FISCAL IMPACT $8,000.00, if the County does the abatement. BACKGROUND/REASONS FOR RECOMMENDATIONS On January 25,X002, staff conducted a site inspection and revealed that there is an occupied mobile home on site without a valid land use permit. There was also a hot tub adjacent to the mobile home without a permit. The hot tub has since been drained, disconnected and stored on site. The mobile home has had the utilities disconnected'and is stored on site. A portion of the barn has been converted and is occupied as a 2nd unit. No permits were obtained for the conversion. The property owner is in violation of the following County ordinance: Title 7, Chapter-- 74-1.002 (Building Permits Required) Title 7: Chapter 82-2.002 (Adoption of the Zoning Ordinance) Title 7 ,Chapter--82-2.006 (Land Use Violation) Title 7, Chapter-- 84-38.402 (Uses permitted in an A-2) The owner of the property has been notified of the violation(s)through written correspondence and certified mail. As of this date, compliance has not been gained. On July 12, 2002,the Building Inspection Department declared the property a public nuisance and posted 'a Notice Order to Abate under Title 1, Chapter 14.-6. This appeal is being made under the provisions of this title. This letter constitutes'a notice of appeal of that notice and order to abate. In 1982, the Williamson required housing for Mr. Williamson's mother, Eloise Welsh. They applied to the County for a permit to build an in-law structure'on their property. Due to the size of their property, they planned to build the unit more than 40 feet from their house. The County denied the application because the proposed location was more than 40 feet from their house. Thereafter, in February 1982,the Williamsons applied for, and obtained, a permit to place a mobile unit on the property in the location they desired. (See Permit No. 2093-81 attached hereto.)According to the permit, the mobile home'is to be used only for family members and may be extended every three years. In 1983, the Williamsons moved a mobile unit onto the property in accordance with this permit. At the County's instruction,the Williamsons also constructed a very expensive and permanent foundation for the mobile home. Board of Supervisors August 12,,2002 Page 2 The Williamsons have complied with the permit requirement that a family member reside in the mobile home. Ms. Welsh and the Williamson have maintained the mobile home and the land surrounding it. Ms. Welsh has paid property taxes to Contra Costa County on the mobile home unit for the last twenty years. (See attached tax statement.) The County recently contacted the Williamsons and requested that they disconnect all of the utilities to the mobile home. Such request is unreasonable given the length of time the mobile home has been on the Property. Moreover, the home causes no damage to the Williamson' property or surrounding properties. Clearly, the Williamson have a vested right to maintain the mobile home. The mobile home should be allowed to remain on the property for a number of additional reasons. The mobile home and the maintenance surrounding it reduce the risk of spreading brush fires. The Williamsons are further willing to allow their daughter to live in it or rent the home to a young family or a St. Mary's student. As set forth above, the mobile home has existed on the property for more than 20 years and Ms. Welsh has paid taxes on this property for this period. The mobile home is not a nuisance or an eyesore. The Williamson's property is very large and the mobile home does not crowd the property. The mobile home is also well maintained. Finally, there is reason to believe that the current complaint comes from a disgruntled former neighbor and no other complaints ever have been received.' We recently had a meeting with representatives of the County from the Planning and Inspection Departments. We learned during this meeting that the County had issued a temporary permit instead of a permanent-for the mobile home. This error was unknown to the Williamsons for they intended the mobile home to be permanent. if the correct permit had been issued, their right to keep the use of the mobile home would be vested and certain. The Williamsons are willing to work with the County to resolve this issue. We can discuss renewing the existing permit or applying for a new permit. Please contact me to discuss resolution alternatives. With regard to the issues arising out of the barn, I believe that the County and the Williamsons have come to an amicable agreement and proposed means of handling. Nevertheless,the Williamsons do not waive any of their rights or defenses regarding that issue. 1 Recently,the Williamson bought a neighboring,property that was sold at foreclosure. The former owner of this property discovered that the Williarnsons'mobile home permit technically had expired because the Williamsons had not renewed every three years. The neighbor then complained to the County and the County began,its recent investigation into the mobile home.
