(District III) Project No.: 7760- 65147 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION 1. Recommended Action: APPROVE and AUTHORIZE Gray-Bowen and Company, Inc., as Interim General Manager of the Blackhawk Geologic Hazard Abatement District (CHAD) to execute a contract amendment with the Blackhawk Homeowners Association in the amount of$60,200 to provide reimbursement for damage done during the landslide repair work, Danville, California. II. Financial Impact: There will not be any impact on the County General Fund. The Blackhawk GHAD will fund 100%of this contract and the District is funded through revenues generated by County Service Area M-2 . Reasons for Recommendation and Background: In the fall of 2000, the CHAD initiated an investigation of potential sub-surface movement in the Sequoia Terrace/Conifer Terrace area of Blackhawk. A number of monitoring devices were installed on Homeowner Association property to monitor groundwater levels as well as sub-surface ground movement and six horizontal drains were installed in the hillside above Conifer Terrace. In April of 2001, some of the more sensitive monitoring devices began to detect very minor sub-surface movement. The GHAD's Geotechnical Consultants recommended that the GHAD initiate additional and more specialized geotechnical investigations in the area and ultimately concluded that there is an area of potential instability and recommended that the District initiate a project to install a number of ground anchors to increase the stability of the slope. Plans,specifications and estimates were developed for the project and the GHAT)advertised for bids. Pursuant to the provisions of Resolution 86/370,three pre-qualified contractors were invited to submit bids. Bids were received and opened in the office of the General Manager on December 1.3,2001,and the Board of Directors ratified the general Manager's decision to award the contract to Drill Tech Drilling and Shoring on December 18,2001. License Agreements providing the GHAD with sufficient rights to enter upon and repair the landslide as well as necessary indemnification were secured from all affected homeowners, as well as the Blackhawk Homeowners Association(HOA). As was originally anticipated, landscaping in the open space area owned by the Blackhawk Homeowners Association on the hillside along Conifer Terrace was damaged as a result of this repair project. Now that the project is complete,the Blackhawk Homeowners Association has obtained bids from two qualified contractors for repair and replacement of the landscaping. In order for the Blackhawk Homeowners Association to be reimbursed for this expense,an amendment to the License Agreement must be executed between the Blackhawk GHAD and the Blackhawk Homeowners Association. IV. Consec,Luences of.Negative Action.: Without Board approval,the CHAD would not be able to reimburse the Blackhawk Homeowners Association for the landscaping work on the hillside along Conifer Terrace.
