AUTHORIZE the Chair, Board of Supervisors to execute a Hold Harmless Agreement with the East Bay Regional Park District for the use of the Martinez Regional Shoreline Park on Thursday, November 21, 2002 for the Contra Costa County Employee Wellness Program's 17'' Annual "Cold Turkey Trot" Fun Run and Fun Walk. 2. APPROVE awarding of T-shirts and prizes to County employees participating in the 2002 Great American Smokeout activities. BACKGROUND: On Thursday, November 21, the American Cancer Society will celebrate the 26th anniversary of the Great American Smokeout. The purpose of this nationwide annual event is to encourage smokers to give up smoking for 24 hours. The desired goal of the Smokeout is to convince smokers to quit smoking for life after participating in the Great American Smokeout. The successful County participation in the Great American Smokeout will help work toward the American Cancer Society's goal of a smoke-free society. For the seventeenth year, the Employee Wellness Program is organizing countywide activities for the Great American Smokeout. Smokeout Coordinators representing the County departments will assist the Employee Wellness Program to promote the Great American Smokeout in order to achieve maximum County involvement. The County's self insurance program provides for the legal defense of officials and employees pursuant to Government Code Section 825 and for the payment of all sums which it is obligated to pay by reason of liability imposed by law and arising from their acts or failures to act, excepting exemplary or punitive damages. This protection covers services performed by officers or employees within the scope of their official duties in accordance with the conditions of their employment or services. With respect to workers' compensation benefits, the County provides workers' compensation benefits to all of its employees as required by California State Compensation laws. The self-insurance program is prefunded to provide funds for payment of claims. Indemnification. The County shall defend, indemnify, save and hold harmless the East Bay Regional Park District, its officers and employees from any and all claims, costs and liability for any damages, sickness, death, or injury to person(s) or property arising directly or indirectly from or connected with the operations or services of the County or its officers and employees, save and except claims or litigation arising through the sole negligence or sole willful misconduct of the East Bay Regional Park District, or its officers or employees. County will make good to and reimburse the East Bay Regional Park District for any expenditures, including reasonable attorneys' fees the East Bay Regional Park District may make by reason of such matters and, if requested by the East Bay Regional Park District, will defend any such suits at the sole cost and expense of the County. RECOMMENDED ACTION: APPROVE and AUTHORIZE the Sheriff, or designee, to modify Cardroom License Number 6, known as "California Grand Casino" located at 5867 Pacheco Boulevard, Pacheco, California, to permit the addition of a card table effective November 1, 2002, to bring the total licensed card tables to fourteen. License is issued to Lamar V. Wilkinson, owner of the cardroom establishment. 11. FINANCIAL IMPACT: Revenue from the additional card table will be the $500.00 application fee, and an additional $500.00 in revenue annually. Ill. BACKGROUND/REASON(S) FOR RECOMMENQATION(S): In accordance with County Ordinance No. 82-44, Chapter 52-3, Article 1, Paragraph 52-3.321, Mr. Lamar V. Wilkinson holds Cardroom License Number 6, known as "California Grand Casino." Ordinance Code Section 52-3.909(c) allows up to a maximum of sixteen (16) tables. Ordinance Coded Section 52-3.905, titled "Change notice, and variance" requires that the licensee notify the Sheriff in writing of actual or proposed change in the conditions or restrictions of the license. Mr. Wilkenson has provided written notice requesting a variance to permit the addition of another table and the Office of the Sheriff has determined and collected an appropriate fee ($500.00)for the processing of his request. There is no detrimental information that would preclude approval of said application, and the Office of the Sheriff recommends the Board approve the application of variance. CONTINUED ON ATTACHMENT.
