Costa DATE: July 10, 2003 �-� .:�;� ,,County SUBJECT: Approval to Submit an Application and Execute a Grant Award Agreement with the State Office of Criminal Justice Planning for Funding of the Career Criminal Prosecution Project for the Period July 1, 2003 through June 30, 2004 in the Amount of$ 159,361 (State Funds) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Approve and authorize the District Attorney to submit an application and execute a grant award agreement, and any extensions or amendments thereof, pursuant to State guidelines, with the State Office of Criminal Justice Planning for funding of the Career Criminal Prosecution Project in the amount of$159,351 for the period July 1, 2003 through June 30, 2004 (State funds-budgeted-Ivo match required). FINANCIAL IMPACT: The grant application will fund attorney salary and benefit costs in the amount of$ 159,361 for prosecution of career criminals. The Office of Criminal Justice Planning has been funding this project in the District Attorney's Office, since the late 1970's. The 2002/03 funding level of$ 179,054 was reduced by the State mid-year to $ 163,336. The State currently projects the 2003/04 funding level at $ 159,351, contingent on available funding in the State budget for 2003/04. As in all State Office of Criminal Justice Planning grants, the County agrees to the following conditions: to provide all matching funds required for said project, (including any amendment thereof) under the Program and the funding terms and conditions of OCJP, and that any cash match will be appropriated as required; that any liability arising out of the performance of the grant award agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and OCJP disclaim responsibility of any such liability; and, that grant funds received from OCJP shall not be used to supplant expenditures controlled by the governing board. There is no match required for this Program. Repeat offenders who commit serious crimes such as robbery, burglary, and grand theft are being prosecuted by this unit. The legislation for the program requires the District Attorney's Office to use experienced felony trial deputies who are assigned reduced caseloads and who are required to handle the case on a vertical prosecution basis from the time of arraignment continuing through final sentencing in Superior Court. Continued funding of this grant by the State is contingent upon the County prosecuting these cases as provided within the statutes. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve the recommendation will result in the inability of the District Attorney to apply for the State funds which may be available to prosecute repeat offender who commit serious crimes such as robbery, burglary and grand theft. (SAPP) in the amount of$114,040 for the period July 1, 2003 through June 30, 2004(State funds). FINANCIAL. IMPACT: The grant application will fund salary and benefit costs for an attorney for domestic violence prosecution. Funding for this program was cut 20.8% in 2002/03, The SAPP program, which had been eliminated from the State budget for 2003/04, may be resurrected, as part of the State budget process. The Attorney General's Office notified the District Attorney yesterday to submit a grant application by August 1, 2043, in the event funding becomes available. Funding for Contra Costa for 2003/04 would be at a level no greater than in 2002/2003, which amounted to $ 95,033 in State funds. Required in-kind match of $ 19,007 is provided through investigative support to the program. Adjustments will be made in expenditures and revenue in the District Attorney's 2003/04 budget when funding amounts are finalized. BACKGROUND/REASONS FOR RECOMMENDATIONS The City of Walnut Creek has approached Contra Costa County to provide administration of the City's home rehabilitation loan program. The City will set aside$240,000 to provide five to ten loans to low and moderate income residents to rehabilitate their homes. Any County staff costs will be covered by the City of Walnut Greek. The effective date of this contract is July 1,2003 and terminates June 30,2004. The County Building Inspection Department `s Neighborhood Preservation Program currently provides housing rehabilitation services to the cities of Antioch,Brentwood, Martinez, Pinole, El Cerrito and San Ramon,as well as the entire urban county. The request to provide housing rehabilitation services to the City of Walnut Creek is a further attempt to continue to develop partnerships with cities throughout the County. Approve and Authorize the Director of Health Services Department or his designee to execute and transmit an application along with the necessary certifications and assurances to the Department of Housing and Urban Development (HUD) McKinney-Vento Continuum of Care Homeless Assistance funding to support the services and operations of the FERST multi-.service centers for individuals and families. B. Authorize the Director of Health Services Department or his designee, if awarded funding, to accept up to $298,547 in HUD McKinney-Vento funding and enter into contract with HUD to perform all responsibilities in relation to receipt of the funding and contracted provisions for the operations of the FERST multi-service centers. FISCAL IMPACT- The funding requested of HUD will help to continue basic needs, counseling, and information and referrals services for families and individuals throughout the County. The 20% match requirement will be met in-kind through Homeless Program projects that are currently appropriated. No additional County funds required. BACKGROUND: The FERST program is critical to meeting the County's need for multi-service center (MSC) entry points into the Continuum of Care. Originally awarded HUD McKinney-Vento funding in 1997 with St. Vincent de Paul, it became a project of the County Homeless program May 31, 2001.
