RECOMMENDED ACTION:
APPROVE the consolidation requests on file in the Contra Costa Elections Department
from the following jurisdictions for the November 4, 2003 Consolidated Election.
City of San Ramon
Town of Discovery Bay Community Services District
Green Valley Recreation & Park District
Rollingwood-Wilart Park, Recreation & Park District
West County Wastewater District
Knightsen School District
Oakley Union School District = r
San Ramon Valley Unified School District
FINANCIAL IMPACT:
There is no direct cost to the County. Any additional costs incurred by the Elections
Division by approving this consolidation request will be recovered through billing the
affected jurisdictions.
REASONS FOR RECOMMENDATION/BACKGROUND:
November 4, 2003 is the regularly scheduled Election Day for the listed jurisdictions. By
approving their consolidation requests, the Board is allowing the jurisdictions to share
costs where their jurisdictional boundaries overlap.
Only the Board of Supervisors can grant permission to these jurisdictions to consolidate
their elections. The procedure is outlined in Part 3 of the California Elections Code;
consolidation of elections.
By granting this request, the affected jurisdictions will reduce the costs associated with
conducting their elections.
CONSEQUENCES OF NEGATIVE ACTION:
Not approving this request could increase the costs to the listed jurisdictions in conducting
the November 4, 2003 Consolidated Election.

WHEREAS, Election Code 1302(x) provides that, in the absence of
establishing the election day for governing board members to regularly occur on
specified statewide elections, the regular election to select governing board members in
any school or community college district shall be held on the first Tuesday after the first

WHEREAS, Education Code § 5322 provides that whenever an election for

be held in whole or part within the territory of this District and it is to the advantage of

NOW, THEREFORE, BE IT RESOLVED as follows:
1. The above recitals are true and correct.
2. This Shard hereby orders an election to be held within the territory

Resolution, not less than 423 days prior to the date set for the election, to the County
Superintendent of Schools who shall deliver the order of election to the Contra Costa
County registrar of Voters and, if applicable, to the county clerk or registrar of voters of

Section 5324.
5. This Board requests that the Elections Department publish the notice
of election in a newspaper, which is a newspaper of general circulation that is regularly
circulated in the territory.

RESOLUTION CALLING PARCEL TAX ELECTION
WHEREAS, Section 4 of Article XIII.A of the California Constitution and
Government Code Section 50079 authorize a school district, upon approval of two-thirds of the
electorate voting on the measure, to levy a qualified special tax for specified purposes; and
WHEREAS, the Board. of Education (the `Board") of the San Ramon Valley
Unified School District (the "District") is committed to preserving quality in educational programs
and providing the best possible education to our students in all grades;
WHEREAS, the worsening State budget threatens education funding in the short
run, and demonstrates ongoing uncertainty for funding of the District's programs in the foreseeable
future; and
WHEREAS, the Board has determined that in order to continue meeting the
educational needs of all of the District's students and to provide stable local funding for area
schools,it is necessary to authorize a special tax;and
WHEREAS, this Board has held a public heating after due notice regarding the
proposed authorization of the parcel tax;
NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the San
Ramon Valley Unified School District, as follows:
2. Recitals. This Board hereby finds and determines that the foregoing recitals are
true and correct.
2. Order of Election. This resolution shall stand as th.e order to the Contra Costa
County Superintendent of Schools to call an election within the boundaries of the District on
November 4, 2003, for approval of the measure contained in Section 3 hereof. The authority for
the specifications of this election order is contained in Sections 5304 and 5322 of the California
Education Code and Section 50079 of the California Government Code.
3. Specifications of Ballot Measure. This Board hereby requests the Registrar of
Voters of the County of Contra Costa (the "Registrar of Voters") to submit to the voters of the
District on November 4, 2003, the following ballot measure:

SAN RA ON VALLEY UNIFIED SCHOOL DISTRICT
EXCELLENCE IN EDUCATION ACT OF 2003
This Proposition may be known and referred to as the "San Ramon Valley
Unified School District Excellence in Education Act of 2003" or as "Measure ".

TERMS-OF EXCELLENCE IN EDUCATION SPECIAL TAX
Terms and Puraogo. Upon approval of two-thirds of those voting on this
measure, the District shall be authorized to levy a qualified special tax of$90 per year on
each parcel of taxable real property in the District for no more than five years, commencing
July 1, 2004. The qualified special tax shall be known and referred to as the "Excellence in
Education Tax". Proceeds of the Excellence in Education Tax shall be authorized to be
used to retain high quality teachers, provide for necessary educational programs and
materials, keep school libraries open, avoid increases in class sizes, and maintain
counseling and music programs.
Senior (,citizen Exemption, In order to provide tax relief to senior citizens in
the San Ramon Valley community, any parcel owned and occupied by a person 65 years of
age or older shall be exempt from the Excellence in Education Tax upon proper application
to the District. The exemption shall be available pursuant to procedures to be prescribed by
the Board of Education or otherwise as required by law or by the Contra Costa County Tax
Collector.
ACCOUNTABILITY P QVISIONS
Independent,Nnnual Audit. Upon the levy and collection of the Excellence in
Education Tax, the Board of Education shall cause an account to be established for deposit
of the proceeds. For so long as any proceeds of the Excellence in Education Tax remain
unexpended, the Superintendent or chief financial officer of the District shall cause an
independent financial auditor to prepare a report to be filed with the Board of Education no
later than December 31 of each year, commencing December 31, 2004, stating (1) the
amount of Excellence in Education Tax received and expended in such year, and (2) the
status of any projects or description of any programs funded from proceeds of the tax. The
report may relate to the calendar year, fiscal year, or other appropriate annual period, as the
Superintendent shall determine, and may be incorporated into or filed with the annual
budget,audit, or other appropriate routine report to the Board of Education.
Specific Poses. All of the purposes named in the measure shall constitute
the specific purposes of the Excellence in Education Tax, and proceeds of the tax shalt be
applied only for such purposes.

The Excellence in Education Tax shall be collected by the Contra Costa
County Treasurer-Tax Collector at the same time and manner and shall be subject to the
same penalties as act valorem property takes collected by the Treasurer-Tax Collector.
Unpaid takes shall bear interest at the same rate as the rate for unpaid ad valorem property
taxes until paid. The collection of the Excellence in Education Tax shall not decrease the
funds available from other sources of the District in any period from the effective date
hereof.
"Parcel of taxable real property" shall be defined as any unit of real property
in the District which receives a separate tax bill for ad valorem property taxes from the
Contra Costa County Treasurer-Tax Collector's Office. All property which is otherwise
exempt from or on which are levied no ad valorem property taxes in any year shall also be
exempt from the Excellence in Education Tax in such year. Parcels owned and occupied by
persons 65 years of age or older are exempt from the Excellence in Education Tax as
described above.
The District shall annually provide a list of parcels which the District has
approved for a Senior Citizen Exemption from the Excellence in Education Act as described
above to the Contra Costa County tax collection officials. The Contra Costa County
Assessor's determination of exemption or relief for any reason other than the Senior
Exemption of any parcel from taxation shall be final and binding for the purposes of the
Excellence in Education Tax. Taxpayers wishing to challenge the County Assessor's
determination must do so under the procedures for correcting a misclassification of property
pursuant to Section 4876.5 of the California Revenue and Taxation Code or other applicable
procedures. Taxpayers seeking a refund of Excellence in Education Taxes paid shall follow
the procedures applicable to property tax refunds pursuant to the California Revenue and
Taxation Code.
SEVERABILITY
The Board of Education hereby declares, and the voters by approving this
measure concur, that every section and part of this measure has independent value, and the
Board of Education and the voters would have adopted each provision hereof regardless of
every other provision hereof. Upon approval of this measure by the voters, should any part
be found by a court of competent jurisdiction to be invalid for any reason, all remaining
parts hereof shall remain in full force and effect to the fullest extent allowed by law,

summarized in the following form.,and the Registrar of Voters is requested to cause this summary of
the measure to appear on the ballot:

5. Filing_of Order of Flection. The Secretary of this Board is ordered to cause
certified copies of this resolution and order to be delivered not later than August 5, 2003, to the
Contra Costa County Superintendent of Schools, the Registrar of Voters, and the Clerk of the Board
of Supervisors of the County.
6. Formal Notice. The Contra Costa County Superintendent of Schools is hereby
requested to prepare and execute a Formal Notice of Parcel Tax Election and consolidation order in
substantially the form attached hereto as Exhibit A (the"Formal Notice"),and to call the election by
causing the Formal Notice to be posted in accordance with Section 5362 of the Education Code no
later than August 6, 2003, or to otherwise cause the notice to be published as permitted by law. The
Secretary of this Board, on behalf of and as may be requested by the County Superintendent of
Schools, is authorized to cause all notices required by law in connection herewith to be published
and posted,as the case may be.
7. Conduct o£Election. (a) Request to Registrar of Voters. Pursuant to Section 5303 of
the Education Code, the Registrar of Voters is requested to take all steps to hold the election in
accordance with Iaw and these specifications.
(b) Doter 1'ampbiet The Registrar of Voters is hereby requested to reprint the
measure in its entirety (that portion of Section 3 hereof which is printed in bold-face type) in the
voter information pamphlet to be distributed to voters pursuant to Section 13307 of the Elections
Code. In the event the measure in Section 3 will not be reprinted in the voter information pamphlet
in its entirety, the Registrar of Voters is hereby requested to print, immediately below the unpartial
analysis of the measure,in no less than 10-paint boldface type,a legend substantially as follows:
"The above statement is an impartial analysis of Measure_. If you desire a
copy of the measure, please call the Contra Costa County Registrar of Voters
at {phone number) and a copy will be mailed at no cost to you."
(c) Consoiidation. The Contra Costa County Superintendent of Schools and the
Board. of Supervisors of the County are requested to order consolidation of the election with such
other elections as may be held on the same day in the same territory or in territory that is in part the
same.
(d) Canvass of Results. The Board of Supervisors of the County is authorized to
canvass the returns of the election pursuant to Section 10411 of the Flections Code.
8. Appropriations Lit The Board of Education shall provide in each year
(pursuant to Section 7902.1 of the Government Code or any successor provision of law) for any

increase in the District's appropriations limit as shall be necessary to ensure that proceeds of the
Excellence in Education Tax may be spent for the authorized purposes.
9. Ballot AtVinent. The President of this Board, or any member or members of
this Board as the President shall designate, is hereby authorized, but not directed, to prepare and file
with the Registrar of Voters a ballot argument in favor of the proposition contained in Section 3
hereof,within the time established by the Registrar of Voters,which shall be considered the official
ballot argument of this Board as sponsor of the proposition.
10. Effective Date. This.resolution shall take effect from and after its adoption.

NOTICE IS HEREBY GIVEN to the qualified electors of the San Ramon Valley
Unified School District of Contra Costa County, California, that in accordance with the provisions
of the Education Code and the Government Code of the State of California, an election will be held
on November 4, 2003, for the purpose of submitting to the qualified electors of the District the
proposition summarized as follows:
"To retain high quality teachers, provide for necessary educational programs
and materials, keep school libraries open, avoid increased class sizes, and
maintain counseling and music programs, shall the San Ramon Valley
Unified School District be authorized to levy an annual tax of$90 per taxable
parcel for five years only, beginning July 1, 2004, with independent annual

By execution of this formal Notice of Election the County Superintendent of
Schools of Contra Costa County orders consolidation of the election with such other elections as
may be held on the same day in the same territory or in territory that is in part the same.
The County Superintendent of Schools of Contra Costa County, by this Notice of
Election, has called the election pursuant to a Resolution and Order of the Board of Education of
the San Ramon Valley Unified School District adopted June 3, 2003, in accordance with the
provisions of Education Code Sections 5302, 5325 and 5361.

RESOLUTION ORDERING ODD-YEAR
BOARD OF DIRECTORS ELECTION; CONSOLIDATION OF ELECTIONS; AND
SPECIFICATIONS OF THE ELECTION ORDER
WHEREAS, California Elections Code requires a general district election be held in each
district to choose a successor for each elective officer whose term will expire on the first Friday
in December following the election to be held on the first Tuesday after the first Monday in
November in each add-numbered year;
WHEREAS, other elections may be held in whole or in part of the territory of the district
and it is to the advantage of the district to consolidate pursuant to Elections Code Section 10400;
and
WHEREAS, Elections Code Section 14520 requires each district involved in a general
election to reimburse the county for the actual costs incurred by the county elections official in
conducting the election for that district;and
WHEREAS, Elections Code Section 13307 requires that before the nominating period
opens the district board must determine whether a charge shall be levied against each candidate
submitting a candidate's statement to be sent to the voters; and
WHEREAS, Elections Code Section 12112 requires the elections official of the principal
county to publish a notice of the election once in a newspaper of general circulation in the
district;
NOW, THEREFORE, IT IS ORDERED that an election be held within the territory
included in this district on the 4h day of November,2043, for the purpose of electing members to
the board of directors of said district in accordance with the following specifications,

1. The Election shall be held on Tuesday, the 4th day of November, 2003. The purpose of the election is

DECLARING ELECTIVE OFFICES TO BE FILLED, SETTING FORTH
PROVISION THAT CANDIDATES PAY FOR.STATEMENT OF
QUALIFICATIONS, REQUESTING AND ORDERING THE CONSOLIDATION
OF ELECTION WITH ANY OTHER ELECTIONS HELD THE SAME DAY
WHEREAS, Section 10509 of the Elections Code of the State of California provides that the
Secretary of this District shall deliver a notice to the County Clerk of Contra Costa County prior to the
day fixed for the general District election stating the elective offices of the District to be filled at the
election and whether the District or the candidate shall pay for publication of a statement of
qualifications pursuant to Section 13307 of the said code; and
WHEREAS, Section 13307(c)of the California Elections Code provides that a pro-rated share of
the estimated cost of the candidate's statement may be collected at the time of filing the statement; and
WHEREAS, a ten percent deposit on the pro-rated share of the estimated cost of the candidate's
statement is to be collected at the time of filing the statement as provided by Section 13307-of the
Elections Code; and
WHEREAS,the word limit for the candidate statement will not exceed 300 words; and
WHEREAS,nomination papers will be issued by the Contra Costa County Registration-Election
Depar€ ent;and
WHEREAS,other political subdivisions will be holding elections in the same territory or part of
the same territory.
NOW,"THEREFORE,BE IT RESOLVED that the Board of Directors of the West County
Wastewater District,Contra Costa County,California, hereby authorizes its Secretary to sign and deliver
to the County Clerk of Contra Costa County the Notice of Elective Offices to be Filled in the West
County Wastewater District,attached hereto and made a part of this resolution by this reference.
BE IT FURTHER RESOLVED that the Board of Directors election be consolidated with all
other elections to be held on the same day in all or part of the same territory.

ADMINISTER THE NOVEMBER 4,2003 MUNICIPAL ELECTION
WHEREAS,the Contra.Costa County Clerk's office has adzdaistered all ton of the
City of San Ramon's City Council elections; and
WHEREAS,the City of San Ramon wishes the Centra Costa County Elections
Department to administer its November 4,2003 municipal election.
NOW THEREFORE BE IT RESOLVED,Haat the City Council of the City of Sart
Ramon, authorizes the Contra Costa County Elections' Department to administer the
November 4,2003 municipal clecdoo and the City of San Ramon agrees to
compensate the County Clerk's office for expenses incurred in this election.
