DIRECT the Auditor/Controller to cancel the check that was made payable to Heather Farm Task Force($5500)and to reissue a check made payable to Walnut Creek Open Space Foundation ($5500). FINANCIAL IMPACT No impact to the general fund or Fish and Wildlife Propagation Fund. REASON FOR RECOMMENDATION/BACKGROUND A portion of the fines collected from violations of fish and game regulations in the County is deposited in the Fish and Wildlife Propagation Fund. State law defines how money in this fund may be spent, but the Board of Supervisors is responsible for authorizing specific expenditures. The Heather Farm Park Habitat Task Force's proposed habitat restoration project is consistent with the expenditure criteria established by State Law. DEPUTY Appropriation from Fish and Wildlife Propagation Fund August 5, 2003 Page 2 of 2 On April 1,2003,the Board of Supervisors approved nine projects to be funded through the Fish and Wildlife Propagation Fund 2002-2003 grant cycle. Heather Farm Habitat Task Force was one of the grant recipients and was awarded $5500 for its habitat restoration project. A check that was made payable to Heather Farm Prk Hab Task (short for Heather Farm Habitat Task Force)was sent to 236 Warwick[give in Walnut Creek on April 22, 2003. On May 20, 2003,William Hunt,Chairman of the Heather Farm Habitat Task farce requested that the check that was originally made payable to Heather Farm Prk Hab Task(236 Warwick Drive, Walnut Creek, CA 94598)be re-issued to Walnut Creek Open Space Foundation(P.O.Box 309, Walnut Creek, CA 94597-0309). At the public comment session of the Fish and Wildlife Committee on May 21,2003,and reiterated in writing in the attached letter, Mr. Hunt explained to the Committee that the Heather Farm Habitat Task Force is a committee of several organizations, formed by the Walnut Creek Park, Recreation and Open Space Commission. The Task Force includes three members from the Walnut Creek Park,Recreation and Open Space Commission, three members from the Mount Diablo Chapter of the Audubon Society, two members from the Gardens at Heather Farm, two members from the Lindsay Wildlife Museum, two staff from the City of Walnut Creek and two members from the Walnut Creek Open Space Foundation. The Task Force does not yet have a separate budget or a bank account to deposit the Fish and Wildlife Propagation Fund check. One of the member groups, the Walnut Creek Open Space Foundation, is a non-profit organization that can process the check to complete the proposed FWC funded project, instead of the Task Force itself. On June 18, 2003, the FWC unanimously approved Mr. Hunt's request to recommend reissuing the check to Walnut Creek Open Space Foundation for the restoration project. The conditions imposed on the first check remain in effect---specifically,the Task Force is required to complete the project by December 31,2003, Any FWC funds that were not used by December 31 must be returned to the FWC. The Task Force is further required to provide a summary report on the progress or results of the project by the same date. These requirements are listed in the letter that was sent to all grant applicants. Our task force has requested that one of our member groups,the Walnut Creek Open Space Foundation,handle funds for the project. This organization has been in existence as a 501 c3 non-profit organization registered in the State of California for many years. Having the Open Space Foundation handle our funds will facilitate our applying for additional grant funds from other grant sources for work in following years. The Foundation's treasurer has requested that the grant check be made payable to "Walnut Creep Open Space Foundation" I have returned the original check which was made payable to the "Heather Farm Prk Hab Task". I apologize for the inconvenience and for the delay in making the request. Please let me know if my request cannot be honored or if there will be a substantial delay in issuing a new check.
