HomeMy WebLinkAboutMINUTES - 08132002 - C62-C66 { TO: BOARD OF SUPERVISORS � FROM: , William Wafer, M.D. , Health Services Director Contra By: Ginger Marieiro, Contracts Administrator _ Costa DATE: July 31, 2002 County SUBJECT: Approval of Standard Agreement #29-395-18 with Office of AIDS SPECIFIC REQUEST(S)09 COMME ATION(S)`&BACKGROUND AND JUSTIFICATION RECOMMENDATION-LSI : Approve and authorize the Health Services Director, or his designee (Wendel Brunner, M .D. ) to execute on behalf of the County, Standard Agreement #29-395-18 with the State Department of Health Services, Office of AIDS, in an amount not to exceed $5, 131 for the County' s AIDS Drug Assistance Program, for the period from July 1, 2002 through June 30, 2003 . FISCAL IMPACT: Approval of this agreement will result in an allocation of $6, 131 from the State for County' s AIDS Drug Assistance Program (ADAP) for the period from July 1, 2002 through June 30, 2003 . The allocation will be used to cover the cost of certain drugs, plus dispensing fees, for eligible low income persons with AIDS and/or AIDS related complexes . These funds may not be used to cover patient monitoring, laboratory testing, or other medical services for persons receiving any of the drugs . The County may make provisions for copayment by patients, commensurate with the patient ' s ability to pay. BACKGOUND J REAS0X S) FOR RECOMMENDATION 6) : On August 7, 2001, the Board of Supervisors approved Standard Agreement #29-395-17 with the State Office of AIDS, to cover the cost of certain drugs which have been included in the AIDS Drug Program by the State and determined by the U.S. Food and Drug Administration to prolong the life of a person with AIDS, for eligible low income persons who are infected with HIV and/or' persons with AIDS and related complexes who meet certain criteria. Approval of', Standard Agreement #29-395-18 provides funding for County' s AIDS Drug Program, based upon actual and projected drug expenditures by the Department,' through June 30, 2003 . Four certified and sealed copses of the Board Order should be returned to the Contracts and Grants Unit for distribution to the State Department of Health Services . Services (Contracts) „ u BOARD OF SUPERVISORS Contra TO: 0 r FROM: JOHN SWEETEN, •' COUNTY ADMINISTRATOR Costa DATE: JULY 28, 2002 - County SUBJECT: LITIGATION SUPPORT SERVICES FOR JUVENILE HALL EXPANSION, TAMALPAIS WING PROJECT AUTHORIZATION NO, 0928-WH399B SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract amendment with Stein, Smith, Rdger and Cohen, LLP to increase the payment limit by $50,000 to a new payment limit of $75,000 to provide legal services in connection with the above construction project. FISCAL IMPACT: There will be no impact to the General Fund. The contracts will be funded from project funds previously appropriated. If the County prevails in the lawsuit, every effort will be made to recover the cast of the contracts as damages payable to the County. In any event, the County's recovery in the lawsuit should more than cover the cost of the contracts. BACKGROUND: On December 1, 1998, the Board awarded a construction contract for the Juvenile Hall Renovation, Tamalpais Wing project to Patrick M. Donaghue, General Contractor for $1,034,570. The contract involved the construction of a day room/sleep room/classroom addition to the existing wing at Juvenile Hall. The addition was to be constructed of cast-in- place, architectural concrete, with metal security doors and other security features. In 1999, the contractor performed concrete and other work with serious defects. After notifying the contractor of the defective work and giving the contractor opportunities to come up with an acceptable plan to repair or replace the defective work, Staff recommended termination of the contractor's rights under the contract. On August 10, 1999, the Board declared that the contractor was in material default, terminated the contactor's rights under the contract, and authorized legal action against the contractor and his surety (Insurance Company of the West) for the recovery of additional expenses and other damages 'incurred by the County as a result of the defective work. Suit was filed by the County on February 14, 1999. On March 13, 2000, the contractor filed a crass-complaint against the County seeking $985,000 in damages for alleged wrongful termination of the contract. In order to effectively present the County's case at mediation and trial and to defend against the claims asserted by the contractor, the County requires litigation support from Stein, Smith, Rudger and Cohen, LLP. FINANCIAL IMPAC'Ta $120,000: 100% County CHILDREN'S IMPACT STATEMENT_ The Dedicated Shelter Group Home program supports three of Contra Costa County's community outcomes: „Children and Youth Healthy and Preparing for Productive Adulthood"; 19Families that are Safe, Stable and Nurturing"; and "Communities that are Safe and Provide a High Quality of Life for Children and Families". This contract will provide children with stable, high-quality residential treatment after entry into the Child Welfare System. R A CK(;,R OUNDL This contract provides for two dedicated group homes (twelve beds), continuing services at established Central County and East County sites. Both homes are dedicated to Employment and Human Services under this contract, providing 24-hour intake, a no-restriction admission policy and specialized staffing and services to accommodate children whose backgrounds may be unknown at time of placement. Keeping children in Contra Costa County in the least restrictive setting possible helps with visitation and reunification efforts. Additionally, without these dedicated beds more children would be placed in costlier, more restrictive facilities outside of Contra Costa County. EHSD also realizes some cost benefits through improved caseworker access to children. FINANCIAL IMPAff $95,525 Multi-purpose Senior Service Program(MSSP), 100% State RAS SCR TINE The Multi-purpose Senior Service Program(MSSP)provides case management on a countywide basis for Contra Costa County residents age 65+years who are eligible for MediCal and certifiable for skilled nursing facility care. The purpose of the program is to provide case management services, including but not limited to assessment, care planning, service arrangement, and client monitoring, so clients can safely stay at home and avoid institutionalization. The increase in the number of individuals age 65+years in need of MSSP services has increased the need for the availability of services from community agencies. Affordable Home Care Agency provides personal care, protective supervision, household chores, and respite services to MSSP clients as referred by case managers. These services are vital to MSSP clients as case managers strive to maintain individuals age 65+years at home. BACK RfITTNDI- The Employment and Human Services Department (EHSD) provides support services to non-English speaking clients whose primary languages include Korean, Laotian, Tagalog, Russian, Farsi, Afghani, Vietnamese, and other languages. On-call oral and written translation services provide communication assistance to EHSD clients whose language needs cannot be met by staff. California Translation Service was selected from a competitive procurement, Request for Interest (RFI) 169 in July 2002 to provide translation and interpreter services. This contract provides supported communication necessary for services to clients and to meet California Department of Social Service civil rights requirements.
