SUBJECT: Mandatory Solid Waste Ordinance
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Refer the November 17, 1983 report of the Health Services Department to the Solid
Waste Commission and request their review and comment on the report.
2. Request the Auditor-Controller, Treasurer-Tax Collector, County Counsel , and
Health Services Director to provide the Internal Operations Committee with
v additional information regarding the cost of the proposed mandatory solid waste
collection program in comparison to cost of the existing enforcement program.
3. Leave this item on referral to the Internal Operations Committee.
BACKGROUND:
On June 7, 1983, the Board referred to our Committee a report from the Public Works
Department and Solid Waste Commission. Our Committee has obtained additional input
from the Health Services Department on how a prepaid mandatory solid waste collection
system might operate. The details of this system are contained in attachments to the
report of the Health Services Department dated November 17, 1983.
Our Committee met on November 21 , 1983 with representatives from the Mountain View
Sanitary District, the League of Women Voters, County Counsel , Public Works, and
Health Services Department. Staff clarified for our Committee the fact that enacting
a mandatory solid waste collection ordinance and placing charge for solid waste
collection on property tax bills requires that the County take over the solid waste
collection business with the existing provider's future business being dependent on
obtaining a future contract based on submitting the low bid if the County chooses
not to actually physically collect solid waste itself. In addition, the Board of
Supervisors would only have authority to impose such an ordinance in the unincorporated
areas of the County not already served by a sanitary district. Cities and sanitary
districts would have to adopt a similar or identical ordinance in order to make the
program effective countywide.
Supervisor Powers believes that it is necessary to talk with the companies presently
doing solid waste collection to see what their reaction is to the proposed ordinance,
and to see the extent to which they would be interested in being involved in such a
program. In addition, Supervisor Powers would like Health Services and County Counsel
to do some additional work to refine the language in the ordinance, and would like
the Auditor, Treasurer-Tax Collector, County Counsel , and Health Services Director to
refine the proposed cost of the program in order to better verify the contention that
such a program will be less expensive and more effective than the current solid waste
collection program.

In addition, although the Solid Waste Commission had initially recommended in
favor of a mandatory collection system, they did not specifically recommend in
favor of a prepaid system. With the additional information submitted by the
Health Services Department, we would like the Solid Waste Commission to restudy
the matter and return their comments and recommendations to our Committee.
