1. RECOMMENDED ACTION:
APPROVE revisions to the Affirmative Action Plan for the Housing Authority of the County of
Contra Costa as recommended by the Advisory Housing Commissioners at their regular meeting held on
September 23, 2002.
II. FINANCIAL IMPACT:
None.
Ill. REASONS FOR RECOMMENDATION/BACKGROUND
The Housing Authority's current Affirmative Action Plan has been in effect since March 3, 1984.
Staff has been working with County Counsel for the past year to update the plan. It is necessary to
update the current Affirmative Action Plan to be in compliance with State and Federal regulations such as
The Americans with Disabilities Act(ADA), and associated law.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect not to approve the revisions to the Affirmative Action
Plan, the Housing Authority of the County of Contra Costa's policy will be out of compliance with State
and Federal laws.

1. AFFIRMATIVE ACTION POLICY STATEMENT
It is the policy and practice of the.Housing Authority of the County of Contra
Costa that appointment,training,compensation,promotion and other conditions of
employment within the Housing Authority services are based upon merit and fitness,that
discrimination in employment because of race, color,age,national origin,religion,
disability, gender,or other category defined by laver is forbidden and that discrimination
based on protected classes is proscribed,except as laws or obvious employment
conditions require otherwise,and that disciplinary personnel actions be taken against
persons engaged in discriminatory practices of any kind.
It is also the policy of the Housing Authority to apply job-related standards
appropriate to each job or position and maintain such standards at a level consistent with
the healthy growth of the Housing Authority and to seek out individuals at any level of
employment whose potential has not been fully utilized with the objectives of assisting
them to reach their full potential without regard to race, color, gender, age, disability,
national origin,religion or other category defined by law.
The United States Government has taken action through the Department of
Housing and Urban Development to have Affirmative Action Programs established in all
State and Local Housing Authorities. Therefore the Housing Authority is establishing
this Affirmative Action Policy to identify and remove artificial barriers to employment
and promotion and to establish assertive efforts to attract and assist minority,disabled
individuals, and female candidates to qualify for employment and promotion.

The Housing Authority shall act affirmatively in pursuit of these objectives
carried out in compliance with the general provisions of Executive Orders 11063, 11246
and 12892;and also, in keeping with the rationale of policy statements contained in Title
VI&VII of the 1964 Civil Rights Act, Section 808 of the Civil Rights Act of 1968,
Section 3 of the Housing and urban Development Act of 1968 as amended, Section 503
and the Americans with Disabilities Act of 1990 and the Age Discrimination Act of 1974
and the Vietnam Era, Veterans Readjustment Act of 1974. The intent of this plan is to
align the agency's programs with the fundamental concepts of these laws, in essence that
all citizens are entitled to an equal opportunity in pursuit of a livelihood, without an
impediment arising out of differences.
An Affirmative Action Program will be initiated under the direction of the
Executive Director and the Affirmative Action Officer,which will require the active
support of all the department heads and managers. The Affirmative Action Officer shall
be appointed by the Executive Director. The Affirmative Action Program will include
but not be limited to the guidelines described within this plan. The goals of the Program
will be to provide employment opportunity and encouragement of a broader participation
of minorities,the disabled and females,and to endeavor for a ethnic and gender work
force composition and distribution that approximates the ethnic and gender work force
composition of the work force population of Contra Costa County (see Attachment A).

11. ADMINISTRATION OF PROGRAM
The Executive Director shall enforce provisions of the Housing Authority's
Affirmative Action and other related policies and require all applicable management and
supervisory staff to comply;and the Affirmative Action Officer shall conduct personal
reviews and complete an annual report to assure compliance with this policy.
Any exceptions will be at the discretion of the Executive-Director in conformance
with the Housing Authority Personnel Policy and Procedures and the Memorandum of
Understanding. These documents deal specifically with the manner in which grievances
may be handled. Any individual or group of individuals may seek redress by bringing
complaints to the proper representative,normally to immediate supervisors first,then
through proper administrative or grievance channels to the Executive Director and/or
Affirmative Action Officer.
In order to implement the plan of this Affirmative Action Program by maintaining
coordination, review and follow-through,the Affirmative Action Officer, under the
direction of the Executive Director, shall assume the responsibilities commensurate with
this position as set forth in this document. The policy and any program reports are
available upon request by staff through the Human Resources Office,however data
protected by privacy laws is only available on a need to know basis.
A. Method of Implementation
To assure affirmative action for this plan,the Housing Authority will follow these
specific guidelines set forth below.

I. The Executive Director and Affirmative Action Officer will periodically
meet with Department Heads to obtain their active support and
participation in implementing,Affirmative Action within their
departments.
2. Department Heads,as directed by the Affirmative Action Officer,will be
responsible for submitting written reports on the specific steps they are
taking and progress being made to effectuate this Affirmative Action Plan
within their Department.
3. Department Managers(such as in Human Resources,Finance,
Development,Housing Operations or Purchasing)as directed by the
Affirmative Action Officer,will be responsible for submitting data
necessary for the implementation or progress of the plan regarding
employees,applicants,or contractors.
III. PERSONNEL RULES,POLICIES AND PRACTICES
The Affirmative Action Officer and Department Heads or Officers will review
rules,regulation,policies and practices and propose such changes as necessary to achieve
the goals of Affirmative Action.
A. Recruitment—The Department Heads,with the assistance of the
Affirmative Action Officer and the Human Resources Officer, are responsible for good
faith efforts in recruitment of minorities,disabled persons, and fernales into appropriate
job opportunities where equally qualified.

1. The distribution of jab announcements to community organizations
and/or advertisements of jab opportunities in publications,
websites,or other media which reach minorities, disabled and
females,will be continued.
2. Recruitment literature or advertisements will state `affirmative
action/equal opportunity employer'. Literature will state the need
or preference for bi-lingual ability in the qualifications.
3. In-house posting of all open positions will be required.
B. Selection—The Executive Director has the primary responsibility for
implementing selection procedures, which are consistent with the goals of Affirmative
Action, applicable Federal or State Laws and regulations, the Housing Authority
Personnel Policies& Procedures,and the Memorandum of Understanding. The
Affirmative Action Officer and Hunan Resources Officer will contribute resources as
required.
I. Statistical data on the number of minority, disabled and fernale
participants in the various steps in the examination process will be
periodically reviewed to identify barriers which are unrelated to
employment.

2. Qualified minority,disabled, and females will be sought out,for
participation on qualification appraisal boards (Oral Interview
Panels).
3. Written tests will be used only when it is determined that they can
provide relevant supplementary information in making personnel
decisions. Tests will be used in conjunction with such pertinent
factors as current and past job performance, education, special
training and experience.
4. Written tests and other selection devices will be periodically
reviewed for consistency with applicable federal or state laws or
regulations.
5. Appropriate analysis will be periodically conducted or obtained to
ensure that tests are not influenced by ethnic or cultural
differences.
6. The setting of written test"pass points"based on an established
mean or standard deviation from the mean, should be utilized
whenever it appears that doing so enables those individuals or
groups of individuals who may have qualified by other means(i.e.
oral exam,reference checks,etc)but would otherwise be
disqualified if"pass points"are not set.

C. Appointment,Placement,Promotion
1. The Affirmative Action Officer will instruct supervisory personnel
with authority to make appointments in pursuing the goals and
commitments of Affirmative Action.
I Whenever operationally beneficial, position vacancies will be
filled through the promotion or reassignment of present employees.
3. Whenever operationally beneficial, Department(leads will place
minority, disabled, and females appointed to trainee positions in
which are commensurate with,their abilities and may increase their
utilization within their classifications.
7. Department Heads and Managers will take reasonable measure to
notify employees of promotional opportunities through the posting
and distribution of job announcements.
8. Department heads will mare reasonable efforts to encourage
minorities,disabled, and females to bid for promotional openings
which will afford upward mobility or break traditional male-fernale
classification roles.
9. The Affirmative Action Officer will periodically monitor the
number of vacancies filled through open and promotional
recruitments, including the number of minorities, disabled and
females interviewed,hired and promoted.

U. Classification
1. Class specifications at all levels will be periodically reviewed to
eliminate qualification requirements, which may create artificial
barriers to employment.
2. Trainee classifications for clerical, and maintenance areas as well
as internships for professional fields will be explored.
2. Career ladders and lattices which provide for advancement and
lateral movement from trainee positions,will be considered in the
classification plan.
E. Training
I. Job-related training opportunities will be reviewed by supervisors
for their supervisory and non-supervisory employees.
1 All Housing Authority employees will be encouraged to take
outside career improvement courses which will help them evaluate
and develop their potential as well as to provide skills to facilitate
upward.mobility.
3. An employee may apply for Tuition Reimbursement under the
"Training and Tuition Reimbursement"section of the Housing
Authority Personnel Policies&Procedures.
4. Where possible,instructors from minority, disabled and female
groups or employees will be used in providing in-house training,.

F. ADA/FEHA Disability Accommodation
Pose: For applicants and employees of the Housing Authority who have
a disability, an interactive process initiated by the applicant or employee regarding
passible accommodations shall be directed to Human Resources. For applicants, every
effort will be made to make appropriate arrangements regarding the application and/or
examination process(es). For employees,the Housing Authority may approve the
accommodation suggested by the employee or find other accommodations which enable
the employee to perform the essential functions of their position which do not impose an
undue hardship on the Housing Authority. Any grievances with respect to the final
accommodation(s)shall be made through the appropriate channels outlined in either the
Housing Authority Personnel.Policy or Memorandum of Understanding.
Definitions: An individual with a disability under the ADA as furthered defined
by California Government Code 12926, is an person who:
1) has a physical or mental impairment that limits one or more major life activities;
2) has a record of such impairment; or
3) is regarded as having,such impairment

G. Sexual Harassment Policy&Prevention Program
Purpose. The purpose of the Sexual Harassment Policy and Prevention
Program is to inform all Housing Authority employees that sexual harassment is a
prohibited personnel practice and is a form of employee misconduct.
:Definitions: Harassment on the basis of gender is a violation of Title VII of
the Civil Rights Act of 1964 as amended. Sexual harassment means unwelcome sexual
advances,requests for sexual favors, and ether verbal or physical conduct of a sexual
nature when (1)submission to such conduct is made either explicitly or implicitly a term
of condition of ail individual's employment. (2)submission to or rejection of such
conduct by an individual is used as the basis for employment decisions affecting such
individual, or (3) such conduct has the purpose or effect of unreasonably interfering with
an individual's work performance or creating an intimidating, hostile, or offensive
working environment.
In accordance with Housing Authority Personnel Policies and Procedures, an
employee who has witnessed or believes he or she has been a victim of sexual harassment
by a co-worker,supervisor,or agent of the Housing Authority should promptly report the
fact 'of the incident or incidents and the names of the individual(s) involved.
Written complaints of sexual harassment must be submitted to the employee's
immediate supervisor and the Executive Director. A confidential verbal inquiry may be
called in to the employee's protection line should the individual wish to make a
confidential report(see Attachment B).

The Executive Director shall appoint an Employee's Risk Management Team
of three employees comprised of at least one (1)male and one (1)female, who will
investigate charges of sexual harassment.
If after investigation sexual harassment is established., the harassing employee
will be subject to disciplinary action as set forth in the Housing Authority's Personnel
Policy and Procedure or Memorandum of Understanding.
It is an unlawful employment practice for an employer or employees to
discriminate against other employees (victims, witnesses, etc.) who have made a charge,
testified,assisted,or participated in any manner in the investigation. This is a non-
retaliation clause and persons should notify the Affirmative Action Officer if any attempt
of retaliation is made.
ResTonsi_bility:
Executive Director:
The Executive Director is responsible for the overall implementation and
application of the Sexual Harassment Policy and Prevention Program.
Affirmative Action.Officer:
The Affirmative Action Officer shall be responsible for providing the
guidance necessary for the investigative team to complete an investigation of alleged
sexual harassment,discrimination,or retaliation cases. The investigative team shall report
all findings to the Affirmative Action Officer who will prepare a written determination of
the charges and findings and forward to the Executive Director.

Supervisor=
Each supervisor is responsible for immediate notification to the Affirmative
Action Officer and the Executive Director of alleged violations of the Sexual Harassment
Policy and Prevention Program.
Employee.
Any employee who alleges a violation of the Sexual Harassment Policy and
Prevention Program may submit in writing, to his/her immediate supervisor and
Executive Director, the following information:
(I) A statement of the alleged violation
(2) All specific information relating to date and time of occurrence, any
witnesses to said action,and a detailed account of the action.
An employee may also make a confidential call with this information to the
employee protection line as outlined in the Housing Authority's Personnel Policies chi
Procedures (see Attachment B).
11. Discrimination Complaint Procedure
Employees may write a memorandum explaining the nature of the problem
and send it in a sealed envelope,marked"Confidential", to the Affirmative Action
Officer for investigation with a copy to the Executive Director. An employee may also
call the employee protection line as explained in the Housing Authority's Personnel
Policies& Procedures. Every effort shall be made to respond to a complaint in a timely
manner.

After collection and preservation of evidence is made by the Affirmative
Action Officer, the information will be presented to the Executive Director with findings
of fact along with recommendations. Every reasonable effort will be made to resolve the
discrimination complaint. If the complainant is not satisfied with the proposed resolution,
the employee may file a grievance in accordance with the Housing Authority's Personnel
Policy and Procedure or in accordance with the Memorandum of Understanding.
I. Retaliation
Victims,witnesses,or other employees involved in employment
discrimination or sexual harassment cases shall have full administrative protection. State
and federal provisions of law protect individuals from retaliation.
If an employee is found to have engaged in retaliation,it will result in
disciplinary action in accordance with the Housing Authority's Personnel Policy and
Procedure or the Memorandum of Understanding.
J. Misrepresentation
Any employee found to have engaged in willfully filing a false discrimination
complaint or a false harassment complaint in an effort to disrupt the orderly ;manner of
business of the Housing Authority of the County of Contra Costa, will be subject to
disciplinary action in accordance with the Housing Authority's Personnel Policy and
Procedure or the Memorandum of Understanding.

SECTION IV—ACTION WITH REGARD TO CONTRACTORS, SUB-
CONTRACTORS DEVELOPERS AND OTHERS AFFECTED BY
AFFIRMATIVE ACTION FLAN
The Housing Authority shall continue to expand its on-going efforts to assure
that contractors, sub-contractors,developers,and other business entities, shall comply
with provisions of the Affirmative Action Plan. Generally, procedures will be followed as
outlined in"Instructions for Contractors regarding the Affirmative Action Plans under
Executive Order#11246, as amended."The Housing Authority's Affirmative Action.
Officer shall seek out and assist minority and female contractions, sub-contractors,and
others in qualifying to bid for contracts.
Further, the Housing Authority is committed to contracting with minority-
owned or female owned firms as defined by federal regulations,where feasible, and in
the absence of available minority-owned or female owned firm capability,the Housing
Authority will seek out firms which employ minorities in decision-making positions.
SECTION V—GOALS AND OBJECTIVES
It is the goal of the Affirmative Action Plan to strive for a Housing Authority
work force composition representative of the County labor force, inclusive of its
minority, disabled and female labor force members. However, it is also recognized that
County regional population differences may cause similar differences in the Housing
Authority labor force distribution.

Data shall be gathered as a guide to achieve and evaluate progress toward
these goals. Therefore,this analysis shall be the first objective of the plan and will
receive priority. The Affirmative Action Officer will submit written reports to the
Executive Director on the immediate measures to be taken and plans for effectively
implementing this program within the respective Housing Authority Departments. Those
aspects of departmental plans,which may require significant job restructuring, or the
establishment of training positions and programs,will be reviewed by the Executive
Director for approval. Appropriate action consistent with the .Housing Authority-wide
Affirmative Action Goals will then be taken.
Vl. PROGRAM EVALUATION
The Affirmative Action Officer will provide for the establishment and
maintenance of a Housing Authority-Wide Affirmative Action Program evaluation plan.
This plan should include but not be limited to:
1. Reviewing Housing Authority work force and County work force data
surveys and departmental reports on appointments and promotions.
2. Reviewing operating department plans and progress reports on
program effectiveness and evaluating there with Departments Heads.
3. Reporting periodically on plans and programs developed to aid in
achievement of Housing Authority-Wide Affirmative Action goals.

The Affirmative Action Officer shall:
1. Monitor and coordinate the Housing Authority's Affirmative Action Program and
report findings along with recommendations to the Executive Director.
2. Serve as Contract Compliance Officer. Review and periodically monitor contract
developments to ensure achievement of equal employment opportunity, open
occupancy and public accommodation objectives,and conduct on-site inspections, at
regular intervals, of employment and occupancy practices.
3. Assist staff and contractors in preparing effective affirmative action program criteria;
chair pre-award and pre-occupancy conferences; compile public information for the
Executive Director to disseminate; implement equal employment opportunity policy
and open occupancy statements.
4. Recommend procedures to the Executive Director to ensure compliance with all
contract provisions.
5. As needed, attend compliance conferences initiated by contractors and attend
conferences related to fair and equal opportunity practices.
6. As assigned,establish and maintain contact as the Housing Authority's liaison with
community and/or contracting groups, labor unions and councils.
;. As assigned,work with schools, minority group agencies and organizations to
encourage entrance of minorities into employment and training programs.

8. Monitor Affirmative Action goals developed under agreements between the Housing
Authority, and unions,civil rights groups and community organizations.
9. Assist in researching and analyzing discrimination complaints received regarding
Housing Authority employees,contractors who work with the Housing Authority, and
other individuals or businesses who provide goods and services to the Housing
Authority.
10. As needed, provide information about minority group programs of the State
Employment Service and the various apprenticeship prograins; represent the Housing
Authority when directed to speak on problems and remedial actions in the field of
employment.
11. Assist in the preparation of reports on employment practices slid programs and
prepare the Housing Authority's annual Affirmative Action Plan.
12. As directed, maintain liaison and continue working relationship with HUD Area
Office Equal Opportunity Division and other related agencies.
13. Investigate sexual harassment complaints and recommend appropriate action for
resolution.
14. Compile an Annual Progress report for the Executive Director with copies to
Department Heads,Officers and Managers.

RACE,/ETHNIC IDENTIFICATION
For the purposes of data for all reports,the following race/ethnic categories will be used:
a. The category"White"(not of Hispanic origin): All persons having origins in
any of the original peoples of Europe,North Africa, or the Middle East.
b. The category "Black"(not of Hispanic origin): All persons having origins in
any of the Black racial groups of Africa.
c. The category "Hispanic": All persons of Mexican, Puerto Rican, Cuban,
Central or South American,or other Spanish culture or origin, regardless of
race.
d. The category "Asian or Pacific Islanders": All persons having origins in any of
the original peoples of the Far East, Southeast Asia,the Indian Subcontinent,or
the Pacific Island. This area includes, for example, China, Japan, Korea,the
Philippine Islands, and Samoa.
e. The category"American Indian or Alaskan Native": All persons having origins
in any of the cultural identification through tribal affiliation or community
recognition.
NOTE: The category "HISPANIC"while not a race identification, is included as a
separate race ethnic category because of the employment discrimination often
encountered by this group, for this reason do not include HISPANIC under either
"white"or"black".

I. DESCRIPTION OF JOB CATEGORIES
For the purposes of data for all reports,the following EEO-4 job categories will be used:
a. Officials and Administrators: Occupations in which employees set broad policies;
exercise overall responsibility for execution of policies, or direct individual
departments or special phases of the agency's operations,or provide specialized
consultation on a regional,district or area basis.
Includes: department heads,directors, deputy directors, and kindred workers.
b. Professionals: Occupations which require specialized and theoretical knowledge,
which is usually acquired through college training or through work experience
and other training which provides comparable knowledge. includes personnel
and labor relations workers,accounting analysts, and kindred workers.
c. Technicians: Occupations which require a combination of basic scientific or
technical knowledge and manual skill, which can be obtained through specialized
post-secondary school education or through equivalent on-the-job training.
Includes: technicians, inspectors,and kindred workers.
d. Protective Service'Workers: Occupations in which workers are entrusted with
public safety, security and protection from destructive forces. Includes: police
and kindred workers.
e. Paraprofessionals: Occupations in which workers perforin some of the duties of
a professional or technician in a supportive role, which usually require less
formal training and/or experience normally required for professional or technical

status. Such positions may fall within an identified pattern of staff development
and promotion under a"New Careers"concept. Includes: welfare service aids,
recreation assistants,and kindred workers.
f: Administrative Support: Occupations in which workers are responsible for
internal and external communication,recording and retrieval of data and/or
information and other paperwork required in an office. Includes: bookkeepers,
