DATE: JULY 22, 2003 PAGE: 2 t l II. Financial Impact: There will be no direct costs to the County's General Fund nor the Airport Enterprise Fund. The installation and test of the Ground Marker System will be funded fully by the FAA. The only indirect costs will be in relation to the amount of time,which expected to be minor,that Airport staff spends to monitor and evaluate the Ground Marker System. All associated staff costs will be bore entirely by the Airport Enterprise Fund. III. Reasons For Recommendation/Background: The FAA has been working to reduce the number of runway incursions for the past several years. A runway incursion is defined as an Operational Error, Pilot Deviation or 'Vehicle/Pedestrian Deviation. An Operational Error is an action of an air traffic controller that results in: Less than required minimum separation between two or more aircraft, between an aircraft and obstacles (obstacles include vehicles, equipment,personnel on runway)or an aircraft landing or departing on a runway closed to aircraft. A Pilot Deviation is an action of a pilot that violates any Federal Aviation Regulation. For example,a pilot fails to obey air traffic control instructions to not cross an active runway when following the authorized route to an airport gate. A Vehicle/Pedestrian Deviation includes pedestrians,vehicles,or other objects interfering with aircraft operations by entering or moving on the runway movement area without authorization from air traffic control. In an effort to support the FAA's safety mission they are continuously exploring, evaluating and validating technologies that show potential for increasing runway safety. The FAA evaluates a range of technologies providing increased pilot and controller awareness of surface aircraft traffic. In May of 2003,the FAA made a presentation to Contra Costa County Airports asking that they support their request to implement a new technology test at Buchanan Field Airport(see Attachment A). The FAA selected Buchanan Field Airport due to its historically high number of Runway Incursions, Surface Incidents, aircraft operations, and its complex airfield layout. The FAA asked that Contra Costa County sign a Memorandum of Understanding(MOU)to complete the installation and test period, which will expire on or before June 30, 2004 (see Attachment B). Upon completion of the test the FAA will remove the equipment. If the equipment proves to be successful Contra Costa County would have an opportunity to purchase the equipment for long-term use. IV. Consequences of Negative Action: The FAA will not install and conduct a test of the new Ground Marker System at Buchanan Field Airport. PARTIES The parties to this Memorandum of Understanding(MOLD are the Federal Aviation Administration(FAA)and Contra Costa County, California. 2.OBJECTIVES The purpose of this is MOU is to identify the scope of effort that both parties mutually agree upon to support an operational evaluation of the Ground Marker system at'Concord Airport(CCR). Specific programmatic goals and objectives to be accomplished within the scope of this MOU include a. Acquisition and installation of five Ground Marker units in an effort to raise pilot situational awareness. This is expected to lead to a reduction in the number of .runway incursions and surface incidents at selected locations on the airport surface(The most likely locations of interest are depicted in Figure 1). b. Determine pilot acceptability of Ground Marker system c. Collect live operational data for system effectiveness analysis d. Coordinate with Contra Costa County on locations,power, and related infrastructure issues d'. Provide funding for the necessary power feed and related infrastructure changes e. Provide maintenance support of the Ground Marker units throughout the assessment period f. Provide on-site training on operation/deactivation of Ground Marker units in case of an operational need g. Generate any necessary NAS change proposals h. Provide briefings to Contra Costa County, CCR, and other organizations as required ij. Develop and implement a pilot/user survey process j'. Perform pre-assessment system checkout as necessary to ensure correct message content,timing, and clarity of messages at the William J. Hughes Technical Center (WJHTC)and CCR k Remove the Ground Marker units at the conclusion of the assessment period 1. Provide one(1)vehicle receiver for evaluation and testing m. Assume full responsibility and liability for Ground darker equipment operation for the duration of the evaluation Contra Costa County will: a. Participate in a site survey to mutually determine exact positioning of antenna and inductive loops at CCR b'. Provide access to airport facilities as necessary for site installation, system checkout, assessment, data collection and maintenance of the Ground Marker units c. Assist in assessment activities for Ground Marker(e.g. coordinating information meetings, distributing information fliers, and distributing questionnaires to local users) d'. Participate in technical interchange meetings at CCR e. Participate in WJHTC prototype evaluation in May 2003 f. Perform daily charts of Ground Marker system to determine status of operation 4. FUNDING No funds are obligated under this MOU.Each party shall bear the full cost it incurs in performing, managing, and administering its responsibilities under this MOU. 5.WARRANTIES Neither the FAA nor Contra Costa County makes any expressed or implied warranty as to any matter arising under this MOU. 6. PROTECTION OF CONFIDENTIAL/PRIVILEGED INFORMA'T'ION Each party shall take appropriate measures to protect proprietary,privileged or otherwise confidential information obtained as a result of its activities under this MOU. CONSTRUCTION The parties understand and agree that this Memorandum of Understanding does not confer any legal rights, duties or obligations on either party and is not subject to dispute in any forum.. Neither party is authorized or empowered to act on behalf of the other with regard to any matter, and neither party shall be bound by the acts or conduct of the other in connection with any activity under this MOU. This prevision shall survive termination of this MOU. S.EFFECTIVE DATEITERM/TERMINATION This MOU shall be effective on the date of the last signature of the parties and shall remain in force until June 2004. 9.AUTHORITY The authority for this MOU is 49 U.S.C. 106 (f)(2)(A)and 106(1) and(m).
