, by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing on the Recommendation of the San Ramon Valley Area Planning Commission on Rezoning Application 2566-RZ and Development Plan #3033-83, San Ramon Area, (Homestead Development Company) . The Board on November 15, 1983, having closed the public hearing and deferred decision to this date on the recommendation of the San Ramon Valley Area Planning Commission with respect to Rezoning Application 2566-RZ and Development Plan #3033-83, San Ramon Area; and The Board having considered the matter, and as recommended by Supervisor Schroder , hereby APPROVES rezoning application (2566-RZ) for change from Agriculture District (A-2) to Planned Unit District (P-1) and Development Plan #3033-83, as recommended by the San Ramon Valley Area Planning Commission, with specific conditions (Exhibit A attached hereto and by reference made a part hereof) . The Board hereby ADOPTS the Planning Commission' s findings, set forth in its Resolution No. 35-1983 (SR) , as its determinations for this decision. OLSSON, COUNTY CLERK .and ex officio Clerk of the Board Deputy Orig Dept: Clerk of the Board / cc: Director of Planning Public Works Director County Assessor County Counsel Homestead Development Co. 417 EXHIBIT "A" AS APPROVED BY SAN RAMON VALLEY AREA PLANNING COMMISSION SEPTEMBER 21 , 1983 CONDITIONS OF APPROVAL OF PRELIMINARY DEVELOPMENT PLAN 2566-RZ AND FINAL DEVELOPMENT PLAN 3033-83: 1. This approval is based on the rezoning and final development plan application dated received by the Planning Department June 29, 1983. 2. This approval is for a maximum of 170 dwelling units based on the final development plan and rezoning dated June 29, 1983. 3. Prior to preparation of the final subdivision map, the project design shall be reviewed to comply with all applicable conditions for approval. Building siting for units 54, 56, 57, 60, 61, 63 and 71 shall be revised to provide adequate space between fences or to eliminate the area and provide common fencing. 4. Final Covenants, Conditions and Restrictions shall be submitted prior to recording of the final map. 5. The time to activate the approval of the Development Plan (3033-83) shall run concurrently with Sub. 6368 and any subsequent extensions. 6. The slope of the 8 ft. high berm on the western property line shall be varied to give it a natural, non linear appearance. 7. Submit revised Conditions, Covenants and Restrictions which indicate a probition against parking in driveways and private roadways. The CC&Rs shall also contain a provision for maintenance of the off-site berm. 8. Fence design and location shall be submit to review by the Zoning Administrator. 9. Prior to the issuance of grading permit, final grading plans shall be submitted to the Planning Department for review and approval. 10. Final landscape and irrigation plans shall be submitted prior to recording the final map or issuance of a building permit. Low maintenance drought resistant native plants shall be utilized. All lawn areas shall be planted with sod. 11. The landscaped area along Crow Canyon Road shall be mounded and landscaped to screen the parking area. 12. Grading for the development, construction of the foundation for Crow Canyon Road, and surface and subsurface drainage facilities shall comply with recommendations of the soil report dated September 6, 1983 by Berlogar, Long do Associates. As built grading plans shall show the location of subdrains and depth of fill keys and benches on which fill is placed. 13. All utilities shall be underground. The project shall be served by a cable television underground system. No individual antennae shall be permitted. 418 3033-83 Page 2 14. The project site shall be served by the Central Contra Costa Sanitary District. Each individual living tmit shall be served by a separate sewer connection. 15. Water supply serving the properties concerned shall be by East Bay Municipal Utilities. Each individual living unit shall be served by a separate water connection. 16. All utility boxes and air conditioning units shall be screened. 17. Comply with the requirements of the Grading Section Building Inspection Dept. including a grading permit is required; a soils engineer will be required to control grading operation and soils report required prior to issuance of building permits. 18. The Final Map shall note both the soil report and the geologic report for the project. 19. Civil engineers and building designers shall take into account the anticipated settlement of fill and native soil during design and construction of pavement, drainage and sewer facilities, and structure foundations. 20. Carports shall be provided for all those spaces not specially required for guest parking. Each unit shall have a designated stall within the carport. 21. Parking outside of specifically designated areas is strictly prohibited. 22. The trees in the bomanite area at the driveway entrance at Crow Canyon Road shall be given special treatment to highlight the entrance to the project. The bomanite or acceptable alternative shall be extended to the eastern property line at Crow Canyon Road. 23. An emergency and fire protection district access shall be provided at the north corner of the subject site. 24. A color board and material sample shall be submitted for review and approval of the Zoning Administrator. 25. Comply with the requirements of Public Works Department, as follows: A. Unless exceptions are specifically granted, comply with the requirements of Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code. This includes the following: 1. Convey to the County, by Offer of Dedication, additional right of way on Crow Canyon Rod as required for the planned future width of 124 feet. 2. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and , transverse drainage, pavement widening and a half-width median island (including surface treatment) on Crow Canyon Road. The face of curb shall be located 16 feet from the widened right of way line. 419 de 3033-83 Page 3 3. Install street lights'.on Crow Canyon Road. The final number and location of the lights will be determined by the Traffic Engineer. 4. Relinquish abutter's rights of access along Crow Canyon Road with the exception of two driveways as approved by the Public Works Department. B. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance. C. Access roads within the development shall be constructed to County Private Road standards. D. Dedicate a drainage easement and observe the structure setbacks pursuant to the requirements of the Ordinance Code for any portion of the drainage system which will convey runoff from public streets. E. Submit a metes-and-bounds description and a plat, prepared by a licensed land surveyor or registered civil engineer, for the above-mentioned drainage easement(s) to the Public Works Department, Land Development Division, for review and the preparation of instruments. F. The above instrument(s) will be prepared by the Public Works Department, Land Development Division; ..upon request by the applicant and submittal of a current title report on the affected property. G. Furnish proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. H. Install all new utility distribution services underground. I. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Land Development Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signing and striping plans for review by the County Traffic Engineer. Overall curb grade plans are available at the Public Works Department for use by the applicant in the preparation of specific improvement plans. The improvement plans shall be submitted to the Public Works Department, Land Development Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for occupancy by the Public Works Department. If occupancy is requested prior to construction of improve- ments, the applicant shall execute a road improvement agreement with Contra Costa County and post the bonds required by the agreement to guarantee completion of the work. 420
