Recommended Action: APPROVE project contingency fund increase of$7,000 for a new total of$44,346 effective August 13, 2002 in order to compensate the contractor, Siteworks Construction, Inc. for final settlement claims. 11. Financial impact: The project contingency funds are currently insufficient to coverthe increased cost.The increase in contingency funds will be funded by City of Brentwood Loan. Reasons for Recommendations and Background: An increase is necessary to resolve all outstanding issues and claims with the contractor.The claim items are from increases in item quantities (Concrete, asphalt concrete, base rock, rock slope protection, and striping), buried man made objects,waterline construction,and other miscellaneous items resulting from the contractors work during the summer and fall of 2000. Change order#5 will resolve all the outstanding issues and settle all claims on the project. IV. Consequences of Negiative Action: The lack of approval would prevent successful completion of this contract and preclude payment to the contractor for required work.
