Barry, AICP Community Development Director DATE: September 24, 2002 SUBJECT: Memorandum of Understanding with City of San Pablo; Giant Road Extension Project— North Richmond Redevelopment Project Area SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS APPROVE and AUTHORIZE the Director of the Community Development Department and the Redevelopment Director to enter into a Memorandum of Understanding with the City of San Pablo to assess and implement, if feasible,the extension of Giant Road south to provide a truck route for North Richmond businesses located south of Wildcat Creek and east of the Richmond Parkway,in the North Richmond Redevelopment Project area. FISCAL IMPACT No General Fund money will be used on this project. The total project development cost is$30,000 of which$20,000 is being provided by CDBG and $10,000 by the Agency as will be shown in the adopted Fiscal Year 2002-03 budget. BACKGROUND/REASONS FOR RECOMMENDATIONS A major goal of the North Richmond Redevelopment Plan is to facilitate economic dev lopment and stimulate and attract private investment in the Project Area. These businesses provide a buffer between the residents and the railroad tracks, local employment opportunities and strengthening of the Forth Richmond economy. These businesses must route their truck traffic through the residential neighborhood to access the Richmond Parkway. The increased truck traffic has created concerns for safety, especially with the proximity of Verde Elementary School. Thus, there is a need to resolve the conflict and identify a feasible alternative truck access route. The County and the City of San Pablo have agreed to work together, and consult with the City of Richmond staff as they have businesses located between the railroad tracks,to explore the extension of Giant Road, south of Brookside Drive and then east to connect with Rumrill Boulevard. The County Redevelopment Agency had previously submitted,and was approved for,a$20,000 CDBG grant to plan an alternative truck route. The CDBG funds,and required local match by the Agency, will be used for the predevelopment work.The City of San Pablo,County Community Development Department,County Public Works Department,and County Redevelopment Agency have all agreed to work collaboratively to resolve the residential/truck traffic issue.The San Pablo City Council has received a presentation on the project and authorized City staff to work with County staff on the study. The North Richmond Municipal Advisory Council(NRMAC)Budget Subcommittee has approved the inclusion of this project and the Agency match as part of the upcoming Fiscal Year 2002-03 Agency budget. The North Richmond Budget is scheduled on the September 10th NRMAC information and the September 24`x'NRMAC action meetings. MEMORANDUM OF UNDERSTANDING(MOU) Between the City of San Pablo and Contra Costa County For the Giant Road Extension Project This AGREEMENT is entered into on the day of , 2002 between the City of San Pablo, a municipal corporation of the State of California,hereinafter CITY, and the County of Contra Costa, a political subdivision of the State of California,hereinafter COUNTY, pursuant to Government Code section 6500 and following. WHEREAS: high volumes of truck traffic have caused intrusion in residential areas of San Pablo and North Richmond; and Limited options for truck traffic have created a need for new routes that will facilitate direct truck access to the regional highway system while avoiding undue impacts on residential neighborhoods; and Communities in North Richmond and San Pablo have expressed their desire to reduce track traffic in their neighborhoods out of concerns for safety,noise, congestion and duality of life; and COUNTY and CITY have both expressed their commitment to assist these communities in making such improvements; and COUNTY has a $20,000 Community Development Block Grant(CDBG) available for use by a County staff person in planning a solution to the truck traffic issue; NOW THEREFORE the parties hereto agree to the fallowing: A. Purpose and method. 1) COUNTY and CITY will work together to define the Giant Road.Extension Project,which will extend Giant Road in a southerly and then easterly direction to connect with Rumrill Boulevard south of the Rumrill/Brookside intersection; and 2)COUNTY and CITY each will assign at least one staff person to work on the project; and 3)The outcome of the project will be agreement on the type of road facility (number of lanes, cross section, and intersection treatments at either end of the extension) and a general alignment for the road; and 4) COUNTY and CITY will consult with staff of the City of Richmond since the proposed project abuts an area within Richmond; and Page 1 of 3 ell 5)COUNTY and CITY will advise the West Contra Costa Transportation Authority of the project to ensure the outcome is compatible with the West Contra ; Costa County Action Plan and related traffic service objectives; , 6) COUNTY and CITY will work together on community outreach during the project,both from property owners directly impacted and the community in general,to seek input on the planning and definition of the project; and 7)COUNTY and CITY will work together after project completion to seek additional resources to be used for community outreach, engineering and design, and construction. B. Agreement Effective Date. This MOU will become effective on the date last signed below and shall remain in full force and effect until terminated by mutual written agreement of all parties hereto. Any of the parties hereto may propose amendments or modifications to this agreement. These amendments shall be incorporated upon ratification in writing by all the parties. C. Idemnification. 1. Neither COUNTY nor any employee or agent thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY or in connection with any work delegated to CITY under this MOO, and CITY shall defend, indemnify, save, and hold harmless COUNTY, its governing body, officers, agents and employees from the same. 2. Neither CITY nor any employee or agent thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by COUNTY or in connection with any work delegated to COUNTY under this MOO', and COUNTY shall defend, indemnify, save; and hold harmless CITY, its governing body, officers, agents and employees from the same. 3. Nothing in this MOU is intended or shall be construed to affect the legal liability of either party to third parties by imposing any standard of care greater than that imposed by law.
