!. RECOMMENDATION:
DETERMINE that there is a need to continue the emergency action taken by the Board on
May 7, 2002 pursuant to Public Contract Code Sections 20134 and 22050, to repair the fire
damage and implement security measures at the County Administration Building at 651 Pine
Street, Martinez.
11. FINANCIAL IMPACT
Subject to a $10,000.00 deductible, fire damage control and repair costs are covered by the
County Property Damage Trust Fund up to $50,000.00 and by CSAC Excess Insurance
Authority Property Insurance Policy over$50,000.00.
111. BACKGROUND
A. On May 1, 2002, the County Human Resources Department experienced a fire that
damaged the file cabinets, fixtures, walls, and ceilings on the second floor, as well as
smoke damage to both the second and third floors and damage to other floors as may
later be determined.
B. By resolution No. 6, dated May 7, 2002, the Board 1) found that an emergency exists,
2) delegated to the General Services Director the authority to proceed in the most
expeditious manner with the evaluation, assessment, and implementation of fire
damage repair and restoration, 3) directed the General Services Director to make
reports to the Board, as required by the Public Contract Code Section 22050, stating
the reasons justifying why the emergency will not permit a delay resulting from
competitive solicitation for bids and why the action is necessary to respond to the
emergency, in order to enable the Board to review the emergency action and to
determine that there is a need to continue the action, 4) further delegated to the County
Administrator and Director of Human Resources and/or their designee(s) the authority
to proceed in the most expeditious manner with the evaluation and assessment of
security needs and the implementation of necessary security measures, 5) authorized

Auditor-Controller to disburse funds as required to implement fire damage repair and
restoration and to evaluate, assess, and implement security measures, fa) declared that
the project, as an emergency, is exempt from the provisions of the California
Environmental Quality Act under Public Resources Code Section 21080(b)(2) and (4)
and Section 15269(b) and (c) of the State CEQA Guidelines.
C. Immediately after the fire, the Director of General Services commenced: 1) assessment
of fire damage 2) debris removal, 3) ventilation of the second and third floors, 4)
installation of new locking devices on the second floor, 5) hired a security guard.
D. Further evaluation, assessment, and implementation of fire damage repair and
restoration are needed. Restoration of the file area and appropriate duplication of files
is necessary. In addition, security measures need to be assessed and implemented.
Therefore, it is necessary to continue the emergency action previously taken by the
Board in order to complete the cleaning, restoration and security measures in the
shortest possible time. To halt the continuing work and solicit open competitive bids to
complete the work would greatly prolong the process and extend the impact on Human
Resource Department operations and services.
E. It is necessary to continue to ventilate the fire damaged area and to further assess
measures to restore, duplicate and/or relocate files. Additionally, a security guard is
still assigned to the second floor and the Department continues to assess the need for
additional or alternate security measures. Therefore, it is necessary to continue the
emergency action previously taken by the Board.
F. Most of the fire repair work has now been completed, although the damaged files may
still need to be restored and/or relocated. The security guard remains on the 2"d floor
during regular business hours. The Human Resources Department continues to
assess the need for additional or alternate security measures. Therefore, it is
necessary to continue the emergency action previously taken by the Board.
G. The Human Resources Department continues to assess the need for additional or
alternate security measures. The security guard remains on the 2"d floor during regular
business hours and in the lobby area until midnight, Monday through Friday.
Therefore, it is necessary to continue the emergency action previously taken by the
Board.
H. Security guards remain in the building during regular business hours and in the lobby
area until midnight Monday through Friday. The implementation of building security
measures should be completed within 30 days, therefore, it is necessary to continue
the emergency action previously taken by the Board.
