SUBJECT: Termination of Tenancy& Subtenancy, Hookston Station Area
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
AUTHORIZE. the Redevelopment Director or his designee to a) serve a Notice of
Termination of Tenancy and Subtenancy to David Randall Fischer individually and as a
attorney-in-fact for tenants in possession, and Tony Aikins, dba Concord Masonry as
subtenant of Redevelopment Agency owned property at 249 Hookston Road, Pleasant Hill;
and b)to terminate said tenancy upon expiration of the Notice of Termination of Tenancy
and Subtenancy; and AUTHORIZE County Counsel on behalf of the Redevelopment
Agency to prepare and prosecute such proceedings as are necessary to regain possession
of the premises upon expiration of the Notice of Termination.
FISCAL IMPACT
None. No General fund impact results from this action.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Redevelopment Agency owns a portion of the Iron Horse Corridor in the vicinity of
Hookston Road, Pleasant Hill. The Agency owned property at 249 Hookston Road is
currently subject to a month-to-month lease with David Randall Fischer and others as
tenant, and Tony Aikins dba Concord Masonry as subtenant. The subject property is
needed for the realignment of the Iron Horse Trail north of Hookston. The month-to-month
lease provides for a 45-day Notice of Termination of Lease/Sublease. The recommended
action would authorize a Notice of Termination of Tenancy and Subtenancy to be served.
