SUBJECT: CONTRACT FOR FACILITATOR FOR THE INDUSTRIAL SAFETY ORDINANCE
PUBLIC PARTICIPATION PROCESS

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract
with Paper, Allied Industrial, Chemical and Energy Workers (PACE) International Union in the
amount of $20,000 to provide facilitation services to assist the public in reviewing,
understanding, voicing their concerns and preparing comments in response to safety plans
and programs, and audits thereof, required of the Tosco Refinery at Crockett/Rodeo under the
County's Industrial Safety Ordinance, for the period September 1, 2001 through January 31,
2002.
FINANCIAL IMPACT:
The Board of Supervisors previously approved an allocation of$50,000 to be charged through
facility inspection fees for this program. The Internal Operations Committee decided to
conduct the public participation program in phases by area, and decided to allocate $20,000
of the $50,000 approved by the Board for this, the first phase of the program.
BACKGROUND:
The Board of Supervisors adopted an Industrial Safety Ordinance (ISO) that took effect on
January 15, 1999 and supplements requirements of the Federal Risk Management Program
and the California Accidental Release Prevention Program. The ISO currently applies to
seven industrial facilities in unincorporated Contra Costa County, and requires them to
develop safety plans, implement safety programs, and investigate and conduct root-cause

analyses of specific incidents. The ISO also requires County staff to audit and inspect these
facilities, and approve their safety plans. In addition, the ISO allows the public the opportunity
to provide input into the development of the safety plans and programs.
On December 12, 2000 the Board of Supervisors requested County staff to develop an
enhanced public participation program to assist the public in reviewing, understanding,
voicing their concerns and preparing comments in response to safety plans and
programs, and audits thereof, required of local refineries under the County's Industrial Safety
Ordinance. On April 3, 2001, the Board approved staffs program, which included the hiring of
an entity to serve as a facilitator for the public participation process, and requested the
Internal Operations Committee to establish criteria for the selection of the facilitator and to
conduct public meetings to receive input on the public participation process.
On May 7, the Internal Operations Committee conducted an evening meeting in Rodeo to
consider a draft request for proposals (RFP) for a firm to facilitate public participation in the
Industrial Safety Ordinance, and to receive public input on the RFP and the process. As a
result of the meeting, County staff was asked to return to the Committee on June 4 with a
revised draft RFP and suggestions for potential appointees to a selection committee.
Committee staff provided this information to Rodeo meeting participants in advance of the
June 4 meeting.
On June 4, the Internal Operations Committee approved the revised draft RFP and directed
staff to issue it with a response deadline of July 6. The Committee also directed staff to
organize a public meeting to receive comments on the RFP responses. This meeting was
held on July 19 in Rodeo. No responses were received at that time; however, responses
received subsequent to that meeting were given due consideration by the Internal Operations
Committee as part of the selection decision.
The Internal Operations Committee, at its regularly scheduled meeting on August 6, 2001,
reviewed proposals submitted StrategiComm; McDaniel Lambert Inc.; Ecology and
Environment, Inc.; PACE; and Inform Public Relations, and recommends that the Board of
Supervisors award the contract for this project to PACE. The PACE proposal will be a joint
effort of PACE, its Local Unions and the Labor Occupational Health Program at the University
of California at Berkeley.
