SUBJECT: RECEIPT OF UPDATED AIRPORT LAND USE COMPATIBILITY PLAN
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. ACKNOWLEDGE the receipt of the updated Airport Land Use Compatibility Plan from the
Contra Costa County Airport Land Use Commission,which triggers a statutory 180-day period
to complete a plan consistency review with the County General Plan.
2. REFER the updated Airport Land Use Compatibility Plan to the County Planning Commission
for the statutory plan consistency review with the County General Plan and REQUEST the
County Planning Commission to submit a report with recommendations to the Board of
Supervisors within the statutory 1813-day plan consistency review period.

3. REQUEST the East County Regional Planning Commission to review the updated Airport
Land Use Compatibility Plan relative to the Byron Airport, and, as necessary, forward
comments to the County Planning Commission in a timely manner within the 130-day plan
consistency review period.
4. DIRECT the Community Development Department to submit an SB 90 claim to recover
certain costs associated with plan consistency review of the Airport Land Use Compatibility
Plan.
FISCAL IMPACT
Direct costs associated with the statutory plan consistency review of the updated Airport Land Use Compatibility
Plan are unknown at this time.However,certain costs associated with this review may be recovered through the
SB 90 process that allows a jurisdiction to submit a claim for reimbursement from the state for programs
mandated by state law.
BACKGROUND
The Community Development Department is in receipt of an updated Airport Land Use Compatibility Plan
prepared and adopted by the Contra Costa County Airport Land Use Commission(ALUC).Public Utilities Code
Section 21760, et seq., provides procedures for airport land use planning. The primary focus of the plan
concerns appropriate planning policies for areas near Buchanan Field and Byron Airport.The plan is based on
the adopted Master Plans for those two airports and the handbook published the California Department of
Transportation,Division of Aeronautics.The County is one of several local agencies within Contra Costa County
(including the cities of Concord,Martinez,and Pleasant Hill)with land use jurisdiction over significant portions of
the planning areas for both Buchanan Field and Byron Airport. State law requires that within 180 days of the
ALUC's adoption of an updated Airport Land Use Compatibility Plan, each affect local agency must:
• Amend its respective General Plan, and any applicable Specific Plan, as necessary, to be consistent
with the updated Airport Land Use Compatibility Plan; or, alternate ely,
• Adopt findings and override the ALUC in accordance with Public Utilities Code Section 21676(b)
[Government Code Section 65302.3].
The Department recommends the updated Airport Land Use Compatibility Plan be referred to the County
Planning Commission for plan consistency review with a request to report back to the Board of Supervisors
within the 180-day period established under state law.The document should be simultaneously referred to the
East County Regional Planning Commission with a request to forward comments relative to the Byron Airport,as
necessary, to the County Planning Commission. Additionally, the Department advises that certain costs
associated with the plan consistency review may be reimbursable through an SB 90 claim to the state.
