RECOMMENDATIONS:
1 . DIRECT County Counsel to draft an ordinance restricting the sale of non-taxable
merchandise by large-scale retail stores based upon the attached 'ordinance recently
passed by the City of Martinez.
2. REFER the proposed ordinance to the CountyPlanning Commission'for public hearing
and to make recommendations to the Board of Supervisors.
BACKG QUND:
There has been a recent increase in the number of"big box" retailers in the county. The large.-
scale retail sures that devote a substantial portion of their floor area to the sale of non-taxable
items significantly increase traffic volumes, promote traffic intrusion into nearby neighborhoods,
discourage pedestrian travel, and increase traffic congestion. These stores also adversely
affect the viability of small-scale pedestrian friendly neighborhood commercial areas,
contributing to blight in these areas. Two reports detailing some of the impacts of "big-box"`
retailers are attached. To the extent that non-taxably: sales do not generate revenues to offset
the negative impacts, local government incurs a cost. Limiting the non-taxable sales in these
"big-box" retailers increases tax revenues to local government that can be used to mitigate the
negative impacts. The proposed ordinance provides that retail stores exceeding 90,000 square
feet of gross floor area could devote no more than 5% of their total sales floor area to the sale
of non-taxable merchandise,

AMENDING TITLE 22 OF THE MARTINEZ MUNICIPAL CODE,
ZONING, TO ADD RESTRICTIONS ON THE SALE OF NON-
MERCHANDISE'B Y BARGE-S CALVE RETAIL STORES
MMEREAS, the City of Martinez, through its General Plan, has identified
transportation and circulation-related goals that include maintaining an
adequate street network to provide the highest level of serLice possible,
protecting neighborhoods from traffic intrusion, and encouraging pedestrian
travel, in addition to other goals and policies for easing residents'frustration;
with traffic congestion,
WHEMAS, the City of Martinez, through its General Plan, has also
identified as a.primary goal the maintenance of economically and socially
healthy neighborhood commercial areas that provide day-to-day shopping'
and community services.
WHEREAS, large-scale retail merchandise stores that devote a substaxatal
portion of their floor area to the sale of non-taxable items significantly
increase::traffic volumes, strain the exiszing street network., promote traffic
intrusion into ne#rby neighborhoods, discourage pedestrian travel, and
otherwise aggravate traffic congestion.
WHEREAS, such stores also adversely affect the viability of small-scale,
pedestrian-friendly neighborhood commercial areas, contributing to blight in
these areas.
MM REAS, the City Council seeks io:limit the negative impacts of such
stares on traffic circulation, land use patterns, and the economic and social
health of neighborhood commercial areas.
WHEREAS, sales of taxable items generate tax revenues that can be used to
offset these and other negative impacts on the community.
VMER.E.AS, sates of non-taxable items generate no such revenues.

SECTION I Title 22 of the MartinezMunicipal Code, Zoning, is amended to
,Add Section 22.34,220 as follows.
22.34.220 I =- It an Lavge-Seale Retail Stores
For retail stores exceeding ninety thousand (90,000) square feet of gross floor-
area, no more than five percent (5%) of the total sales"floor area: shall be
devoted to the sale of non-ta-cable merchandise.
For purposes of this section, "sales floor aree" includes only interior building
space devoted to the sage of merchandise, and does not include restrooms,
office apace, storage space, automobile'service areas, or open-air garden sales'
space.
For purposes of this section, "non-taxable merchandise includes products,
commodities, or items not subject to California state sales tax
SECTION II: Severabillity, If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be invalicl or
unconstitutional by a decision of any court of competent,jurisdiction, such
decision shah not affect the validity of the remaining portions of this
ordinance. The City Council declares that it would have passed this
ordinance and adopted each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that any one or more sections, subsections,
clauses or phrases be declared invalid or unconstitutional on their face or as
applied.
SECTION ISI: EFFECTIVE DATE. This ordinance shall became effective
thirty (30) days after the date of adoption.
SECTION I7': POSTING. The City Clerk shall cause this ordinance to be
published at least once, with the names of those city council members voting
for and against theordinance, in a newspaper of general circulation
published and circulated in the City of Martinez.

retail industry over the past 30 years. National chains speer in discount pricing have been
driving the'retail trz4 by focusing on rural and surburbau popudatium growth centexs. These
large stores are called"big box"both because they ll.memhazldize in bulk and because they
