FISCAL IMPACT: No General Funds involved. HOME and CDBG funds are provided to the County on a formula allocation basis through the U.S. Department of Housing and Urban Development (HUD). Funding of $40,000 will come from administrative funds currently allocated to each program ($20,000 from HOME and $20,000 from CDBG). BACKGROUND: Contra Costa County receives an allocation of approximately $5 million in federal CDBG, HOME and HOPWA funds for use in developing housing affordable to lower income households in the County. Dame Construction et al. ee&z SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the County Counsel or his designee to execute on behalf of the County a Consulting Services Agreement with Alan Kropp & Associates, Inc., for litigation support and expert witness services in connection with the matter of Contra Costa County v. :Dame Construction Company, Inc., et al. FINANCIAL IMPACT: There will be no impact to the General Fund. The Consulting Services Agreement is funded from Building Inspection permit fees. Payment under this Agreement will be limited to $45,000. BACKGROUND: On January 9, 2002, the County filed a lawsuit against developer Dame Construction Company, Inc., and others to recover funds for the completion of grading and road improvements at Fleetwood Road in the Danville area. Alan Kropp & Associates, Inc., will assist the County in evaluating geotechnical engineering issues in the litigation and provide expert testimony on these matters. CONSEQUENCES OF NEGATIVE ACTION: Without expert witness services, the County may be unable to prove its case against the defendants at trial. Kaufman and Broad of !Northern California, Inc., et al. FINANCIAL IMPACT: There will be no impact to the General Fund. The Consulting Services Agreement is funded from Public Works funds budgeted for matters relating to the road base material Sierra-Crete. Payment under this Agreement will be limited to $75,000. BACKGROUND: On July 11, 2002, the County filed a lawsuit against developer Kaufman and Broad of Northern California, Inc., to recover funds for the completion of road improvements in the California Skyline subdivision (Subdivision 7737) in Bay Point. Brown and Caldwell will assist the County in evaluating technical issues in the litigation, including issues relating to corrosion, pavement distress and staining, and hazardous waste regulations, and provide expert testimony on these matters. CONSEQUENCES OF NEGATIVE ACTION: Without expert witness services, the County may be unable to prove its case against the defendants at trial. FISCAL IMPACT The cost is covered by revenue received from application fees paid by the applicants. BACKGROUND/REASONS FOR RECOMMENDATIONS The Community Development Department has contracted with EDAW, Inc. for this EIR work. This contract amendment would allow the existing services, and additional services, to complete the Final EIR and increases the contract by$22,960 to a new total of$141,742.
