Kochly, District Attorney ° Costa DATE: June 17, 2003 C o'u n ty 05�% SUBJECT: Approval to Submit an Application and Execute a Grant Award Agreement with the State Department of Insurance for Funding of Workers' Compensation Insurance Fraud Prosecution Program in the Amount of$ 556,718 for the Period July 1,2003 through June 30, 2004 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Approve and authorize the District Attorney to submit an application and execute a grant award agreement, and any extensions or amendments thereof, pursuant to State guidelines, with the State Department of Insurance for funding of the Workers' Compensation Insurance Fraud Prosecution Program in the amount of $ 556,718 for the period July 1,2003 through June 30, 2004(State funds-budgeted). FINANCIAL IMPACT: The grant application will fund salaries and benefits for two attorneys, an investigator, and one-half FTE clerk assigned to the program. The Workers' Compensation Insurance Fraud Prosecution grant award is allocated from a trust fund financed by an assessment payable by the insurer. Of the assessment amount, approximately one-half is earmarked for distribution to District Attorneys for enhanced prosecution of workers' compensation insurance fraud. Supplantation is prohibited. Expenditures and revenue for grant positions are included in the District Attorney's 2043104 budget. REASONS FOR RECOMMENDATION/BACKGROUND: The State Legislature has determined that one of the significant factors driving up the costs of workers' compensation insurance is fraud. While fraud is recognized as a growing problem across the country, California is an area of concerted criminal activity in insurance fraud. City will receive Community Development Block Grant (CDBG)funds from the Department of Housing and Urban Development (HUD) as an entitlement to the City pursuant to the provisions of Title I of the Housing and Community Development Act of 1974, as amended. B. The City has approved and authorized the expenditure of Two Hundred Thousand Dollars ($200,000.00) from said CDBG funds for a housing rehabilitation program for owner-occupants of single-family homes. C. County has the demonstrated experience and qualifications to operate a housing rehabilitation program under the Community Development Block Grant Program. D. Washington Mutual Bank is prepared to assist City and County in achieving the objective of the program by participating with the City and County in the proposed loan program. E. This is the sixteenth year the County has contracted with the City of Antioch for these services. The Agreement will result in $70,000 in revenue to the County for costs related to the implementation of the Program. F. The term of the agreement is July 1, 2003 to June 30, 2004. BACKGROUND: Legislation'in 1997 encouraged a study to be conducted to evaluate the statutory and regulatory responsibilities and appropriate fiinding sources for county agricultural commissioner programs. The study placed priority upon the pest exclusion program and identified opportunities for improving and finding mandated activities. 1n 1998 legislation was passed as a result of this study. The legislation was geared toward funding high-risk exclusion activities performed by the county agricultural commissioners throughout the State. Contract No. 03-0239 sets activity levels that are designed for Contra Costa County based on historical workloads, costs and a negotiated work plan to maintain optimal service levels. The agreement improves the service level of high-risk exclusion activities,in the county.
