!. Recommended Action:
1. FIX September 23, 2003, at 9:30 a.m., as the date for a Board hearing on the Tri-Valley
Transportation Development Fee Revision Ordinance, the Development Program Report,
and for the filing and hearing of any written objections or protests to the proposed fees.
2. DIRECT the Public Works Director to give notice of the hearing in accordance with
Government Code Sections 65091 and 66017 and County Ordinance Code Section 913-
6.014.

II. Financ aI Impact:
There will be no impact to the general Fund. The recommended action would lead to an increase
in funding for specified transportation projects. The funds collected will be deposited in a trust
fund account specific to the improvements to be funded by the TVTDF Area of Benefit.
III. Reasons for Recommendations and Background:
The Tri-Valley Transportation Council(TVTC)includes Contra Costa and Alameda counties, and
the cities of Danville, San Ramon, Dublin, Pleasanton and Livermore. The TVTC was formed to
address transportations issues of common interest. In 1998,the TVTC unanimously recommended
to its member jurisdictions the adoption of a uniform development fee, known as the TVTDF. All
participating jurisdictions supported this recommendation by adopting ordinances establishing
uniform development fees in the Tri-Valley area dedicated to specified regional transportation
projects.
In April 2003,the TVTC approved the fee reduction for"Multi Family Residential"and increase for
"Office" and "Industrial" of the Land Use Categories. The "Multi Family Residential' fee will be
reduced from$1,198 per dwelling unit to$1,087 per dwelling unit(actually$1,217 to$1,097.87 to
account for inflation and I% administrative cost). The "Office"fee will be increased from $1.14
per square feet of gross floor area to $3.07 per square feet of gross floor area (actually$1.18 to
$3.10 to account for inflation and 1% administrative costs) and "Industrial" fee from $0.88 per
square feet of gross floor area to$2.08 per square feet of gross floor area(actually$0.87 to$2.10
to account for inflation and 1% administrative costs). The fee adjustments will eliminate potential
project funding shortfalls.
IV. Conseguences of Negative Action:
Failure to fix the hearing date to consider revision of road fees will result in the loss of potential
revenues and would be inconsistent with the intent of the Joint Powers Agreement, which
established the TVTDF.
NOTICE OF PUE3LIC HEARING AND AVAILABILITY vF DATA
(Fee Revision for Tri-Valley Transportation Development Fee Area of Benefit)
On September 23,2003,at 9:3€7 a.m.,in the Board Chambers,County Administration Building,651
Pine Street, First Floor, Martinez, CA, the Contra Costa County Board of Supervisors will hold a
public hearing to consider adapting an ordinance revising the fees for the Tri-Valley Transportation
Development Fee(TVTDF)Area of Benefit(see map). At the hearing,the Board will consider any
written protests by property owners, as well as any oral or written comments.
Fees collected through the TVTDF will be collected only from new development within this portion
of unincorporated Contra Costa County (see map) and will be collected upon the issuance of
building permits.
The TVTDF revision is the result of Amendment 1 to the Joint Powers Agreement between the
Counties of Contra Costa and Alameda and the Cities of Danville, San Ramon,Dublin,Pleasanton,
and Livermore.
The proposed fees for approval by the Board are:
Land Use Proposed Fee
Single-Family Residential: $1,740 per dwelling unit
Multi-Family Residential: $1,097.87 per dwelling unit
Commercial: $1.17 per square foot of gross floor area
Office: $3.10 per square foot of grass floor area
Industrial: $2.10 per square font of gross floor area
Other: $702 per peak hour trip generated
As with most fee programs, the fee revenue from the TVTDF program will not pay the cost of all
regional improvements. Other funding must be generated,some of which includes revenues from
Measure B in Alameda County and Measure C in Contra Costa County,Transportation Equity Act
(TEA) funds, State Transportation Improvement Program (STIP) funds, Southern Contra Costa
JEPA funds, and local funds (traffic impact fee programs, developer contributions, etc.).
The Development Program Report,which includes detailed information about the area of benefit
boundaries, estimated costs of the proposed improvements, the methods of fee apportionment,
and anticipated revenue sources,is available for review at the office of the Clerk of the Board,651
Pine Street, First Floor, Martine4 CA.

(Fee Revision for Tri-Valley Transportation Development Fee Area of Benefit)
The Board of'Supervisors of Contra Costa County ordains as follows:
SECTION 1. SUMMARY. This ordinance amends Ordinance No. 93-35 by revising the fee schedule set
forth in that ordinance.
SECTION II. NOTICE AND HEARING. This ordinance was adopted pursuant to the procedure set forth in
Government Code Sections 55091, 56017, and 66434, and Division 913, Title 9, of the Contra Costa
County Ordinance Cotte, and all required notices have been properly given and public hearings held.
SECTION III. The fee schedule listed in Section IV of Ordinance No. 98-35 is amended to read:
Land Use Fee
Single-Family Residential: $1,740 per dwelling unit
Multi-Family Residential: $1,097.87 per dwelling unit
Office: $3.10 per square foot of gross floor area
Retail: $1.17 per square foot of gross floor area
Industrial: $2.10 per square foot of gross floor area
Other: $702 per peak hour trip
SECTION IV. Except for the change made above,all other provisions of Ordinance No. 98-35 continue in
full force and effect. Any fees payable under the previous fee schedule remain subject to payment and
collection at the highest rate allowed by law.
SECTION V. EFFECTIVE DATE. This ordinance becomes effective 60 days after passage. Within 15
stays of passage,this ordinance shall be published once with the names of the Supervisors voting for and
against it in the San Ramon Valley Times, a newspaper of general circulation published in this County.
Pursuant to Section 913-6.026 of Contra Costa County Ordinance Code, the Clerk of the Board shall
promptly file a certified copy of this ordinance with the County Recorder.
