The Board of Supervisors RESOLVES THAT:
The County of Contra Costa on September 12, 2000, contracted with Roek Construction
(Roek), for the New Office Building at Delta Fair Boulevard, Antioch for Employment and
Human Services Department, Budget Line Item No. 4423-4420, Authorization No. 0928-
WH424F, with National Fire Insurance Company of Hartford as surety, for work to be
performed on the grounds of the County; and
The Director of General Services reports that said work has been inspected and complies with
the approved plans and specifications, and recommends its acceptance as complete as of
August 13 2002; and recommends the withholding of$16,500.00 pursuant to the "withhold
summary" provisions of the contract between Roek Construction and the County; and
Therefore, said work is accepted as recommended above, and the Clerk shall file with the
County Recorder a copy of this Resolution and Notice as a Notice of Completion for said
contract; and the Director of General Services is directed to withhold monies otherwise due
as authorized herein.

SUBJECT: RESOLUTION OF ACCEPTANCE AND NOTICE OF COMPLETION
FOR CONSTRUCTION OF THE NEW EMPLOYMENT & HUMAN
SERVICES OFFICE BUILDING AT 4549 DELTA FAIR, ANTIOCH
The new office building for Employment & Human Services at 4549 Delta Fair Boulevard in
Antioch, which was constructed by Roek Construction ("Roek'), was partially occupied by EH
on July 1, 2002 and completed by August 6, 2002. To accept the project as complete, a
Resolution of Acceptance and. Notice of Completion has been prepared and is presented to the
Board for approval.
While the project is complete, there still remain several minor punch list items, including
landscape repairs. These are covered by a withhold letter signed by the contractor(Roek), which
specifies that $16,500 will be withheld from project funds until the punch list items have been
completed. If the items are not completed by September 12, 2002, the County may use the
withheld funds to complete the items.
During the project, Roek notified the County of several potential claims. On November 15,
2001,Roek submitted to the Board of Supervisors one claim involving alleged construction work
disruptions caused by the County. The .Board rejected that claim on December 4, 2001.
Subsequently, on June 3, 2002, Roek filed a lawsuit on that claim in the Contra Costa County
Superior Court (Case No. CO2w01623), seeking damages exceeding $125,000. It is possible that
Roek may file additional claims involving disagreements over the construction specifications.
General Services staff will work with County Counsel to attempt to resolve the above lawsuit
and the claims associated with the project.
Despite the potential construction claims, the construction work is complete and the project is
ready for acceptance. Therefore, the Department of General Services recommends that the
Board adopt the Resolution of Acceptance and Notice of Completion and direct the Clerk of the
Board to file the document with the Recorder's Office.
